Act Today to Preserve Manufactured Housing Lending!

Our congressional delegation will be heading back to Washington DC soon after being in their districts for most of August. If you haven’t already done so, please contact your elected Representative today about the harmful impact new financial regulations will have when they go into effect.

The primary focus of our industry nationwide is to remove harmful provisions in federal financing and consumer protection law that are set to begin in mid-January.

One of the primary issues is the fact that industry lenders could be held responsible for the discussions and actions of salespeople on retail lots and in communities.

The other issue is government restrictions on how high interest rates can be for home loans. Manufactured housing loans are usually lower balances and shorter terms than site-built housing which causes the rate caps to be restrictive.

Some manufactured housing lenders are considering exiting the business if these provisions are allowed to take effect and this clearly is something the industry cannot afford.

The industry is attempting to amend these harmful regulations out of federal law before they go into effect in January. HR 1779, the “Preserving Access to Manufactured Housing Act” was introduced in the United States House of Representatives and currently has more than 60 co-sponsors. The Manufactured Housing Institute estimates we need about 120 co-sponsors nationally in order to move this legislation.

So far, two of Indiana’s nine Representatives have signed on as co-sponsors of this legislation – Congressman Marlin Stutzman and Congresswoman Jackie Walorski – and we need more support.

The current House recess is a good opportunity to contact your elected Representative to discuss the legislation is critical to Indiana jobs, our industry and your business. Get with your state association and/or MHI to see what are the best wasy that you can team up with others to move this into a win column for our industry. ##

Preserving Access to Manufactured Housing

The manufactured housing industry has been confronted with the most serious challenge to its existence in its history in the form of the Dodd-Frank bill. Supporters of the bill failed to take into consideration that, as written, the Dodd Frank bill effectively eliminates chattel (home-only) financing for loans under approximately $78,000. The bill essentially lumps chattel lending criteria in with the same real estate lending restrictions, thus ignoring the higher cost of funds for home-only loans. As the loan amount declines, and the higher cost of funds plus the fixed costs of making a loan effectively kick home-only loans into the predatory lending category once the loan amount hits some $78,000.

H.R. 3849 is a proposed bill that has been introduced into the House of Representatives by Indiana's Congressman Joe Donnelly and Tennessee's Congressman Stephen Fincher. The bill is aptly titled the Preserving Access to Manufactured Housing ActIn addition to limiting the impact on manufactured chattel loans from the restrictions described above that were introduced by the Dodd-Frank bill, the proposed H.R. 3849 would exempt manufactured housing salespeople that are not deriving income from the proposed financing the salesperson is trying to arrange.

Oklahoma was the second state after Mississippi to have its entire congressional delegation signed on as co-sponsors of HR 3849. I was able to help secure the backing of Oklahoma's congressional delegation through meetings with either each of our congressmen, or with their staff member with responsibility for housing issues. The following points were helpful in securing their support:

  • Manufactured housing is not only the most affordable housing available in the United States, our production capabilities are the most efficient in the world for the production of entry level housing.
  • The manufactured housing industry although monitored by HUD, is self-funded through label fee payments to HUD. How many functions of the federal government have no financial drain on the government's resources?
  • Failure to act will eliminate the financing options for all potential purchasers in the very lowest economic sector of our market, those people trying to purchase homes under $78,000. Our industry's average loan is $58,000. The single-wide market would essentially be destroyed.
  • Failure to act will eliminate all financing options for about half of the existing 8.8 million manufactured home owners who may try to sell their homes, so they also have an incentive to contact their congressman and senators.
  • Your congressman should be receptive to our industry's message. You do need to get in front of him or her. Getting to Washington, D.C. may be cost prohibitive, but getting to the congressional offices in each of your home states should be doable.

A pressing need at the moment is to find a Democratic senator to help roll out a senate version of H.R. 3849. Senator Tom Coburn (R, OK) has agreed co-sponsor the bill on the Senate as long as we have a Democratic co-sponsor who has the approval of Senator Harry Reid for the roll out. Please inform me if that occurs and I will inform Senator Coburn. # #

MHI PAC and the Upcoming Midterm Elections

Industry in Focus Reporter Eric MillerWASHINGTON, DC – Indiana representative Joe Donnelly is the top recipient of contributions from the Manufactured Housing Institute Political Action Committee (MHI PAC). According to OpenSecrets.org, Donnelly received a $6,000 contribution during the 2010 election cycle.

As of October 13, 2010, receipts totaled $101,019.00 with $79,590.00 cash on hand. Total spent amounts to $118,584.00. Sixty-five percent of contributions were made to Democrats and 32 percent went to Republicans, with specific Republicans receiving some of the largest contributions.

Donnelly and several key members of the Manufactured Housing Congressional Caucasus are facing tight races. The biggest recipients in House of Representatives races include Barney Frank (D-MA) with $3,000 and Bill Posey (R-FL) also with $3,000 and Baron Hill (D-IN) $2,000. In the Senate races, top recipients include Blanche Lincoln (D-AR) with $4,000 and Richard Shelby (R-AL) with $3,500.

In terms of voting records on industry related issues and the S.A.F.E. Act, as well as Title 1 reform and Duty to Serve, were all contained in the Housing and Economic Recovery Act of 2008 (HERA). In the Senate, Reid, Shelby and Lincoln all voted for the Act. Then-Senator Obama did not vote. In the House, Donnelly, Hill and Frank all voted for the bill. Posey was serving in the Florida State Senate at the time. Would-be Speaker of the House John Boehner voted against HERA.

The National Association of Homebuilders (NAHB) and the National Association of Realtors (NAR) has also provided contributions to these candidates. As of October 13, Donnelly received $1,000 from the NAHB PAC. Frank received $5,000 from NAHB, as did Posey. Hill is not listed as having received a contribution from NAHB. In the Senate races, NAHB gave $2,500 to Lincoln and $5,000 to Shelby. In contrast to MHI PAC’s contributions, the NAHB gave 39 percent to Democrats and 60 percent to Republicans. The total spent by the Homebuilders in the 2010 cycle is $3,012,057.

Contributions by the National Association of Realtors far exceed that of either the NAHB or MHI. As of October 13, the Realtors gave 58 percent to Democrats and 41 percent to Republicans. Donnelly received $6,000 from the Realtors, Frank received $6,000, Hill received $6,000 and Posey was handed $5,000. In the Senate races, Lincoln received $14,000 and Shelby $3,000. Total expenditures for Realtors in the 2010 cycle are $11,218,449.00.

Democrats currently hold a 256-178 majority in the House of Representatives, with one vacancy. The battle for control of the House focuses primarily on 64 competitive races–58 Democratic-held seats and 6 Republican-held seats including 9 members of the Manufactured Housing Caucus.

According to MHI, two races that are particularly important to the manufactured housing industry are those including Congressman Baron Hill (D-IN) and Congressman Joe Donnelly (D-IN). Beyond financial contributions, MHI says it will be working with members in these key districts to get-out-the-vote for their candidates.

According to their report to members at their Denver meeting in September, MHI believes as do many political analysts that a Republican takeover of the House of Representatives is possible. If so, House Minority Leader John Boehner (R-OH) is in line to become Speaker of the House. A GOP majority would mean major changes as a number of senior Democrats chairing committees important to manufactured housing would face demotions to lesser roles including Housing Financial Services Chairman Barney Frank (D-MA), a staunch supporter of manufactured housing.

The current Senate line-up is 57 Democrats, 41 Republicans and 2 Independents. The Republicans must win 10 seats to recapture the Senate. The odds favor continued Democratic control, but a significant surge by Republican candidates could lift the Republicans into striking distance of gaining control of the Senate.

Follow-up to May 26 Housing Alert

This Industry Voices post is a follow-up to the May 26 MHI Housing Alert.

MHI members have been working hard on issues related to the SAFE Act, both on the national level and the state level for almost two years, and we appreciate all of your efforts leading up to this point. Based upon some questions MHI is receiving about the Housing Alert of May 26 on the SAFE Act and H.R. 5369, I want to emphasize that the proposed legislation does not seek an outright exemption for retailers of manufactured and modular homes. The language in H.R. 5369 is intended to exempt activities which are administrative and clerical in nature that facilitate the sale of a home to a consumer such as assisting customers in completing paperwork by answering questions, etc. Language in the SAFE Act as originally passed by Congress in 2008 should have accomplished this goal, however, as we all know, the model legislation developed for the states canceled out this exemption.

Initially, our strategy was to advocate for an outright exemption, but Members of Congress indicated that this was not an option. They clearly communicated that the intent of the SAFE Act was to regulate the activities of individuals, not specific professions. The introduction of H.R. 5369 is an important step in bringing the influence of Congressional leadership into the process and will serve as a tool to elevate the need for clarification and relief for this industry before both Congress and HUD. The bill, in combination with over 5,000 comment letters submitted on the proposed rule to implement the SAFE Act, will assist MHI members and states in accomplishing the goal of allowing clerical and administrative tasks to be exempt activities under the SAFE Act.
