So, all of the above begs the question: why are manufactured homes selling at a lower national annual pace in 2018 – or year to date in 2019 – than the year that Warren Buffett led Berkshire Hathaway entered the industry with its acquisition of Clayton Homes in 2003?

But the above in a nutshell is the true state of the manufactured housing industry. The facts are what they are, and in some 550 words, the above sums it up.

Now what has caused this scenario? Objectively examined, several factors are contributing to this troubling trend.

On Manufactured Home Living News (MHLivingNews) and here on MHProNews, we’ve built step-by-step a case that reveals the following evidence, concerns, trends, and allegations. Let’s note that what follows references sources inside and outside of the manufactured housing industry.

In a series of direct quotes in context, a document from 21st Mortgage signed by Tim Williams, and video recorded comments by Kevin Clayton, these all line up to demonstrate how independent retailers, communities, and producers – among others – where purportedly harmed by action that could be deemed an antitrust violation. It isn’t that there has never been concerns raised by others, there have.

  • The Manufactured Housing Association for Regulatory Reform (MHARR) has made the ‘post production sector’ – which are often their code-words for the Manufactured Housing Institute (MHI) – a significant issue for no less than a decade, because since we’ve been publishing, they’ve periodically raised that concern. They did so previously in the now defunct Journal of Manufactured Housing.
  • Controversial speaker and writer George F. Allen in his blog, and at other times more privately, has raised this issue of the monopolization and consolidation of manufactured housing, and the purported failures of MHI.
  • Another source raised a similar issue, which has not yet been previously examined here in depth, and we plan to do so in the days ahead.

 

1)    Defenders of Berkshire Hathaway, Clayton, 21st, MHI et al have said words to the effect that MHProNews has MHARR as a sponsor.  That’s true and is out in the open.  There is no hidden agenda. It should be noted that our fact-checks and analysis predates any advertising relationship with MHARR.

2)    Furthermore, that same point could be made that MHI, Clayton, and 21st Mortgage Corporation, which for years were sponsors of MHProNews.  Our fact-checks and related reports that led to our current understanding of the state of the manufactured housing industry began while those organizations were our sponsors. Meaning, we began our fact-checks and analysis that led us to this point while MHI and some Berkshire brands and their allies were among our sponsors.

3)    So, to a fair, informed, and objective-minded reader, it should be clear that MHProNews is not ‘pulling an Allen’ — who purportedly flips and flops according to who he thinks is or may benefit him at that time.  Note too that Allen’s flip-flops should not be construed to diminish the value of some of his prior critiques of MHI, Clayton, and their Berkshire Hathaway related business units in manufactured housing. That falls within the principle of separating the wheat from the chaff with all people and organizations. Nobody is perfect, neither are any organizations or companies. That includes this writer and this publication. But in keeping with Society of Professional Journalism Code of Ethical Conduct standards, we hold the powerful to account, and we have been revealing of prior incomplete understandings that explained more fully why manufactured housing wasn’t progressing as it should.

Doug Ryan with the nonprofit CFED, now known as Prosperity Now, has likewise alleged that Clayton and their related lenders were monopolizing in the industry.

While MHI’s SVP Lesli Gooch has denied the charge, Doug Ryan at CFED, and long time MHI member, George Allen, are among those who’ve raised the issue of monopolistic practices by MHI.

 

Trade and Mainstream Media Summary

So, there are several sources within manufactured housing that have made similar claims and allegations to MHProNews, and MHLivingNews, although they have routinely not provided the level of documents, direct quotes, graphics, and videos that provide evidence that our industry-leading trade publications have.

There are voices across the left-right media divide that have raised the issue of monopolization in general.  An example of that is a New York Times column, linked here.

There are more specific reports about manufactured housing that pointed a finger at Warren Buffett, Berkshire Hathaway, Clayton Homes, and their manufactured housing related lenders of 21st Mortgage and Vanderbilt Mortgage and Finance (VMF). Examples of those are linked below.

 

 

There are numerous others, but that’s sufficient to make the point.

This publication and this writer have reached out numerous times to Clayton, 21st, the Manufactured Housing Institute (MHI), and their attorneys for comments or reactions to the allegations that purportedly demonstrate antitrust violations. They have routinely declined commenting, either in writing, or live at industry events.

But Richard ‘Dick’ Jennison – president and CEO of the Manufactured Housing Institute (MHI) has himself said that the industry could be doing 500,000 new home shipments. Which begs the question, during an affordable housing crisis, after decades of positive, third-party research praising manufactured homes, why isn’t the industry at record highs?

But what is arguably the definitive report ‘making the case’ for behavior that violates antitrust laws is linked here.  The Arlington, VA based Manufactured Housing Institute (MHI) is arguably not only ‘failing’ to be effective, but is arguably behaving in ways that de facto foster consolidation, which benefits Berkshire Hathaway and other ‘big boy’ companies.

The Seattle Times, MHProNews, and even Clayton Homes’ local hometown media have each reported that federal investigators are digging into a variety of allegations involving manufactured housing brands connected to Warren Buffett led Berkshire Hathaway.

 

 

 

It should also be noted that each of the most recent MHI Chairman have been involved in some kind of scandalous allegations or legal issues.

What thus far has been reported only by MHProNews and our sister site in trade or mainstream media are the dark money connections between Buffett’s donations which flowed to nonprofit groups that in turn often attacked manufactured housing in some form or fashion.

Rephrased, Buffett and Berkshire money – directly and/or indirectly – has been on both sides of numerous battles in manufactured housing.  The effect has been to cause a steady stream of consolidations.

The result has been a severe contraction, outlined by the Atlantic, of the number of manufactured home independent businesses.  While routinely those were ‘small businesses,’ they also included the fall of larger organizations, such as Fleetwood Retail during the timeframe since Buffett entered the industry. A number of independent producers of manufactured homes have been lost during those 15 years.

Summed up, what GuruFocus called the unethical strategic moat, and what the Nation called Warren Buffett’s dirty secret, is arguably part of a larger scheme that has harmed access to affordable housing, by hobbling the manufactured home industry when it was most needed.

Never forget that even during medieval times, castles and their moats were in fact breached.

 

Solutions? Congress, States, Other Investigators

The breadth and number of allegations of wrongdoing, while not proof in an absolute legal sense, are certainly just cause for Congress, state, or other investigators to take up this issue in an investigation.

It would be profitable to the nation at large, and thousands of independent businesses to press for congressional hearings and investigations on this matter.  By laying out in public the kinds of facts that HUD Secretary Carson, or reports like this one, has made about the proven value of manufactured homes, the stranglehold of Berkshire Hathaway could be broken.

Such a Congressional investigation can and should occur as a parallel to investigations by the Federal Trade Commission, the Federal Bureau of Investigation for possible violations of the RICO, the U.S. Postal Service for misuse of the mails, the Department of Justice, HUD, and other federal regulatory bodies.

As 2020 is on candidates’ minds, the issues outlined – largely bipartisan or nonpartisan in nature – could be useful in scoring points with voters. That may be especially true for the roughly 111 million renters – per Apartment List – and the approximately 22 million Americans who live in mobiles built before June 15, 1976 and/or the manufactured homes made since.

But once owners of conventional housing and other businesses understand that the lack of affordable housing costs the nation an estimated $2 trillion dollars in lost gross domestic product (GDP) annually, per third-party research, the support for action to break up the monopolistic behavior of Berkshire Hathaway in manufactured home should grow among those too.

But the bottom line is that acting to stop market manipulation is the right thing to do.  This has purportedly harmed thousands of independent businesses, and millions of our fellow Americans.

Manufactured Home Community Case Study, UMH Properties, Lessons for Independent Community Owners, Investors

For some time, but more recently in the report linked here, the Daily Business News on MHProNews has a made the point that the purported market rigging by Berkshire Hathaway brands, as referenced in reports linked here, here, and here has harmed more than just independent manufactured home ‘street retailers.’  It has arguably harmed independently owned communities too.  One could go further, and say that a similar case can be made for the harm done to investors, see the report, linked here and here.

 

These in turn would logically harm the interests of manufactured home producers.  Who says? MHI backer, Amy Bliss, Executive Director of the Wisconsin Housing Alliance (WHA), among others.  But frankly, it is logical and obvious.

But let’s focus more for this report on manufactured home communities.  Because whether he intended to do so, or not, what the George F. Allen fact-check – linked below – unmasked is the purported harm to independently owned communities, and how Allen’s behavior relates to addressing that harm to independently owned communities, or not.

Note that harm also logically impacts residents in these communities.

But back to the owners of manufactured home community owners. What might the concerns of market rigging cost the owner of a manufactured home community?  Depending on the size of the property or other factors that impact value, the total harm could be in the hundreds of thousands of dollars, or even into the millions of dollars.  Take that times some 44,000 communities, and the figures soar into the tens of billions.

Given who would arguably be liable, it’s the type of numbers that might even make the Oracle of Omaha and his investors, wince.

Is there evidence for that economic harm caused to community owners? Yes, and it comes from a publicly traded company. That firm, in the case study below, is UMH Properties.

How many billions and billions of dollars in lost property value might Berkshire Hathaway, their allies, and surrogates potentially be liable for if a suit like this was taken to court and succeeded?

Then, apply that same query to retailers, producers, suppliers, lenders, and other firms impacted.

Let’s begin this report with a clarification of the headline. The term white hats and black hats are metaphorical for ‘good guys’ and ‘bad guys.’ We know professionals in our industry who literally wear black hats. That should not be construed as a slam on any of those who literally wear a black hat.

 

That said, ‘white hat’ and ‘black hat’ are a symbolic case of ‘if the behavioral shoe fits, wear it.’

Furthermore, within firms one might deem to be a black hat operator, there are good people working for them. People may find themselves working at a company, association, or nonprofit with problematic professional ethics for a variety of reasons.  Some may have a difficult time leaving or otherwise navigating an escape.

Now, let’s define for purposes of this analysis the black hats.

For this discussion, a black hat company is one that periodically causes negative headlines or other forms of blowback for the manufactured housing industry.

They may or may not be engaging in problematic practices at all times and places. But they do so often enough we’re the public and/or media impression regarding manufactured housing is a poor one.

  • As you watch this video by the activist group MHAction targeting Frank Rolfe and his colleague’s “Mobile Home University” boot camp, keep in mind that MHAction has reportedly had dark money funding from Warren Buffett.  Not to defend or attack Rolfe and his partners, but keep in mind, that this kind of protest could be organized against whomever they want to target. These types of protests have attracted negative media coverage.

Once more, put yourself as an outsider looking in.  How would you see MHI? White Hat, or Black Hat?  Then, for a contrast, take a peek at the Manufactured Housing Association for Regulatory Reform (MHARR).  Fewer headlines, but no black eyes.

MHARR at this time is only open for independent producers of HUD Code manufactured homes and certain state associations. But if you wanted an impression of a white hat, which association would you pick? MHI, or MHARR? Right or wrong, many form opinions based on who you are associated with.

 

Why Does MHI Have White Hat and Black Hat Companies?

That said, the question must be asked. What role or function do white hat companies play at arguably black hat dominated MHI?

Here is what years of evidence arguably boils down to:

  • The industry’s smaller firms are caught up – intentionally or not – in the narratives spun by the MHAction white paper, or the John Oliver viral, satirical video, etc. After all, why would Buffett be funding MHAction, if not for a reason like that?  Buffett’s not a masochist. Keep in mind what Kevin Clayton said in the video linked here.  “Warren” would be okay with Clayton losing money for 5 years, so long as they are growing their moat.  Kevin Clayton said it, why not take it at face value?

Take Buffett at his word, he wants sharks, piranha, and alligators in the waters of his Clayton’s castle moat.

With that vantagepoint, here’s what the evidence trail, ‘follow the money’ and some deductive reasoning suggest.

  • Smaller companies at MHI are the buffet for Buffett and their Big Boy allies.
  • Smaller or modest with firms with a better reputation give cover to MHI’s black hat firms.
  • Small companies are helping pay for what the bigger companies want to do.

A top gent at one of the industry’s rising star firms said at to us as we toured Tunica words to this effect.  ‘You guys (MHProNews) lay out the facts and evidence step-by-step in a logical manner that makes it easy to follow.  I’m just glad that you’re taking aim at Clayton and company, and aren’t taking aim at us [i.e. his company].’

Jealousy. Lunacy. Hypocrisy. Once was, award-winning, former community-investor George F. Allen bemoans MHARR, begs them and NAMHCO for unity with MHI, all while assailing this platform. Will someone in his circle please show him how to use the GPS app on his phone?

 

Or is Allen still navigating by using an old app-less flip phone? Does he not see that the Manufactured Housing Association for Regulatory Reform (MHARR), the National Association of Manufactured Housing Community Owners (NAMHCO), himself, we and others have all left the Manufactured Housing Institute (MHI) for good, stated, and ongoing reasons?

Let’s unpack wanna-be “EducateMHC” magician and trickster Allen’s Good Friday assaults and caterwauling complaints about several MH industry things, as he purportedly puffs to carry MHI’s water. Yes, that’s the same MHI Allen himself quit, that he said privately and publicly betrayed had him, and that he long complained about their purported oligarchic practices. In his trying to point a finger at others, has he successfully instead pointed three fingers back at himself and his buddies affiliated with the Arlington, VA oligarchic front group?

Let’s dig into the evidence and find out.  Because after 6 months of declining new manufactured home shipments during an affordable housing crisis, manufactured housing retailers, communities, producers, lenders, and all others merit serious answers, not another artful dodge.

What is it All About?

Professionals in our industry or any other are obviously in business to make money. For the majority who want to earn an honest living, that requires information, among other factors.

So as the ancient Romans put it, “scientia potentia est” or “knowledge is potential power.”

Knowledge is only potential power because accurate information must be properly acted upon in order for it to have practical value.

But what if the information being put forth isn’t accurate?  Doesn’t that make success more difficult to obtain?  Especially for the independent business person, who may be competing against a nearby industry giant?

That’s just one reasons why critical thinking skills are necessary.  Because Allen is right about this much, there are two entirely different narratives at play in manufactured housing industry trade circles.  That begs the question, which narrative is more accurate?

As a thoughtful strategist – the Rev. Martin Luther King, Jr. put it – the purpose of education is to build character and to learn to think critically. Keep in mind what King and his colleagues accomplished.  Flash back to 1950.  Who would have thought that black Americans could have so many social, economic, and political barriers for their progress removed by the efforts of King and others working with him?

Knowledge, critical thinking – reality-based understanding – these are important for any professional, especially for those in a seemingly uphill battle.

IfMHProNewsIswritingAboutItIWantToKnowAboutItQuoteIn a normal industry, some of the types of facts and insights needed to succeed would typically come from trade associations.

Sadly, in manufactured housing – as even their exiting president Chris Stinebert obliquely suggested – the Arlington, VA based Manufactured Housing Institute (MHI) has purportedly been failing at their own mission.  Why else would Stinebert wait until his final column to list all the ways that MHI was – from his insiders vantagepoint – failing to get to the root issues? So while some moan or rail that MHProNews dares to hold MHI or other ‘big boys’ to account, it must not be forgotten that others – including, but not limited to, MHI insiders – have blasted MHI before or contemporaneously with this publication.

Rephrased, there is ample evidence that Stinebert and others in and out of MHI have provided to demonstrate that the Arlington, VA based trade group was weaponized to do the bidding of their ‘big boy’ masters.  Let Allen or others in MHI try to defend against that claim as best they can.

 

White Hats, Black Hats

Those ‘big boys’ are often tied to Omaha based Berkshire Hathaway, or Knoxville metro based Clayton Homes and their lending affiliates.  To be accurate and objective, there are other companies in the mix too.  MHI can arguably be seen as a mix of black hats and black hats.  The question then is, which hat is a given firm or individual wearing?  And are white hat firms giving black hat conglomerates cover for black hat activities?

The contention that much of the industry’s ills are in many ways internal did not begin here at  MHProNews.  One might argue that we were a bit slow on the uptake.  But if so, it was to make sure that the evidence existed to back the various claims being made, often by MHI insiders.

More recently, thanks to numerous voices inside and out of the Omaha-Knoxville-Arlington axis, MHProNews and our publicly-facing sister site can and have sincerely advanced the troubling case that the industry is underperforming due to the fallout from purported: antitrust violations, ongoing efforts at market manipulation and association failures.

One need look no further than the historic shipment data to recognize that the industry is underperforming.

Even publicly traded MHI member companies are making that argument that the industry is underperforming, as the Skyline Champion (SKY) graphic below reflects. The comments were added by MHProNews, but the green line reflects that the industry has a long-term average of some 224,000 new HUD Code home shipments annually.  It has achieved 372,000 plus new manufactured housing units produced in 1998.  In the mobile home era, over 55o,000 units were produced and sold for 2 years running.  What was done before can surely be done again.

In 1998, manufactured homes (MH) outsold RVs by some 3 to 2. In 2017, RVs outsold MHs by some 5 to 1. RVs recovered far more quickly from 2008. The facts raise questions. One, is the effectiveness of MHI as the post-production or ‘umbrella’ association in the country. The other question is more sobering. Has Buffett-Berkshire “Moat” strategies kept manufactured home production at historically low levels to allow a few big boy brands to consolidate others at a discounted ‘value’ by MHI insiders?

 

Another example of how MHI and their big boy brands are stirring the industry’s problems is the John Oliver’s satirical viral hit “Mobile Homes” video, accessible via the linked text-image box below.

 

 

That’s not caterwauling. That’s better known as following the facts, evidence, money trail, and logic.  That’s what researchers and reporters are supposed to do, George.

George F. (F?) Allen’s ‘Defense’ of MHI and Certain State Association Executives

George F. (F?) Allen is up-front in each blog post for some years about why he writes. “Motto: ‘U Support US & WE Serve U!’”  Meaning, write him a check, take out your plastic, or cash and he’ll provided you with his sage views.

Of course.

Never mind that he’s now out of the land-lease business, so by his own prior definition, he no longer has “skin in the game.” Ooops.

Never mind that – per sources in his own circle – despite his new ‘EducateMHC’ moniker, his own daughter reportedly failed in the land-lease community business.  That reported failure almost took Allen himself under, per those same sources in Allen’s own orbit.  Ooops.

And never mind that Allen’s and his colleagues in SECO have an idea of education that has proven to be legally problematic, as the report and cross-linked information here outlines.  Ooops.

Keep in mind that Allen likes to entertain others, and is rather good at it. Among his delights are ‘magic tricks.’  The person who is adept at slight-of-hand actions has attempted a verbal slight-of-hand for some time, one could say.  In fact, why not point out that part of the ‘mystery shopping’ service that Allen provided for years was predicated on fooling people into thinking that he was an actual prospect.

So, what follows from Allen’s blog as his Good Friday topic is prudently considered through the lens of those assertions and related factoids. He’s been successful for years in writing and organizing events for a fee.  Done well, that’s a legitimate part of the American way.  Done badly or problematically, it is a good reason to apply “caveat emptor.”  Let the buyer beware.

 

Thanks, George 😉 Allen’s Over-the-Target Responses to Recent MHProNews Reports 

Naval and Air Force pilots have long had the expression that you don’t catch flak unless you are over the target.

Sources indicate to MHProNews that some of the same state executives that complained about leaks to this publication have at times shared information with Allen or others too. That’s obviously done when those same association executives doing the ‘leaks’ thought it useful to their interests.  Perhaps so, but it is mentioned here because Allen did in his missive quoted at length further below.

Part of the purpose of good media is to hold the powerful to account. Who says?  The Society of Professional Journalists and their code of ethics.

It has been a while since Allen has taken public aim at this platform in an apparently failed attempt to get industry readers to boycott MHProNews.  That was allegedly done as ‘carrying water for’ association executives in the MHI orbit.  In response to the SPJ bullets 2 and 3, noted above, this fact-check and analysis are hereby offered.

Allen, himself a prior MHI critic, has apparently found a new way to profit from being a periodic voice to attempt to dissuade industry independents from following the reports and analysis on MHProNews.

Allen has not bothered to explain in depth to his readers what changed his views about MHI, on the concerns he previously noted publicly below.  Does his lack of consistency bother him?

George Allen can’t have it both ways, but that doesn’t apparently keep him from trying. He has a modest following today, which once used to be a larger following. As a former client of his told MHProNews, with George “It’s AAA, All About Allen.” If someone is doing good, and Allen’s not somehow in the mix, it is not uncommon for Allen to attempt to undermine that source, per some of his own followers.

  

Facts, documents, and accurate quotes in context are #NettlesomeThings.

New readers should bear in mind the following points.

  • Allen and Spencer Roane have been offered the opportunity to publicly dispute the evidence presented here on MHProNews and/or on MHLivingNews regarding themselves and/or the concerns associated with MHI, that he himself previously voiced routinely. They’ve repeatedly declined to engage in a public discussion or debate.  That’s in keeping with their 5th Amendment right to remain silent, which we respect.  But that leaves others free to ponder, if they had the better case, why not make it in public?
  • MHI, Clayton Homes, 21st Mortgage Corp, and/or their attorneys have been made a similar offer to publicly dispute the evidence presented here or on MHLivingNews via a moderated, on camera, and in front of a live audience of industry professionals. They’ve repeatedly declined the opportunity to do so.  Once more, that’s their right.  Perhaps they’ve duck out knowing their are federal investigations underway, and that whatever they say could be used against them in a court of law?  See the video, below the next bullet.  NOTE: views of that video have apparently more than doubled since we began sharing that mainstream media report about investigations of Clayton and their related lenders, from their own hometown news station.
  • George F. Allen, various figures associated with MHI, Jim and Kevin Clayton, Tim Williams and others may be loathe to admit it today, but they have each praised this publication for being pro-industry and for the good work being done here. Now that same analysis done here that they previously praised has turned dark in their eyes.

 

 

As believers in free enterprise and the value of honest competition, Allen – right or wrong – is serving an obliquely useful function. This publication and MHLivingNews are apparently ‘over the target,’ so we are ‘catching flak.’ This isn’t the only recent attack by opposing voices.  But the other assaults are less visible, and this one by Allen is visible.

As an observable attack, Allen is thus useful to manufactured home industry investors, advocates, and professional readers to understand the ongoing dynamic within MHVille. The visceral reaction being quoted below by Allen – in his role as a periodic tool for the Omaha-Knoxville-Arlington axis – will speak for itself.

Let’s see what Allen said, and then unpack it in a very few words.  As the reader can see from the screen capture below, provided under fair use guidelines, attacking this publication was his headline topic.  That’s a backhanded compliment. The text that follows the image shown is from his blog on that date and is unedited in any fashion.

Nobody Else Will Tell You This!

Enough of the Name Calling, Sensationalist Caterwauling, & Questionable Claims!

Since 2009, manufactured housing’s nadir (‘worst’) year ever, when only 48,789 new HUD-Code homes were shipped nationwide, we’ve collectively and simultaneously endured and experienced:

  • The loss of easy access to chattel capital for new home loans in communities
  • Two venerable trade magazines ceasing publication (i.e. Manufactured Home Merchandiser and The Journal)
  • Two new trade pubs birthed (i.e. MHInsider and Manufactured Housing Review)
  • A near continuous online diatribe (‘bitter & abusive denunciation’) of one – but not both, national advocates for manufactured housing (i.e. MHI but not MHARR), one or another state association executive (e.g. WI being latest target), and specific corporate executives (e.g. from Clayton Homes & 21st Mortgage) not aligned with a particular yellow journalist’s views of the manufactured housing industry.

ENOUGH IS ENOUGH! Together, as an industry and realty asset class, we should be; no, we must be, ‘working together’ to eclipse 100,000 new HUD-Code housing shipments during year 2019. Also to offset negative press coming from social activist quarters regarding predatory site rent practices foisted on homeowners/site lessees! But such a coming together will continue to elude us as long as an industry outlier broadcasts speculative contrarian tripe, tearing down manufactured housing and land lease community business models at will!

SOLUTION? Make it a point, henceforth, to support your state manufactured housing association as an active member, as well as one or more of three national advocacy bodies (i.e. MHI, MHARR & now, NAMHCO). Also ensure you’re on the receiving end of MHInsider magazine, Manufactured Housing Review online ezine, the Allen Letter (if a land lease community owner/operator), and the Allen CONFIDENTIAL! business newsletter – if a top housing manufacturer or portfolio executive!

Frankly, that’s ALL YOU NEED TO READ & BELIEVE, to stay cogently, accurately, and timely informed about industry and asset class matters! Resist any temptation to succumb to reading anything by anyone engaged in name calling, sensationalist caterwauling, and questionable claims! JUST DO IT – resist the temptation to muck & muddle your thinking. You’ll be glad you did!

Fisking – Unpacking Allen’s Missive

In no particular order of importance.

  • Allen tells his readers who to read, and who not to read. That’s his first amendment protected right, up to the point that he may be part of an organized boycott effort, because a boycott can become legally questionable in antitrust and other types of legal controversies.
  • Allen fails to admit that he and his inner circle are reportedly regular readers here on MHProNews. Thank you, to all of our readers.  Pardon the hypocrisy of some who tell others not to do, what they themselves do.  The fact that he and his circle read here is implied by his attempted critique.
  • It is Allen who fits the caterwauling definition, because what he gave are emotional appeals and red herrings, not an actual effort to debunk even a single factual claim made here or on MHLivingNews. There is no effort made by Allen to point out any failure in logic, any inaccuracy, or any of the evidence we’ve presented that sparked his public moaning.

Here is a pull quote that bears a nod of interest.

Together, as an industry and realty asset class, we should be; no, we must be, ‘working together’ to eclipse 100,000 new HUD-Code housing shipments during year 2019.”   The reality is that the industry will not be ‘working together’ – because some are arguably working to purportedly eliminate their industry competition, by direct and indirect means.  Allen’s related quote is equally lacking in logic. He wants people to support “one or more of three national advocacy bodies (i.e. MHI, MHARR & now, NAMHCO).” Excuse me, sir? MHARR and NAMHCO exist because MHI – in their view – have failed the industry.  It is an either or proposition.

Why Hasn’t Allen Explained to MH Community Readers How Clayton/21st Hurt Their Interests?

Note that neither Allen, nor anyone else in the orbit of industry publishing he has cited has attempted to debunk the documents, direct quotes and evidence linked from the text-image box below.

In a series of direct quotes in context, a document from 21st Mortgage signed by Tim Williams, and video recorded comments by Kevin Clayton, these all line up to demonstrate how independent retailers, communities, and producers – among others – where purportedly harmed by action that could be deemed an antitrust violation. Why hasn’t George F. (F?) Allen told his readers how that cost them money? Why is Allen giving perps cover?

 

What Allen fails to tell his readers is how that attack on industry independents harmed independent owners of manufactured home communities.  Yet Allen claims to be their protector.  How so? Isn’t he giving other big time cons cover?

Allen cited in this and a prior posting about the Manufactured Housing Association for Regulatory Reform (MHARR) and the National Association of Manufactured Housing Community Owners (NAMHCO).  Those associations are both breakaways from MHI. They exist because each trade group’s members believed that MHI wasn’t getting the job done properly.

Allen fails to mention that important fact. By contrast, MHProNews has not missed that obvious mark.

Calls for ‘unity’ by Allen or MHI sound good, warm and fuzzy — until they are carefully examined. Unity behind what? Unity with what goal?

If the big boys absorb the smaller firms at a discounted value due to market manipulation, that’s unity.  Is that the unity that Allen wants?  Why is Allen de facto working for the interests of the consolidators that he periodically takes pot-shots at? Isn’t it just another head-fake?

What Allen ignores in his missive – either through ignorance or perhaps from incentives offered by the ‘big boys’ – is that a key reason that the industry is underperforming is rooted in the Omaha-Knoxville-Arlington axis and their allies.  Allen makes no effort to debunk the evidence published here or on MHLivingNews for that claim.  Why would he?  The powers that be and their own attorneys won’t touch that topic in public, and perhaps with good reason. So, in goes GFAllen…

Allen ignores the fact that Clayton has been the source of embarrassment to the industry, starting not long after Warren Buffett bought them for Berkshire Hathaway.

 

 

Thus, it is unlikely that Clayton, 21st, or MHI will publicly respond to our published – documented, and evidence based – concerns.

Allen laments Frank Rolfe, predatory community operators, and the John Oliver video errantly dubbed “Mobile Homes.”  But what F (F?) Allen fails to mention is that MHI is connected to each operation in that Oliver video. Ooops.

Several Florida newspapers opted to run the same letter sent by our publisher.  The reportedly did so only after an editor checked the claims and sources, per the editor that did the fact checking. The letter was sent to only 1 publication, but at least 5 have run it.

MHARR’s new initiative, that Allen both praises and slams at the same time, exists precisely because MHARR states their belief that MHI has so dropped the ball on post-production issues that they have no other choice but to try to act where MHI is failing to do so.

 

“Lead, Follow … Or Get Out of The Way”

 

It’s America.  People are free to write a huckster and incentivized mouthpiece a check if they want to do so. They are free to read Allen or attend his meetings.  Those that go say the networking is pleasant and useful, but some lament the ‘education’ part of it.

But what SECO and the Allen Roundtable arguably prove is that professionals in manufactured housing are so desperate for answers and professional opportunities, that they will listen even to someone with his track record of recent years. In years gone by, Allen helped found the National Community Council (NCC), which is part of MHI. But more recently, Allen himself has quit MHI and the NCC.  Allen himself won’t pay to go to their fundraisers, errr, ‘meetings.’

Allen has positioned himself to fill a vacuum.  As soon as someone else steps up and offers an alternative, don’t be surprised if his meetings and ‘education’ vanish like a fleeting morning fog in sunny Florida.

Once more, our publisher invites Allen – or the Omaha-Knoxville-Arlington axis – to publicly dispute and disprove

  • in front of a live audience of industry professionals,
  • with moderator and
  • on camera any of the claims made here on pro-growth MHProNews or MHLivingNews.

You can’t solve a problem by ignoring the root causes.  That’s what Allen either doesn’t get or has arguably been incentivized to ignore and obscure.

Thus despite Allen’s caterwauling and attempted slight of hands, our published case against the Omaha-Knoxville-Arlington axis, their surrogates and allies stands.  If any of these concerns or allegations we’ve reported or that others have raised were easily disproven, why hasn’t anyone in the Omaha-Knoxville-Arlington orbit and/or their surrogates stepped up to the plate and made the public effort?

People can make mistakes, and people can be misled. But the mature person admits an error, and that is part of the Society of Professional Journalists code of ethics. Make corrections promptly and prominently. Where has Allen ever admitted an error? He was either right to condemn MHI before, or right to defend them now. He can’t have it both ways.

Conclusions? 

George F. (F?) Allen (GFA) is arguably either:

·        confused,

·        clueless,

·        corrupt,

·        or some combination of those.

As noted, Allen and his buddy Spencer Roane have been given the opportunity several times to debate the issues he laments publicly with our publisher in a moderated session, on camera, in front of a live industry professional audience. Allen and Roane both keep ducking that offer. Shall we add the word cowardly to the bulleted Cs above?

BTW, that same offer to discuss and debate the issues has been repeatedly extended to the Omaha-Knoxville-Arlington axis. Allen has apparently been carrying water for them in recent months, and perhaps this is missive by GFA their reply.  But given the history of Allen previously decrying their rigged system, as was shown above, what was the MH Axis thinking?  Can’t they come up with a better surrogate? If not, doesn’t that speak volumes too?

Ponder that, “using the strength and weight of an adversary” against them. Here’s more about jujitsu or jiujitsu: “use of an opponent’s strengths or one’s own weaknesses to accomplish one’s goals.” That might sound like magic, an answer to prayer, or a dream come true.

Manufactured home industry professionals who want to see honest and robust growth need all of the above, plus what follows.

The hottest topic in the industry presently is that viral video by Oliver called “Mobile Homes.” You can see that video on MHLivingNews, linked further below.  Because that is the hottest issue, that also means that the fact checks and related on MHLivingNews are ‘read hot’ here on MHProNews.

That logically means those who are found here or on MHLivingNews can benefit from Oliver’s hit video. Those who aren’t, can’t to that same degree.

In the case of our industry, that need is for affordable housing, and/or for ‘fast homes.’  Manufactured homes are not instant, but compared to many other operations, HUD Code homes are quicker.

This morning we will tease two upcoming reports, but our focus today is on an immediate headwinds and threats to manufactured home independents. That looming dagger is most notably in the land lease manufactured home community sector, but by extension, into other arenas too.

 

Upcoming 1: There are numerous opportunities that manufactured housing can and should serve. One very specific one will be featured in a report that should be ready next week. Demographic changes are creating opportunities that the big boys will know, but operations of small to medium size need to better understand in order to profit from.

Upcoming 2: perhaps as soon as tomorrow, we will publish a turning ‘lemons into lemonade’ report, that takes nettlesome issues that create headwinds for the industry and reveals how they can become opportunities in disguise.

Behind the Curtain of John Oliver’s Mobile Homes Viral Video? MHAction, and Their Agenda

First, the facts. Much of the John Oliver satirical viral hit on manufactured housing ne’er do wells was sourced from MHAction related materials. This is easy to identify because Oliver shows the ‘white paper’ that includes MHAction in his report.

That is the same white paper that MHProNews spotlighted for industry independents a few weeks ago. The Washington Post, followed by other news media outlets, reported on that same MHAction co-branded ‘research.’  Note that then and now, the Manufactured Housing Institute (MHI) response was the same. Per sources, they shared a few things with various state executives and others, explained why they really could not effectively respond, and it was just best to let the matter blow over.

Really?

Question. What do they get paid millions of dollars a year to do? Is MHI paid to give excuses? As one source with knowledge told MHProNews, they are committing “association malpractice.” That same source also said MHI has about $4 million in their reserves fund, and that they could mount an effective reply if they wanted to do so.

So why don’t they?

The apparent response from those smiling faces in Arlington, VA where MHI is headquartered is that they obviously don’t want to reply to attacks on the industry, even in this case, when several of those attacked are their own members. That begs the question, why not defend even your own?

As a non-industry attorney investigating manufactured housing issues that called MHProNews this week noted, who benefits from the MHI inaction? Who is harmed by their inaction?

Moving back to the MHAction co-branded ‘white paper.’

Let’s recall where MHAction gets their funding. No conjecture is needed, because here are some eye-opening facts.  Keep in mind what investigative reporter Sharyl Attiksson says, “follow the money.” ICYMI, you can click on the linked report later for more details and insights.

Summing Up Before Moving Onto What’s Coming Next

We are left with the inescapable fact that Buffett’s largess helped pay for that MHAction co-branded ‘white paper’ attack on private equity firms investing in manufactured home communities.

We see that MHI, and several state executives affiliated with them, are saying let’s let this blow over.  Buffett’s Berkshire brands in MHVille dominate MHI, as the do numbers of state associations too.

That MHAction co-branded ‘white paper’ targets giant firms, and a common thread is that the ones noted by Oliver’s video were MHI members.

Just as big banks can handle regulatory hurdles better than smaller ones, so too big companies can afford to take media hits easier than smaller firms. So while it may seem counterintuitive to fund those that attack your own interests, that what is occurring. The purported logic is they can take it better than you as as a smaller business can.

To the general public watching that John Oliver video, yes, it may make Warren Buffett, Clayton Homes, Frank Rolfe, or others look bad. But that casual observer sees the entire industry looking bad. Here are some actual comments posted on the John Oliver video

  • You gotta admire the dedication this show’s crew has to actually enroll in these shady seminars just to find out how awful the people behind these things really are.” – Floating Sunfish.

 

MHI, and the states, are doing little more than hand wringing. Hey! Daddy Buffet Bucks helped pay for this assault?!

Are you an MH Independent?  If so, do you see the various ways that the powers that be can hit you with unexpected headwinds?  But there is more.  Like a grand master in chess, your opponents are thinking several moves ahead.

Here is what they’ve already signaled, per sources to MHProNews, on what they are working on next.  The John Oliver viral video on “Mobile Homes,” or the Washington Post and related reports that MHAction – thanks to funding from Uncle Warren – are arguably preparing.  You may look back and think of this as the calm before the coming storm.

 

 

What’s Looming Next?

Start with two words. Rent Control.

The next ‘white paper’ the folks at MHAction are pushing is one calling for broader rent control. It is a threat to MH Communities that are independently owned.  But don’t think that the impact stops there, because our industry is interconnected, so others in MHVille will feel the impact too.  You can access their sadly flawed 2-page summary of their thinking on that issue from the image below, or this link here.  MHAction and their allies are calling for nationwide rent control.

Washington Politicos, Advocates Are Watching John Oliver’s Video

 

Sources are telling MHProNews that the John Oliver “Mobile Homes” viral video has been raising concerns in Washington, D.C. While that doesn’t always result in legislative action, it could. Do you hear that from MHI? What happened to Nathan Smith’s pledge to make MHI more proactive?

 

 

The industry’s independents are left with several vexing problems.  Among them is the question of feeding the hand(s) that bite them, by paying an association(s) that may be working against your interests. Or doing business with brands that may be working against your long-term interests as an independent. Or that some associations stand mute when challenges like these artificially generated headwinds arise.

No easy way out?

If you’ve been paying an organization to protect-educate-promote your firm, perhaps saving those dues or fees would be a useful first step?

Or as a notable association member suggested, there may need to be a battle within those trade groups to wrestle control away from the powers that be which are arguably leading the industry into one ambush after another.

We began this column with a simple truth.  Businesses, organizations, and professions are based upon solving some need(s).  What need does MHI solve?

If their purpose is to help consolidate the industry into ever fewer “big boy” hands, they are succeeding at that mission.

But in that case, MHI would arguably be falsely claiming to represent “all segments of factory-built housing,” when in fact they seem to be serving only a favored few.

Our industry has powerful and timely truths, but they are being obscured by messages like Oliver’s and MHAction’s. The good news about manufactured homes, communities, or the industry at large are not being successfully defended or promoted by MHI. The shipment data proves that all too well.

Warren Buffett Wades Into Politics, Why Not John Oliver’s Piece on “Mobile Homes?”

Billionaire investor Warren Buffett is once again wading into the topic of politics,” according to CNBC in an article linked here.

 

The article is entitled, “Warren Buffett wants to ask the 2020 presidential candidates this 1 question.” The Daily Business News on MHProNews will explore that as our focus for this post, but first we will ask this question. Since Buffett surely must know about John Oliver’s blast at him and his company, why didn’t he wade into that topic too?  You can learn more and – see the Oliver video with a withering fact-check – at the link below.

Or was Oliver’s comedic hit on Buffett, Clayton Homes, and numbers of key members of the Manufactured Housing Institute (MHI) too challenging a topic for the Oracle of Omaha to delve into?  Is Oliver’s hit a shark in the water, launched by MHAction, which a money trail reflects has had funding from Buffett backed entities?

We’ll let those questions hang for industry professionals, investors, and advocates, as we unpacked part of what CNBC reported on the Solon of Stocks who hails from Omaha wants to ask 2020 candidates.

The following bullets are pull quotes from CNBC’s article, linked above.

  • Buffett, who supported Democrat Hillary Clinton in the 2016 presidential election and has previously weighed in on whether or not executives like Michael Bloomberg or former Starbucks CEO Howard Schultz would make good candidates, said in a recent interview that there is one question he would want to ask the field of candidates planning to run for the White House in 2020.
  • I want to hear what they tell people who disagree with them,” Buffett told Yahoo Finance on Monday. “I would like to ask a candidate: ‘What are you for that the majority of your followers are against?’” That’s the best way to be sure that a candidate really believes in a particular issue, according to Buffett. “That’s really the test,” he says in the interview.
  • Those comments from Buffett came in response to a question about whether the billionaire would ever ask a candidate what they think about the economy or other issues. Buffett laughs and points out that any candidate would probably just “tell me what I want to hear” to win his support, which is not what the billionaire would want.
  • For Buffett, being strong-minded but having enough respect to hear out someone with a different opinion or point of view is a positive thing.

Let’s stop right there for now. We’ve asked the Berkshire brands in MHVille, and their purported national mouthpiece, the Manufactured Housing Institute (MHI) to apply a standard quite like that last bullet from their boss, Buffett.

For years, Jim and Kevin Clayton, Tim Williams at 21st, top or mid-range MHI officials – they all responded to our MHProNews inquiries, often within the hour. About 2 years ago, all of that stopped.  Which begs the question, why? Why not reply to the manufactured home industry’s most read trade media?  Why not apply this Buffett rule outlined in this CNBC interview of direct, respectful engagement?  Or of listening carefully to what the other side has to say?

So Sayeth Buffett – About Investing, and About Politics…

Here are more bullets from the same read-hot, and ‘trending’ CNBC piece.

  • For example, Buffett and his Berkshire Hathaway right hand man Charlie Munger, “disagree on a few things,” Buffett told CNBC in 2018, and that’s often been helpful.

 

  • Charlie, he’s given me a lot of good advice over time,” Buffett told CNBC in a 2016 interview. “And, I may hate to take it to a certain degree, but sometimes — but my decisions have been better. I’ve lived a better life because of Charlie.”

 

  • Billionaire Ray Dalio also thinks listening to those who disagree with you is essential. It’s a hallmark of the culture that Dalio has created at his hedge fund, Bridgewater Associates, which he calls “radical transparency.”

 

  • I just wanted to see things through [employees’] eyes and to have them see things through my eyes so that together we could hash things out to discover what’s true,” Dalio said.

 

  • Billionaire tech entrepreneur Peter Thiel also likes to ask a similar questionto Buffett’s when interviewing job candidates: “What important truth do very few people agree with you on?”

 

 

  • The question is more difficult to answer than you might think, Thiel writes in his book, “Zero to One,” as it requires candidates to show both creative thinking skills as well as the courage to voice an unpopular opinion.

 

  • It’s intellectually difficult because the knowledge that everyone is taught in school is by definition agreed upon,” according to Thiel. “And, it’s psychologically difficult because anyone trying to answer must say something she knows to be unpopular.”

 

  • Meanwhile, Buffett identifies Vermont Senator Bernie Sanders as one presidential candidate who would not be afraid to answer Buffett’s question about unpopular views he holds. Buffett tells Yahoo Finance that Sanders’ followers see him as “authentic,” adding: “if you asked him you what he was for, that most people might be against, he would tell you.”

There are concerns in MHVille about the 4.4 million plus views of John Oliver’s HBO piece for Last Week Tonight on “Mobile Homes.”

 

There arguably should be furrowed brows among industry leaders. But that’s not our focus, rather, the viral Tiny House Video below is.

Why?

Because in about 5 days, YouTube reports well north of 10 million views of their video.

The video runs almost 6 minutes before you actually step into the ‘tiny house on wheels.’ Hmm, let’s see. House on wheels, if it is tiny, that’s okay?  If it a HUD Code manufactured home, that’s not?

But the fact that almost a third of the video goes by before entering the home once more blows out of the water the notion that videos must be short to be watched. Because their video is about 18 minutes long.

 

 

The Daily Business News on MHProNews has used a variety of methods to illustrate a point. It’s this.

The Omaha-Knoxville-Arlington axis can’t deny the facts.

New HUD Code Manufactured Housing producers are collectively selling fewer units today than the year Warren Buffett bought into the industry.

While the numbers of independently owned manufactured home industry firms has dramatically shrunk since 2003, Berkshire brands in MHVille such as Clayton Homes, et al have watched as their market share steadily grew.

 

  • Either Omaha-Knoxville-Arlington leaders are inept at growing the industry, or not.  For the record, we believe these to be intelligent, capable people.  The question is, capable of what?

 

  • Berkshire was either lucky that they grew their strategic Moat, or it was their stated plan has been well executed (link).

 

  • Are we to believe that a modest organization that made this tiny house video can routinely generate viral videos in days on tiny houses that may be made to no building code, while the HUD Code manufactured home industry’s giants and their Manufactured Housing Institute (MHI) can only muster low 4 or 5 figure levels of viewership in over a year?

 

The Berskhire brands, Cavco’s Joe Stegmayer, and MHI leaders had an opportunity at Tunica to debunk or refute the concerns and evidence that has mounted against them.  They have exercised their constitutionally protected right to remain silent.

If they’ve engaged in any illegal or unethical actions, perhaps that silence is wise.  But how to explain their silence in defending their own members from attacks by Oliver’s episode?  See the report, below the bylines and notices.

There’s a swamp in Washington, D.C. But let’s be clear, there are swampy, rigged, and corrupted stuff occurring in states and local jurisdictions too.  Each of these impact manufactured home owners and professionals, day be day.

It may seem odd at first to name them both in the same paragraph, but both Senator Bernie Sanders and President Donald J. Trump share this in common. They’ve tapped into the millions who believe that the systems been rigged and corrupted.

That’s almost where their similarities end. Senator Sanders (I-VT) is openly promoting a socialist agenda that’s failed almost everywhere in the world that its ever been tried.

By contrast, President Donald J. Trump – a former Democrat turned Republican – promotes an agenda that shares similar items what worked for Democratic President John “Jack” F. Kennedy and former democrat turned GOP President Ronald R. Reagan.

There are many reasons why Donald Trump captured 1/3 of the counties that previously voted for Senator (D-IL) turned President, Barack Hussein Obama.

 

Manufactured Housing and The Swamp

Manufactured housing could be roughly 10 times larger than it is today. So why isn’t it bigger? Several reasons. We explore those on a periodic basis, while spotlighting the factors that should result in more manufactured home sales.

The industry needs an independent voice – like this platform, and our publicly focused sister-site, MHLivingNews.com – that use a factual, evidence-based, and common sense ways of evaluating the realities and possibilities for manufactured homes in America today.

One of many things are certain. Like hate or no-opinion on President Donald J. Trump’s style, the future of his initial and planned reforms will depend on GOP victories from coast to coast.

Don’t dismiss – not buy-into – the so-called ‘blue wave.’ Keep in mind the same sources that say that anti-Trump candidates will win in November are those who crowned Secretary Hillary Queen… – err, excuse me, ‘president’ – in 2016.

There’s energized Democratic, Independent, and GOP voters. It’s always about who shows up.

While the Manufactured Housing Institute (MHI) paid for two pro-Clinton speakers in the closing days before the 2016 election, the Kovach family supported Donald J. Trump’s candidacy as the one we believed would be best for the manufactured home industry, independent businesses, and hundreds of millions of Americans. As the screen capture above proves, one of those pro-Trump stories ended up on the president’s campaign website, and hundreds of conservative and pro-Trump websites.

 

One Big Difference Between 2016 and 2018

The biggest difference between 2016 and 2018 are results. President Trump has proven he can do what Secretary Clinton and former President Barack Obama’s said he couldn’t and wouldn’t do.

That’s the reason you should start talking up President Trump’s record vs the false claims and smoke-screen distractions of his opponents.

Love or hate POTUS Trump’s style, he’s getting results he promised. If the House is held, and the margins in the Senate and House grow, we bet he’ll give us more victories for business and income growth in the future.
