Manufactured Housing Institute (MHI) Asks Industry Members to Ask Senators to Support S 2155, Behind the Scenes Details

In a ‘housing alert’ email to association members, the Manufactured Housing Institute (MHI) urged the industry’s professionals to contact their senators and ask them to vote “Yes” on S. 2155.

 

Passage of this language will ensure that manufactured housing retailers and sellers are not subject to compliance requirements clearly designed to apply only to the actual entity making the mortgage loan,” read part of the association’s message.

GovTrack tells the Daily Business News that the odds of passage, as of this morning, stands at 42 percent.

That’s better than what Skopos Labs believes the odds are for passage of Preserving Access to Manufactured Housing Act, which as of this morning were just 26 percent.

 

Like Getting Half of Preserving Access…

S 2155 has much more to it than MH Industry issues.

That said, the language that is Mortgage Loan Originator (MLO) rule related is akin to half of what Preserving Access bill purportedly hopes to accomplish.  Namely, the repeal of the MLO rule from CFPB regulations.  That is mildly similar to what MHI SVP Lesli Gooch has said is their strategy to move the bill ahead by whatever is moving on Capitol Hill.

 

 

Left and Right…

Doug Ryan at Prosperity Now (formerly CFED) opposes the bill, saying to the IndyStar that “This [provision for manufactured housing in the bill] will hamper new lenders from getting in.”

Some moderate Democrats, such as Indiana Senator Joe Donnelly, are likely to vote for the S 2155 bill.  Meanwhile Senators like Elizabeth Warren (D-MA) and Sherrod Brown (D-OH) are opposed to it.

Progressive media, such as The Young Turks (TYT) scorched S 2155 backers, MHI, and Warren Buffett.

For example, “One of the bill’s chief architects, Sen. Heidi Heitkamp (D-N.D.), and her husband have nearly $1 million invested in two of the bill’s biggest winners, J.P. Morgan Chase and Berkshire Hathaway, according to a 2016 financial disclosure document reviewed by TYT Investigates.

Heitkamp and her spouse collectively own between $100,001 and $250,000 of corporate securities stock in J.P. Morgan, as well as an additional up to $45,000 in a J.P. Morgan fund. Heitkamp alone owns between $215,000 and $550,000 worth of Berkshire Hathaway stock, and including joint investments, she and her husband have up to $600,000 invested in the company. Together, the Heitkamps could have up to $895,000 invested in the two firms.

For the senator, whose net worth was roughly $4.5 million in 2015, according to an estimate by the Center for Responsive Politics, these J.P. Morgan and Berkshire Hathaway investments potentially account for a substantial portion of her assets.”

Ouch.

 

Positives in the S 2155 Bill, PLUS Behind the Scenes Analysis

For those who favor free markets and more moderated regulations, the bill on the surface is just fine.

The bill would indeed be good news for thousands working in manufactured housing, if it is passed into law, because it makes communications for front-line sales people with prospective buyers.  In those ways, MHProNews and MHLivingNews demonstrably favored passage of Preserving Access, of which this bill has one of its two provisions.

But is that the key issue?

As MHProNews has previously reported, sources say there is a kind of hypocrisy in the Arlington, VA based association’s manufactured housing advocacy, as the linked and below reveal.  Plus both sides are playing politics on this issue, playing to their respective audiences.

MHI – and the powers that be behind them – are demonstrably being hypocritical, as sources inside and outside of MHI have told MHProNews – as recently as today – because MHI could have made a deal like this without Congress, by agreement with the non-profits in a deal with the CFPB’s then Director, Richard Cordray.

Furthermore, MHI knew in 2012 that they were not going to be able to get past President Obama’s threatened veto of Preserving Access, even if the Senate had voted for it (the House has passed it repeatedly, but the Senate never has).

See former MHI VP Jason Boehlert’s statement, and full report, linked below. These can be called ‘allegations.’  But doesn’t the clear evidence support those claims?  And why won’t MHI defend or explain any of this, when they are often given the opportunity?

2012 Election Results and Coming Lame Duck Session

Sources say that “consumer groups” are now opposing the option they had previously offered, in part as a possible negotiating point.

Depending on which source and their claim(s) you listen to, MHI and their overlords are:

  • Inept, since they could have made this deal years ago, and saved millions of dollars in lobbying and costs,
  • Arrogant, for not making a deal, that MHI insiders tell MHProNews was on the table,
  • Playing a shell game, because a few big companies benefit from NOT passing any bill, and they would benefit if the bill passes too. For a select few, either one is ‘win-win.’
  • Deceptive to the small to mid-sized businesses that are the most harmed by this, which has per sources led to more companies that have sold out for less than their true value in a normal business climate, or were forced out of business entirely.
  • Harming many consumers, who really do need honest guidance.

What’s particularly interesting is that Nathan Smith, MHI’s prior chairman, admitted on camera that the association had a history of missed opportunities.  Has that history changed since he made that statement?

Per sources to the Daily Business News about this MHI plan, you can therefore call these maneuvers posturing, a con, hypocrisy, stupidity, arrogance, or any of the other claims and allegations noted herein or in the linked reports.

Whatever you or those sources believe, the end result for thousands of independents is the same.

Independents have been, and are being harmed, when MHI could have made this same deal years ago.

Who will hold MHI and their string-pullers accountable?

 

And just days ago, MHProNews confirmed with sources at the CFPB that no known meeting has taken place, nor had been scheduled there.  Why not, if they were serious about making these reforms to Dodd-Frank happen?

“Unprecedented Amount of Damage,” Says HUD Secretary Dr. Ben Carson

HUDSecDrBenCarsonPhiladelphiaPASept192017Officials from both parties are praising the more organized response by FEMA and others in dealing with disaster recovery, as the Daily Business News has previously reported.  But reminiscent of the post-Katrina disaster, revival will still take years, HUD Secretary Dr. Ben Carson stated.

Carson has recently toured some disaster impacted areas, and commented on in places such as post-Harvey Texas and post-Irma ravaged Florida.

What I’ve seen has really been a catastrophe, an unprecedented amount of damage from natural disasters, which means we need an unprecedented response,” the News-Press said that Carson told reporters at HUD headquarters. “Funding allocations are an overriding priority. We want to move the compensation into people’s hands as quickly as possible. But despite our best efforts, that of course will take some time.”

Congress recently appropriated 7.4 billion in federal aid for disaster relief.

Those sums, Carson says, will be carefully allocated.

It will include relief to those low- to moderate-income homeowners without flood insurance, businesses which won’t qualify for a Small Business Administration (SBA) loans, as well as for infrastructure projects that state and local governments can’t afford to repair.

Pay More Attention to What People Do Than What They Say

Applying long-time MHI award winning member and critic Marty Lavin’s principles, shouldn’t the industry pay more attention to the results than the posturing or self-praise chest-thumping by MHI?

Editorially, MHProNews has promoted the notion that Dr. Carson needs to invest one to three days touring manufacturing centers, retail centers, communities and talk to actual home owners of manufactured homes.

If Dr. Carson does that, sources tell MHProNews, he can’t help but be impressed with homes produced by regulations his federal agency ultimately overseas.

 

 

Manufacturers who have had the experience of providing such tours to public officials have told the Daily Business News on MHProNews that it is routinely an “aha!” moment when an official see first-hand the modern realities of the business, vs. the outdated myths and misconceptions that of prevail in the mainstream media, among policy advocates, politicos, bureaucrats and others.  ## (News, analysis.)

Big Horn, Fire Alarms, Deal Making & Big Time at Deadwood

Mixers. Meals. Networking. Gaming. Dining. Local and nearby tourist sights. Buffalo burgers.

And let’s not forget business, golfing, presentations, deal making, auctions, and meetings.  All this and more were found at the popular 5 State Convention in Deadwood, South Dakota.

Selling the American Dream

Selling the American Dream” was the theme of author, speaker, industry veteran, and consultant, Ken Corbin.

Corbin spoke about several topics.

They included company and industry life-cycles, why businesses and industries grow, whither, die and how they can revive.

One of Corbin’s several points was that since the peak of 1998, some 10,000 independent retailers have vanished in the manufactured housing industry.  It was a point in keeping with a Daily Business News report, linked here.

Maximizing Sales & Compliance

Ron Gorsline, Hudson Cook Law Firm did what attorneys addressing professionals often do.  He got into the nitty gritty of how the Consumer Financial Protection Bureau (CFPB) is dealing with business in general and the manufactured housing industry in particular.

In some cases, Gorsline said, the CFPB is making it up as they go along.

Among Gorsline’s points was that a company being investigated could spend $500,000 defending an action, one that the CFPB might later decide no error or wrongdoing had occurred on the part of the investigated company.

The burden that kind of enforcement creates on a small business can be devastating.

The issues Gorsline raised have been a periodic focus on MHProNews for years, and is one reason why editorially this publication opposed Secretary Hillary Clinton for president, as she was a strong advocate of the CFPB and Dodd Frank.

By contrast, candidate-now-President Donald Trump has promised to do away with the overbearing powers of the agency.

The attorney’s presentation was interrupted when fire alarms went off, and the building was ordered evacuated. Jerry Vogler of the S.D. Manufactured Housing Association said it was the first time in 30 years that he’s had that experience.

It turned out to be a false alarm, and the warmly applauded meeting resumed.

How to Dominate Your Local Market

Kovach is a well know speaker in manufactured housing circles. Feedback on L. A. “Tony” Kovach’s presentation was robust from association as well as business attendees.

Jerry Vogler said that the turnout for this convention was the best in years. Feedback from attendees for the event was routinely positive. Stuart Doggett of the Montana MH and RV association was another familiar face engaged in making this event possible, as were sponsors and others. 

The popular presentation may be laced with hot links and provided to the industry at large at some time in the future. The key themes were the industry’s tremendous potential, while often facing misinformed, bigoted, or prejudiced head winds from media, officials, and others.

He also addressed the fact that home owners wanted to be part of the solution in dispelling the myths and misconceptions about today’s manufactured homes.

He also gave a flash version of how the actively retired businessman, the Rev. Donald Tye, Jr. and he met.  He explained how they are collaborating in efforts to improve the lives of others through a proper understanding and respect for manufactured homes.

HUD Secretary Ben Carson has said that home owners have an average  The net worth of $200,000, while renters only have a $5000 net worth.  Home ownership, says Tye and Kovach, is a cause that’s good for society at large.

What’s wrong is that we don’t ask what’s right,” Kovach quotes Chesterton.

He said it was a mistake for the industry’s independents to wait for anyone from Washington to come riding into save the industry. That has to be done at the local level by dedicated, honest, and willing-to-learn and develop professionals.

Kovach said that the industry can return to 500,000+ new manufactured home shipments annually sustainably, ethically, and with happy customers by following proven steps at the local market level.

Robinson is a good speaker, good writer and a likeable person, says MHProNews publisher, L. A. “Tony” Kovach. Clayton Homes “Have It Made” Campaign, Manufactured Housing Pros React, Initial Analysis

Clayton finally took the bull by the horns, and quit waiting on the industry to decide how to do it,” said Hamilton. “So, they are going to do it themselves.  Good for them!

Builder Online Touts

 Clayton, one of the largest home builders in the country, has kicked off its biggest marketing campaign to date focused on how its building process can help provide affordable housing for American families,” said Builder in their initial review.

The Have It Made initiative launched nationwide Sept. 2 with a 60-second commercial air during the the [sic] University of Alabama and Florida State University football game,” Builder’s article by senior editor Jennifer Goodman said. “The campaign represents the company’s mission to provide quality homes at affordable prices, says Kevin Clayton, CEO of Clayton Homes.”

Common MH Industry Reactions

There have been numerous comments received by MHProNews regarding Clayton’s initiative. The Clayton video has drawn mixed reviews, as the comments above and below reveal.

A common reaction has been the notion advanced by some readers that “MHI should be doing this.”

There are concerns raised over Clayton’s sheer size vis-à-vis the balance of HUD Code home production, and their vertically-integrated retail arms, all of which operate under several different brand names.

There are those who just don’t like the video.

The following IM exchange with MHProNews from an industry veteran is an example, and it took an interesting view.  Their comments = C, our reply = R.

  1. C) “I do not like the [Clayton Homes video] spot.”
  2. R) Interesting. Why not?
  3. C) Their “…commercial reinforces stereotypes more than I would like. I know their goal was to change it [perception, stigma], but they mention it way too much for my liking. I know of the firm they hired – they are out of Colorado.”

For those that have voiced concerns that “MHI should be doing this,” hasn’t their General Counsel/Sr. Vice President of State & Local Affairs, Rick Robinson, obliquely spoken for the Arlington, VA based association’s take on Clayton’s campaign?

I know that Clayton [Homes] has been to many of your state [association] meetings showing their new ad campaign,” wrote Robinson earlier this week. “To see the formal release and a video of the first ad,click here. I hear that you’ll be seeing these ads a lot on SEC football games.”

Aren’t Robinson’s comments pretty matter of fact?

MHI funded research and resources, per sources to MHProNews, have allegedly been used in part by Buffett’s manufactured housing units.

If so, doesn’t that concern and other allegations noted indicate the reality that the Berkshire Hathaway’s Chairman holds two of four seats on the organization’s all-powerful MHI Executive Committee?  Or that small to mid-sized members are helping pay for what the biggest members want?

Or consider this fact.  That the third MHI Executive Committee seat is held by what Forbes called a former Clayton Homes division president?

Or that the fourth seat is held by a firm that has Clayton product – or makes use of Berkshire-connected lending – in their land-lease communities?

Using the figures supplied by Cavco (CVCO) and MHI, some 63 percent of the industry’s production is held by Clayton and Cavco. Can you spell, monopoly? Does that create conflict of interest within MHI? Or does it warrant other business, consumer, and legal concerns?

State Association, non-MHI Member Reacts to Video and Image Campaign

While not commenting on this specific campaign, Marty Lavin has lashed out repeatedly at MHI’s failures, while carefully weaving, so as not to step on Clayton or Berkshire Hathaway toes.

Facts Matter

The threat to Clayton, MHI – and potentially ‘monopoly innocent’ members of the industry – is that a video like theirs will raise questions in the public’s mind.

As MHI/NCC Vice President Jenny Hodge said, people research online, they don’t just buy.

When

  • Democratic lawmakers,
  • the Center for Accountability,
  • Ishbel Dickens/NMHOA and others are making charges and allegations of racism, steering, “near monopoly,” and predatory lending,

won’t those concerns be found by savvy buyers who do a Google, Yahoo or Bing search?

While there are a few that think it is a mistake for MHProNews to report on or analyze such matters, MHR publisher Kurt Kelley said, ” There’s nothing mean or villainous about stating the truth. What MHI President and CEO, Richard A. “Dick” Jennison said in the roughly 20 second video above is revealing, in the light of other reports by MHProNews.

Note the easy question asked, and what Jennison answered. Why would a man that requires Berkshire Hathaway’s support get his contract extended after making that shocking statement? Would the National Association of Home Builders (NAHB) or the National Association of Realtors (NAR) extend the contract of someone that said something similar in their industry?

Industry Potential, and Problems

RV’s outsell manufactured homes by about 5 to 1.  When RVs – which are a luxury item, not a necessity such as a home is –  have been growing rapidly, why not manufactured housing?  When the data that Clayton and Cavco published reflects the fact that those two companies are growing at a somewhat slower pace than the industry at large, should they be leading the charge for image, education, and marketing?

Sam Zell publicly pointed to the need for the industry to establish a sound credit base.

Obtaining a stronger source for competitive, additional financing – didn’t two of Warren Buffett’s Berkshire Hathaway (BH) lending brands admit to NOT supplying the Government Sponsored Enterprises (GSEs) with data they wanted for chattel lending?  Didn’t that failure by BH lenders to supply such data harm most of the industry’s desire for the GSEs to do robustly do chattel loans?

Good news and analysis writers don’t begin with the punch line, but some rules were meant to be periodically broken.

Most manufactured housing professionals would far prefer not to deal with politics or complex regulatory issues. They are in business or working for a company to earn a good living.  That said…

With about 7 percent of the nation living in a pre-HUD Code mobile home, or post-code manufactured home, imagine a municipal council where 33 percent of their elected officials are manufactured home owners who love the industry. A place where the local Chamber has met and embraced their manufactured home community operation as an asset. Where businesses are cross promoting each other, including the quality, affordable manufactured home lifestyle.  Can you see how a very-real place like that would help professionals earn more while having happy customers?

Fast Forward

Today, the relationship with some of the MHI staff and the industry’s largest, and most popular trade media has turned frosty. Why?  Did that frostiness precede published exposes?

Why has the relationship with MHARR, several state associations, various companies and MHProNews improved during that same period? Are there connections between those contrasting realities?

This writer has an unfair advantage in answering such questions, because I listened and watched as MHI President and CEO Richard A. ‘Dick’ Jennison went from several calls and messages a week – just over three years ago – to suddenly, unilaterally stopping positive engagement altogether.  Those or other possible allegations won’t be the focus of today’s report.

By contrast, there has always been regular contact with MHARR, even during periods where MHProNews took editorial positions different than theirs. Isn’t that how it should be? The relationship with state associations has generally been cordial, warm, friendly, to good. But again, when there were differences, that didn’t keep associations or trade media to be in sharp conflict with each other.

The focus of this Friday Flashback is the reality that MHLivingNews and MHProNews have worked to promote items useful and beneficial to MHI, MHARR, other associations/their respective members – as well as non-aligned companies.  We’ve done so since our inception, and have continually done so for years.

Need to be Pro-Industry, Pro-Consumer

The president of a national operation with numerous locations from coast-to-coast said the following to MHProNews yesterday.

They’re probably pissed bc of the old trade association mantra – you’re either with us or against us.”

The off-the record message was a mix of encouragement and that person’s own critical analysis of those who don’t see the value of offering balanced, independent, manufactured housing industry news and commentary.

Let’s deal with the realities of the business . . . and trust that the broader public and our customer base will appreciate the honesty and reward us with more business,” that president wrote. “Thriving industries at the end of the day deliver a strong value proposition.  Let’s focus on doing that!”

The number of MHI, MHARR, and other association members who actively read, follow. and support the analysis offered by MHProNews is growing, as is the industry’s overall readership of the industry’s largest and most-trusted trade media.

There are a growing number of operations in manufactured housing that understand that local HUD Code retailers and communities could be growing at profitable, sustainable, higher double-digit or even triple-digit annual rates.

That would mean that:

  • as community vacancies drop, values would rise,
    • Retailer profits would grow,
    • HUD Code production and profits would grow,
    • More lending,
    • More insurance,
    • more transportation, more installations, more anchors, ‘skirting’ (foundation enclosures), more ACs, porches, steps, decks, other ancillary services, etc.
    • and for associations that get floor dues, more revenues.

DOJ, HUD Update Existing Guidance Despite Calls for a Moratorium

The Departments of Justice (DOJ) and Housing and Urban Development (HUD) released updated guidance on the application of the Federal Fair Housing Act (FHA) to state and local land use planning laws on December 12th.

The guidance is designed to help state and local governments better understand how to comply with the FHA when making zoning and land use decisions as well as to help members of the public understand their rights under the FHA,” the agencies said in a joint statement.

The FHA prohibits discrimination in housing based on disability, race, color, religion, national origin, sex and familial status (residing with children under 18).

The statute bars state and local governments from enacting or enforcing land use and zoning laws, policies, practices and decisions that discriminate against persons because of a protected characteristic, such as race, national origin or disability.

The Fair Housing Act helps protect open, free and integrated communities,” said Principal Deputy Assistant Attorney General Vanita Gupta, head of the DOJ Civil Rights Division.

Government officials, housing providers and the general public need to understand how land use and zoning decisions can create barriers to equal housing opportunity.  We hope this guidance will help communities make these decisions free from discrimination.

This updated guidance will help give localities and the American people a clearer line of what could constitute housing discrimination under the federal Fair Housing Act.  Cities will also have more resources to understand their fair housing rights and responsibilities in the course of making decisions related to various types of housing, including group homes for residents with disabilities.

While a good portion of the Guidance deals with land use planning as it applies to group homes, there is much our state associations can use when they are dealing with cities attempting to eliminate our homes from the supply of affordable housing stock via zoning,” said Rick Robinson, General Counsel for the Manufactured Housing Institute (MHI).

The movement by the DOJ and HUD run counter to calls from many inside and outside of the MH industry for a moratorium until President-elect Donald Trump takes office.

MHARR recently told the MHProNews that they are calling on the heads of three agencies specifically – The U.S. Department of Energy (DOE), the U.S. Department of Housing and Urban Development (HUD) and the Federal Housing Finance Agency (FHFA) to defer further action on pending controversial rules or actions that could have a severely negative impact on both the manufactured housing industry and American consumers of affordable housing.

South Carolina City Amends MH-related Ordinance

mfg_home_being_moved_from_a_Florida_community__citylab_slash_Esther_SullivanRick Robinson of the Manufactured Housing Institute (MHI) informs MHProNews of the second reading by the Darlington County Council in South Carolina of amendments to a manufactured housing (MH) ordinance.

The proposed ordinance requires a county registration decal be displayed on any MH within 15 days of its transfer of ownership or location, provided it is located within Darlington County; and the decal must be visible from the street or roadway the home faces.

Exceptions include manufactured homes that will be in the state less than 30 days, as well as units on display at sales centers that have a license to sell MH. Temporary registration is available for MH involved in legal issues, and may also be obtained by individual owners for up to 180 days providing they do not meet the requirements for permanent registration. ##

Michigan State Association Conference to Honor Members’ Efforts

michigan manufactured housing association logoNew this year at the Michigan Manufactured Housing Association’s (MMHA) 74th Annual MMHA conference in Detroit Oct. 19-20 will be a program to recognize the exceptional marketing and communications efforts of our members, according to news.sys-con. Categories include best community entrance, best model home staging, best community event or activity, best member sales event or activity, best member website and best member advertisement. Winners in each category will receive an award.

Speakers at the conference include Liz Keegan from the Fair Housing Center of West Michigan, Darren Krolewski with Datacomp and Debbie Ostrander from the Department of Environmental Quality. Rick Robinson from the Manufactured Housing Institute (MHI) will discuss national industry issues, while state governmental liaison Tom Hoisington of Public Affairs Associates will go over important legislative updates.

Additionally, MHProNews has learned a panel session, “Legally Speaking,” will feature two attorneys, I. Matthew Miller and Matthew Paletz, hosted by MMHA legal counsel Bill Perrone.

Updated Rent Stabilization for Manufactured Home Communities due in June

manuf home  plantation on the lake  credit  calimesa califRick Robinson of the Manufactured Housing Institute (MHI) has informed MHProNews that the city council of El Monte, California, county of Los Angeles, on March 30, 2015 approved Urgency Ordinance No. 2852 to extend the existing manufactured home (MH) rent stabilization for an additional three months, through July 3, 2015.

On April 29, 2015 the city mailed notices seeking feedback from community owners, managers, residents and other interested parties regarding the rent stabilization issue. On May 4 the city was to have conducted another meeting with community owners and other interested parties for their input.

In the meantime, the city staff has been instructed to formulate regulatory options for rent stabilization and discuss the issue with stakeholders. Since the current measure expires July 3, it is anticipated the El Monte City Council will approve an updated ordinance by June 2, 2015. ##
