Town’s Stance Against “Mobile Homes” Caused Division, Uncertainty – MH Association Reacts, Video, Report

In May, the McBee Town Council passed a temporary moratorium on manufactured homes from being placed in that town’s city limits.

 

WISTV reports that the motion read, “Mobile Homes are prohibited from being placed on any lot within the town limits of McBee, South Carolina and any current uninhabited mobile homes cannot be occupied and that the Mobile Home Ordinance will be reviewed and updated within the next 90 days.”

I’m a single mother of four kids. I’m going to try not to cry,” said Carrie Johnson, with her voice faltering with emotion. “I’m mad, I’m angry, and I’m hurt.”

Johnson, and her four daughters had been living in two-room single section home, stated WISTV, but then she got good news: a plan to rent a double wide1 and move it to the small town of McBee.”

I’ve seen pictures of it, and it’s beautiful. To me, it would be their mansion,” she said of the manufactured home.

The sudden controversy has caused some like Johnson to feel less than welcome, said WISTV. The resident feels like she’s thought of as “trailer trash” or a “second-class citizen” in the Town of McBee, “a town where some estimate there are more mobile homes1 than stick-built homes.”

But Johnson says that slice of her American Dream is now uncertain, due to McBee’s planned change in their ordinance.

According to a councilman Kemp McLeod, McBee simply isn’t discriminating at all. “It’s not the intent of the town to judge anybody,” he said. The town needed to make sure manufactured homes weren’t blocking right-of-ways, were hooking up to the water system correctly, and weren’t devaluing homes already here.

But that councilman’s statement reflects a common mistaken notion is disproven by Trulia and a study by two economic researchers, previously reported in the report linked below.

McLeod’s comment also represents a potential unjust taking, as was a decision in a recent court ruling in a high court ruling in Iowa.

Associations, Associations…

The Manufactured Housing Institute of South Carolina is working with the city officials in McBee,” said Mark Dillard, Executive Director Manufactured Housing Institute of SC (MHISC) to the Daily Business News on MHProNews.

We’ve offered to help them put together an updated manufactured home ordinance.  We’ve always found it works well to get with officials during the early drafting stage,” Dillard said.That’s when you can have the most influence.”

That fits with what MHISC’s Ed Schafer said to MHProNews in 2016, who’s praise for forward looking towns hints that there are others that aren’t so open minded.

But the battles in South Carolina – which has one of the highest percentage of manufactured homes in the housing stock – rages on there, and elsewhere in the U.S. too.

Third-party researchers who’ve been contacting MHProNews have asked variations of the following question. ‘Given the national scope of the problem, isn’t this something that a national trade association should be addressing?’

Fair question. Two MHI connected sources suggested to MHProNews today that MHI has not taken any apparent interst in the McBee matter.

It’s one of the reasons why the Washington, D.C. based Manufactured Housing Association for Regulatory Reform (MHARR) has said that a new national post-production association is needed to supplant what is often seen as the failures of the Arlington, VA based Manufactured Housing Institute (MHI) from habitually acting.

Those failures aren’t new, argued former MHI award winner, Marty Lavin, who explained that MHI has long worked in favor of the interests of their largest members.

Long time, now former, MHI member George Allen recently said that the problem with MHI is summed up as “Perennial corporate consolidation and power plays among far too few elite producers of HUD-Code manufactured homes, along with far too few purveyors of chattel capital…”

While some might quibble over Allen’s conclusion, the problem he described echoes a point Sam Zell has also made.  High regulatory barriers results in more consolidation.

But beyond the cost to business, is the far higher cost to would be manufactured home owners.

MHI in recent years has responded only after months, or years, of pressures from within the industry, per voices inside and outside of that trade body.

President Trump – “Bigger than Watergate,” “We Need Accountability” – National, MH Industry Impacts

Imagine if during the 2008 campaign, if someone in the Bush Administration had planted one or more FBI informants in then Senator Barack Obama’s campaign. Then further imagine, that federal investigations were started, based in part on information paid for by opposition to then-candidate, Senator Obama.

 

Then envisage that word of that hypothetical attempt to illegally influence a presidential election had leaked out, or if the story was broken by news media. That would have been a huge scandal, and rightly so.  Part of the bedrock of the American political system are free and fair elections.

To have the power of the federal government weaponized for political opposition purposes would debatably be “worse than Watergate.”  That wouldn’t be a partisan issue, its a question of integrity and the rule of law to protect the rights of all.

There is no evidence that the above hypothetical ever occurred during the Bush years.  But there is mounting evidence that federal taxpayer funded resources were used to influence a presidential election.

That in brief is what President Donald J. Trump’s Thursday tweet means with respect to Obama-Clinton operatives.

That has sparked political pundits, media outlets, and public reaction.

Wow, word seems to be coming out that the Obama FBI ‘SPIED ON THE TRUMP CAMPAIGN WITH AN IMBEDDED INFORMANT,‘” the president tweeted in reference to a National Review report published last week, said the Hill, a news source based in the nation’s capital.

For those who may not recall, the Watergate scandal occurred when President Richard Nixon, a Republican, was tied to the attempted coverup of a crime, in which former FBI and CIA agents broke into the offices of the Democratic Party and George McGovern (that year’s Democratic Presidential candidate).

Watergate was the location for the DNC offices at that time.  The Watergate break-in was an illegal political spying effort, designed as part of an illicit plot to help defeat McGovern.  It was no doubt a dark, ugly chapter in our nation’s history.

The photo above at the left is an aerial view of the Watergate complex, the buildings which at the time were the office of the Democratic National Committee (DNC). That’s what gave rise to the name of the break-in and cover-up scandal, called, Watergate.

But today, we’re not talking about former federal agents.

Rather, the concern is that active, paid FBI and other federal agency staffers have illicitly been involved in derailing a political campaign – and post-election – of attempting to unseat a duly elected president.

If the leak yesterday – that the above concerns are part of what an upcoming inspector general report will allegedly reveal – that would be a bombshell.

Andrew McCarthy says, ‘There’s probably no doubt that they had at least one confidential informant in the [Trump] campaign.’ If so, this is bigger than Watergate!

There are now numerous reports that allege that Obama-era led agencies used their surveillance powers to monitor and attempt to disrupt the Trump campaign.

This is not the first time that the Obama administration has been accused of spying on the Trump campaign.

Last year, President Trump accused the former president of wiretapping Trump Tower shortly before the 2016 election.

Terrible! Just found out that Obama had my ‘wires tapped,’ in Trump Tower just before victory. Nothing found. This is McCarthyism!” the president tweeted in March 2017.  Then White House Press Secretary Sean Spicer later clarified the tweet to mean that the Trump campaign had spied upon, not a literal wiretap.

Attorney, Author, Talk Radio Mark Levin Calls for Accountability

 

MHVille – First Look

The Daily Business News has for over a year made the case held by thousands of manufactured housing professionals, from coast-to-coast. Namely, that the current Trump administration has been far more business-friendly than former President of the United States (POTUS) Barack Obama’s Administration was.

The National Federation of Independent Business (NFIB) and others have praised President Donald Trump for his pro-growth, pro-business policies.  The NFIB has hundreds of manufactured housing industry members.

POTUS Trump has also been more business-friendly than the Bush or Clinton Administrations were. That’s according to the National Association of Manufacturers (NAM) survey, NFIB surveys, and statements from the Manufactured Housing Association for Regulatory Reform (MHARR).

The regulatory freeze that has given the industry relief from several pending regulations did not occur under Barack Obama.

Rather, President Trump is undoing many of the costly and burdensome regulations of prior administrations.  These points aren’t a matter of posturing, they are all a matter of record.

Accurate Trump Administration Predictions

Based upon the Trump Administration’s policy stances, statements made over a year ago from MHARR’s top officials predicted that President Trump would be pro-business, and that others in the industry needed to rally around his efforts.

By contrast, Democratic presidential candidate, Secretary Hillary Clinton pledged very similar policies on regulations as Barack Obama had initiated with Congress.

Secretary Clinton named Dodd-Frank as an example.  She pledged to keep those onerous regulations as they had been during the POTUS Obama years, suggesting that she may also strengthen them.

The Manufactured Housing Institute (MHI) is officially hoping that next week the House will vote to pass their version of S. 2155.  That bill includes a roll back of the CFPB’s so-called MLO rule, that effectively gagged unlicensed personnel from speaking to consumers about lenders and loan terms.

It must be noted that this Congressional effort would not be taking place with any hope of enactment under a hypothetical Hillary Clinton presidency.

Who says?

That’s the application of the logic of former MHI government relations vice president, Jason Boehlert.

President Obama opposed a similar MHI backed bill, threatening to veto it. Secretary Clinton said she agreed with Mr. Obama, pledging to do the same or ‘strengthening’ Dodd-Frank.  Now, look again at the video with MHARR posted above, and ask, what were MHI and those who rule that association thinking?

2012 Election Results and Coming Lame Duck Session

The Special Counsel Robert Mueller investigation of the so-called “Trump campaign-Russian collusion” allegations has now turned one year old.

Even as third-party analysts claim that 90 percent of mainstream media reports have been anti-Trump, public opinion has nevertheless shifted away from Mueller.

In a recent survey, just over half the country now believes that Mueller’s so-called probe into alleged Russian collusion with the Trump campaign is – as the 45th president has often called it – “a witch hunt.”

It’s worse than most realize, because there was never a predicate crime being alleged.  

Democratic attorney Alan Dershowitz argued over a year ago that there is no federal crime of collusion.

Had collusion between the Russians and the Trump campaign existed, said Dershowitz – noting that there is no evidence of any collusion – it would have looked bad.  But the Harvard law professor Dershowitz said that even if the alleged collusion existed, it would not have been illegal.

Then what was the Mueller investigation all about?

Recall that President Obama said days before the election, that the Russians were unable to interfere in the American elections.  There is no evidence that a single vote was changed by Russian attempts to hack.

Recall that MHProNews advised readers last year that even a CNN producer admitted to undercover investigators a year ago that the Russia-Trump stories were “bullsh-t.”

An underreported aspect of the specious ‘Russia’ story is that governments around the world, including the U.S. government, attempt to influence each other’s elections all-too-often.

Recall that Barack Obama attempted to interfere with Israel’s elections, and with the Brexit vote in England. Arguably worse, is that POTUS Obama – following calls from the Clinton State Department – invaded Libya.  For what?  The Libyan nation – as a result of that Obama-Clinton action – has since been destabilized. As but one tragic result, America later lost diplomats in Benghazi, Libya.  That’s been one of many consequences from that outrageous Obama-Clinton military plan to attack Libya’s leadership. The previously pacified Libyan people now are suffering a civil war.

The Russian efforts to interfere in the 2016 U.S. election, per sources, is their “payback” for Secretary Clinton’s alleged interference in the Russian elections.

Ironically, every scandalous effort to weaponize federal resources are boomeranging back onto Democrats and their anti-Trump allies.

The U.S. ought to be vigilant and protect the election process, against foreign and domestic manipulation and interference.

U.S. policy ought to respect the rights of foreign nations.   Furthermore, U.S. policy ought to pro-actively protect our own nation’s borders, and then it can call upon others to act similarly.

For years, America has been living in a topsy-turvy world.  So much so, that Barack Obama candidly and accurately said not long ago that there are two ways that the nation looks at the facts.  That’s sad, but true.  Isn’t he, Secretary Clinton, and their allies part of the reason that claim is accurate?

Facts Matter – Mr. Obama’s “Alternative Universe,” Trump Admin, Investors & Politicized Manufactured Housing Data

Plausible allegations of officials – starting during the Obama era – using:

  • federal agents,
  • taxpayer dollars,
  • and illicitly applying federal legal procedures to stop or unseat a campaign – or a duly elected president – are all indeed worse than Watergate.

Simplified Summaries of Threads

Former DNC Chair Donna Brazile said that the Hillary Clinton campaign rigged the primaries, to prevent Bernie Sanders from becoming the Democratic Party’s candidate.

It is now clear that the Clinton campaign paid millions for the so-called “Steele Dossier,” which used foreign intelligence assets – British and Russian sources – to try to paint then candidate Trump in an unfavorable light.

That bogus politically-motivated ‘fake dossier’ – along with leaks of one or more FBI memo(s) – were in turn used by then FBI director James Comey to spark the Mueller probe.

If that isn’t outrageous enough, Special Counsel Robert Mueller has a staff packed with Clinton campaign donors.

Millions of taxpayer dollars have been spent on what looks to be a political effort initially designed derail candidate Trump, and later used to spark a stir they apparently hoped would lead to a duly elected president’s impeachment.  All on totally spurious – faked! – grounds.

If this is so, it’s not just outrageous, its criminal.

 

Why This Matters to MHVille, Next Week

Next week, the House will vote on their version of S. 2155, which includes a provision that would remove the MLO rule.  The mortgage loan originator (MLO) rule that is widely seen as harmful to manufactured housing industry retailers, communities, lenders, and others.

GovTrack tells MHProNews the odds of passage for S. 2155 stands at 56 percent.

Under President Obama, such a measure would have been vetoed.

Under a hypothetical Hillary Clinton Presidency – based upon her campaign promises – a bill like S. 2155 that will change Dodd-Frank would have been vetoed.

If S.2155 bill passes – and MHProNews’ publisher has editorially supported a similar such pro-business, pro-consumer change like this for years – it will be a Trump Administration accomplishment.

It would be entirely spurious for MHI to claim any legitimate bragging points.

Why?

MHProNews reported that days before the 2016 election that MHI had not one, but two paid pro-Clinton speakers on their stage in Chicago.

Warren Buffett was pro-Barack Obama and pro-Secretary Hillary Clinton.

Buffett is the Chairman of Berkshire Hathaway.  Berkshire is the parent to Clayton Homes, 21st Mortgage, Vanderbilt Mortgage, and has interests in a raft of other suppliers, lending, and services entities that intersect with manufactured housing.  Berkshire’s brands are widely seen as dominating MHI.

Based upon feedback from industry sources, there is a growing realization that MHI has been slow-walking or stonewalling reforms that hurt the industry, rather than championing them.

The Washington Post’s recent report on HUD, Pam Danner and manufactured housing underscored those concerns.

MHI Lender Shakes Up DTS and MLO Rule Discussions

As a result of years of MHI failures and allegedly weaponized reports, there is also a growing interest in creating a new post-production association, one that truly represents the independent retailers, communities, lenders and others.

 

Manufactured Housing is Non-Partisan

Manufactured housing – because it is affordable housing – ought to be viewed as a non-partisan issue.  It has long enjoyed the support of Democrats and Republicans alike for that reason.

But during end of the ‘Bush 43’ years, and during the eight years of the Obama presidency, anti-business policies often harmed our industry.

By contrast, President Trump – and cabinet members such as Secretary Ben Carson – have been working to undue those harms, pledging a new era of cooperation.  Would that have taken place under madam Clinton’s leadership?

Manufactured Housing Roadblock? BBC Reports “Trailer Park Living”

Longtime Daily Business News readers know that the MHProNews view – and that of scores of industry professionals – is that proper terminology is important.

 

The reverse of that is that improper terminology is to be avoided.

When the Daily Business News uses the term “trailer house” or “trailer park,” its typically because some third party that used that phrase.  A quote is a quote, nothing more or less.  Even if the person or party is misspeaking, it is not the journalist’s or trade media’s place to change what was said.

That said, the BBC used the term trailer house living” in their video report, shown below.  That’s where the headline comes from, and as of this date, the BBC video has over 1.1 million views.  Compared to the vast majority of manufactured home videos, this video has been seen by hundreds of thousands to a million more people.  That gives a tiny sense of why this is an imporant challenge for the industry to address.

There are times that the term “mobile home” legitimately applies, because a factory-built home built on a permeant frame was built before June 15, 1976.  In the 1930s to the 1950s, there were arguably trailer houses built.  A trailer house could be pulled behind a properly equipped car or light-duty pickup (see linked report, immediately below).

There are scores who use the terms ‘trailer,’ ‘trailer house,’ ‘trailer park,’ ‘mobile home,’ or ‘mobile home park’ who are industry professionals and investors. When it’s a quote, we get it.  When it’s a punch like, in private, at MHProNews, we get it.  Properly used – it can be improperly applied – for SEO purposes, we get it.

But the vast majority of the time, the right thing to do is to use the correct terminology.  If you and your team don’t make that commitment, it’s not as easy to hold the media or others accountable when they misuse terms.

Some think that the term should be changed to just “home,” and that’s understandable.  That said, for reasons we won’t go into today, it’s not practical. Nor is it the law.

Manufactured homes and manufactured housing are legal terms, defined by the HUD Code for manufactured housing, which went into effect on June 15, 1976. As Steve Duke said, the code defines the construction standards a factory-built home was built to, and thus should not be deliberately misused, ever.

The video above is one of numerous practical reasons why terminology matters.  When someone is shopping for a manufactured home – and they call it a trailer – or do a search for “trailer house living,” YouTube is likely to show the BBC video above as one of those results.

That may be statistically true, but the WSJ correctly points to a trend of a wealthier class of manufactured home buyers.

Sun Communities (SUI) First Quarter of 2018 performance results are out.

We started 2018 on a positive pace posting $1.14 in core FFO per share which is at the top end of our guidance range. All cylinders are firing on our operations front and both, our manufactured housing and high RV components driven by outperformance in our rental program and home sales net profit, as well as lower than expected interest expenses,” said Gary Shiffman, Chairman and Chief Executive Officer (CEO) of Sun Communities (SUI), per Seeking Alpha’s investor call transcript.

Same community revenue growth for the quarter was 5.7%. We did experience 6.6% same community expense growth in the quarter, the majority of which related to a one-time reserve increase for certain general liability claims and increased utility usage in the Midwest, Texas and Florida which we attribute to significantly lower temperatures for the period. Demand for the high quality lifestyles Sun delivers remains robust. For the quarter, Sun gained 616 revenue producing sites which included outperformance in RV conversions from transient to annual sites. Home sales volume rose 1.3% to 837 homes in the quarter, driven by an almost 40% increase in new home sales. The bulk of our over 100 new home sales in the quarter were in Florida, Arizona, South Carolina and Texas highlighting the diversification and increased demand throughout the portfolio,” said Shiffman.

In the quarter, we also completed the construction of 246 expansion sites and two manufactured housing communities that will contribute to revenue growth as these sites lease up over the coming quarters. The Company remains on pace to complete construction of approximately 1,350 expansion sites in 16 communities of which 1,000 are in 12 manufactured home communities and 350 are in 4 RV Resorts by the end of 2018. On a final growth front, our ground up developments continue to progress, the construction work at our 332 site Cava Robles RV Resort is nearly complete. The resort is now accepting reservations and is scheduled to open by the end of second quarter. Construction at Carolina Pines are 840 site development at South Carolina began in the first quarter and we expect to complete approximately 470 sites by the second quarter of 2019,” Shiffman said.

Mobile Home Explosion in a Manufactured Home Community Caught on Camera

An explosion at what appeared to be a pre-HUD Code mobile home located in a manufactured home community was caught on a police dash camera.

 

The explosion occurred at the Cypress Mobile Home Park, in Cypress CA, near Los Angeles.

Police not only caught the incident on camera, but first responders also save an occupant of that home.

It was very dark smoke coming out of every window at this point,” said Officer Melissa Grove from the Cypress Police Department, per KABC.  Three different versions of the video are posted below.

 

Neighbors said one man had already been burned, while another was alongside the home attempting to douse the flames. With the fire burning out of control – heroically – officers went in to get him out.

We pulled him. He was hanging on to something very tightly, and that broke, and we got him out right before it blasts,” Grove said.

It was really shocking, especially when you’re not expecting it,” said Officer Ed Pastor from the Cypress Police Department.

 

Orange County firefighters said it was oxygen tanks inside the dwelling that caused the explosion. Firefighters were able to douse the flames before they spread to any other neighboring homes.

The Take Aways

Industry professionals have numerous possible lessons to learn from this story.

  • The local media’s report appears to be accurate in saying that the residence involved was a true ‘mobile home,’ meaning a unit built before the HUD Code for manufactured housing went into effect.
  • The neighboring homes appear to have been manufactured homes, as dash cam video seems to indicate.
  • As MHLivingNews and MHProNews have often reported, true mobile homes or even older trailer houses are more susceptible to fire than manufactured homes, which are perhaps a bit safer against fire than conventional housing, according to the National Fire Prevention Association (NFPA) research.

U.S., Brit Media Hyped About Italian Flat Packed PreFab, Video, Stills – From $33K

The house, says the producer, is about 30-40 days out from the time an order is placed until it is ready to ship.

The flat-packed, hinged unit can be set up, they say, in less than a day.  A time elapsed video shows that process.

The Sun has published the most recent report on this technologically interesting house.  They reported a similar figure on costs similar to what the media release to the Daily Business News received directly from the Italian producer.

A single unit is reported as £24,800m which at the current exchange rate, would be $32,736 at today’s exchange rate of 1 pound = $1.32. That unit is the size of a tiny house, about 290 sq feet.

Gushing Media…

New Atlas, said:The M.A.Di home is an economic flat-packed housing solution that is not only sustainable, but designed to last and withstand earthquakes. Manufactured by wood specialist Area Legno in Italy, the M.A.Di home is built using CLT (cross laminated timber) to create a modular and multi-functional anti-seismic family home.”

Inhabitat stated, “The modular, the flat-packed design of the M.A.Di Home is meant to create a streamlined, sustainable process between manufacturing and assembly. Thanks to their unique folding ability, the homes are prefabricated off site, flat-packed and easily transported via truck or container to virtually any location.”

And on it goes with Builder, or the Sun – which thinks this could solve the British affordable housing crisis, and others too.

What MADi is Not…

The price doesn’t include:

  • Transport
  • Installation,
  • Foundation, or per their spec sheets,
  • most of the interior items, such as cabinetry and appliances.

To rephrase, it isn’t – yet – an immediate threat to HUD Code manufactured homes (MH). It might well give smaller modular homes a run for their money.

What MADi once more reminds the MH industry professionals is that the nation, and others abroad, are looking for what MHProNews reported months ago, are hunting for “the Single Section Manufactured Home Alternative.”

But be it foreign or domestic, a range of modular, container and PreFab Housing producers are taking aim at those millions of housing units that MHProNews has documented for the industry are needed.

But it’s a slogan that Pamela Beck Danner, JD, could have used to promote her own prior contest, which was spotlighted in this campaign video made by her backers.

MHProNews editorially has spotlighted for some 2 years (+/-) the need to see Ms. Danner replaced as the administrator for the HUD Code manufactured home program.

That call for Danner’s replacement at HUD recently seemed to get a high visibility boost.  More on that story’s update, linked below.

MHProNews has given Ms. Danner an opportunity to respond, which has not yet been accepted.

We believe in ‘fair and balanced’ coverage.
