“A Home Is a Home” Conversation Starter

From time to time, it is healthy to have a conversation about the best way we can move forward in a changing world, and in doing so, think through some potential long term goals and aspirations. If we do not at least have those conversations and think these sorts of ideas through, then we are guaranteed that nothing changes.

What follows are simply conversation starters based on my personal observations, no more and no less. They represent no more than my own thoughts.

To quote the American political philosopher, Robert Nozick, “My thoughts do not aim for your assent – just place them alongside your own reflections for a while.” In that spirit, I would offer the following ideas for our industry in Virginia:

Elimination of titles for manufactured homes — While we have been quite successful in cleaning up titling in Virginia, we should have a conversation about the continued long-term need for titles for manufactured homes. We sell homes, not cars, and as such, we should think about how to find a way to convey ownership and perfect personal property security interests in a way that reflects that fact, and in doing so, simplify the process for manufactured homes that are sold as real property. To be sure, doing this would require a viable alternative method of securing personal property interests in manufactured homes. Without such an alternative, elimination of vehicle titles for manufactured homes cannot happen.

Elimination of zoning discrimination against manufactured housing — We need to think about ways to eliminate zoning discrimination against manufactured housing in Virginia. A home is a home.

Being clear about what makes us who we are — We need to be clear that we are simply a mode of construction, just like our site-built friends and our colleagues in the apartment industry. Things beyond that distinction do not define us, and we should not let them. We are not a niche or boutique industry. We are no different than our site-built friends. We are not better, nor are we worse. We build homes, many times in a more efficient manner than many of our competitors. We sell those homes. We lease those homes and the land they are on. That is no more and no less than anyone else in the housing industry.

Embracing our diversity — We should embrace the diversity that characterizes various forms of factory built housing, and in doing so, make sure that we do not allow regulators and others to play us all off against one another. We all should support equity in zoning (a home is a home); all of our homes are well-built. We should, however, also be open about the various styles of construction and what distinguishes them.

Positioning ourselves for a changing development patterns — We should have a conversation about how we position ourselves in a nation that is becoming more urban and suburban and less rural with each passing day. For example, one trend in redevelopment is the use of mixed -use, mixed-income planned unit developments. Our homes (both manufactured and modular) offer the perfect solution for a number of the residential components of these types of neighborhoods at a cost per-square-foot and at a level of quality that allows us to compete favorably with our site-built competitors. But we need to make sure we have the right regulatory and marketing framework in place.

Again, these are just conversation starters. Nothing more. Nothing less. As always, I welcome your thoughts. ##

Are Frameless HUDs a MOD under state laws?

The question of whether a “frameless” factory built home might be considered a modular home under state law is an interesting question.

To me, if the definition of “manufactured home” is amended to delete the requirement that a manufactured home have a permanent chassis, it wouldn’t matter what state law says.

If a frameless home receives a HUD label, that label is preemptive and the home is a “manufactured home” within the federal meaning of that phrase.

What is more interesting is if the term “manufactured home” is amended to exclude RV trailers larger than 400 square feet so a larger RV trailer could be built, since that unit is not defined in a federally preemptive way, then yes, state law could define that unit as a modular home.

So for the RV industry to produce a non-regulated home at either the federal or state level, they would need to amend federal and all state laws. ##

Grass Cutting, Delinquency Goals and Modern Marketing

Tony,

Just wanted to leave a quick note about the educational seminar you spoke at regarding “Modern Marketing.” I brought a few community managers along for your presentation…it was a real eye opener for them and me. While we take pride in the fact that our managers and staff maintain their communities and do a good job in collecting site rent, there is more to being successful than cutting grass and meeting the delinquency goals. The days when our customers came to us bringing their homes into our communities are long gone. If we can implement just a few of the ideas from your presentation it will make a huge difference how we will be able to attract potential customers to purchase homes and live in our communities.

I will certainly bring more of my community managers along if you will be speaking again at the 2015 Louisville Home Show.

You Might Be a Redneck!

Hurricane Isaac Preparation Guide / 10 Point Plan

kurt-kelley-posted-in-mhpronewsThe latest track shows Hurricane Isaac to be a Category 1 storm that will track through the New Orleans area then N, NW all the way through northern LA. This will likely affect our clients in Hammond, Gonzales, Alexandria, Denham Springs, Houma, Prairieville, Alexandria, Opelousas, Morgan City, Monroe, LA and South and Eastern Mississippi.

Here's Ten key recommendations for those in the path of the storm.

1) Single section homes not lot set should have the air let out of the tires;
2) Homes should be moved closer to wind breaks if possible – but should avoid being set next to large trees;
3) Unsecured property should be moved inside or secured. Dead or untrimmed trees should be trimmed/removed;
4) Management should know the cell phone numbers of all employees. Land lines may be down and texting may be the best way to communicate;
5) If the main location loses power or has a catastrophic hit, there should be second location designated for a meeting place for all able-bodied employees;
6) Write the direct contact information down for your insurance company(s). Claims reported first tend to be adjusted first. Mobile Insurance’s claims number is 800-458-4320;
7) Know the contact information for all key utility (electric, phone, data, water, computer service…) and other suppliers (fire, police,..);
8) Systematically power down and disconnect computer systems to prevent them being damaged by power surges;
9) Place a note on your website outlining what clients should do in the event you are shut down; and
10) Take a video of your property as it exists right now / pre –storm. Be sure to include all real property improvements, home inventory, as well as building contents.

Take these steps and you will limit your exposure. ##

I read Tony Kovach's recent Masthead blog post with some fascination. Because the upcoming elections are on my mind too. Many of us feel that we are watching something slip away. Many of us want to make sure that we continue what was started in 2010, when the House or Representatives was retaken by 'tea party conservatives'.

I did a post on LinkedIn recently, asking questions about the impact of the Nanny State on manufactured housing professionals. Here are a pair of the statements, quoted below verbatim, with the initials of the person who made the comment:

The industry is, I agree, significantly over-regulated. Often intentionally, exemplified with the number and types of superfluous disclosures to prospective residents our legislature seeks to add, and also as the unintended consequence of legislation targeting others (SAFE Act as to sale of park owned homes, Red Flags, Safeguard Rules, Patriot Act, etc.)” TD

The problem is that sometimes we get what we "wish for" – the HUD Code. Many manufacturers in the industry wanted HUD regulation to avoid regulation by each state. Tony is correct – the largest shipment year was 1974 – the year before the HUD Code, but, there were other factors at work as well.KR

Lincoln Union Forces MHProNews

We have so many things that can inspire us Americans. One of the countless examples is Abraham Lincoln, who suffered defeat after defeat in his personal career, only to keep coming back through dogged persistence to accomplish his goal.

Lincoln is famous for three reasons one his election in 1860, two his struggle to hold the Union together in the Civil War. But Lincoln is also famous that his life was riddled with failure and he overcame it time and time again. Here is just a small sampling of his failures;

1831 Failed in business

1832 Lost his job

1836 Had a nervous breakdown in bed for 6 months

1843 – Ran for Congress and lost

1848 Ran for re-election to Congress and lost

1858 Ran for US Senate and lost

1860 Ran for President and won.

The question – how many failures can you endure and carry on? The answer that Abraham Lincoln gave with us with his life example is to keep on keeping on until you accomplish that worthwhile goal.

Great things can be accomplished by team work. Pulling together can happen professionally as well as politically. That is why associations and parties exist. One thing is certain, "United, we Stand. Divided, we fall."

There is no need for perfect unity, nor is it possible. America became free of England not because everyone stood together! They became free because enough stood together to make it happen. Some say that perhaps 1/3 of the people were engaged in the effort and supported independence.

So don't think that just because there is opposition that we are thus 'doomed to fail.' YOU be a part of the solution. Gather others of like mind. Share the truth well, and some will accept it. That is how you get 'enough.'

The same can be true for us now as it was for the American Rebels at the time of the Revolution, as we work to reverse a long string of legal and regulatory setbacks to our liberties. We can do it. We are Americans. Amer-I-CAN.

The economic times give manufactured housing professionals an in unprecedented opportunity. Lower incomes means more people than ever before are looking for affordable quality homes in America. But we won't accomplish it unless we get some regulatory and legal hurdles out of the way.

What is the the future of independent Manufactured Home Communities?

A question brought up by an individual at a real estate investment group meeting in  Tacoma, WA did not get answered at that time so thought I would attempt to put my perspective on it and then get feedback as to other people’s opinion.

The question:   Where do you think the MHP industry (a.k.a. Manufactured Home Park, Manufactured Home Community, Land Lease Community) is headed?

To start, I will explain some of the chatter on the internet on this subject.

Many are under the impression that within 5-7 years the MHPs will fade into history. Manufacturers are not listening to MHP Owners and are not building the types of manufactured homes needed to fill the lots available in the older MHPs.

The MH Retailers have such a high markup from the factory price that the end users cannot afford their homes.

Banks & Mortgage Companies are not interested in financing a “mobile home” that is not attached to land.

So MHP Owners have had to step in and do the financing for the individuals looking to buy. Politicians are trying to over-regulate the industry by passing new laws dealing with financing, rent control, maintenance issues. Their interference with the free market is killing the industry overall.

On paper in WA (lip service?) some politicians have made efforts to extended benefits to help Owners maintain and develop MHPs as the last form of affordable housing. Yet they did not provide funding to support their magnanimous ruling on paper.

On top of all this the taxes keep going up – calculated as a commercial operation according to the Pierce County Assessor’s Office instead of as multifamily residential. That is where it stands. In order to bring some relief to the overall picture all parties need to get together and work out a solution.

There are numerous summits and all of the above are represented, except there are no representatives from Mobile Home Park Owners that count. The ones who have 500 -1000 units are there, but they do not represent the ‘mom and pop’ MHP Owners as a whole.  Community Owners need to get their input into these meetings in some way.

Another problem that will arise is that many Owners are from out of state and depend on a mismanagement company to run their operations. They do not have an office on site – their office is 5-10 miles down the road or more. These MHPs fall into a state of disrepair and then the city officials step in and close them down.

The tax base from the personal property taxes are not very much. By closing the MHPs down, then they can build a new car dealership or motel that brings in more taxes for the city. Watch over the next 3-7 years to see how many MHPs are closed by city officials and not a developer Buyer.

As for the smaller operations – business will continue as usual. A home is abandoned – take it over, rehab it or have a Lonnie Dealer do it for you with you providing concessions for them. Sell the homes and finance it with a note. Same with those that are selling their homes: Buy it at a discount, rehab it, sell it on a note – never RENT a MH. If repo homes come available in another MHP – the Owner of that MHP should jump on the opportunity of keeping the home in their MHP. If they do not and it is available, you need to buy it, relocate it to your MHP and get it occupied.

Several of the trainers for the Washington State Mobile Home Community Owners Association have provided classes explaining to all in attendance that for each home that comes into your MHP you increase the overall value of your MHP.

For example if lot rent is $400/month and you bring in a home to fill a vacancy. The rent for one year is increased by $4800 (12 X $400). Dividing this by 0.10 (10 CAP) the value of your MHP just increased by $48,000.00. As long as you have the frame in your MHP, the mobile home can be rebuilt and your income stream will continue to flow in.

One MHP can be considered a pretty decent retirement plan. Most people who get involved in the industry are not satisfied with just one and may have more. Just be careful not to get overextended. Why?  The scuttlebutt on the internet is that the commercial loans will have the same problems as the residential loans. One cause is that loans are not being made. The financial institutions are saving their funds for when interest rates climb to 11-12%. (A rumor was started that this was supposed to happen in November 2009). The main cause will be that the banks and mortgage companies will be sticking their noses up in the air and looking down on financing or refinancing of MHPs. Many MHP Owners have 3-5-7 or 10 year balloons that will be coming due soon.

Last year at the convention I brought this up and one of the instructors stated that one of his clients was in this type of predicament. One solution is for the use of Private Money to bail out fellow MHP Owners. The elimination of the banks and mortgage companies would be a great relief to many. Yet, who has deep enough pockets to take them out of the picture?
