Manufactured Housing Professionals, HUD Secretary Ben Carson, Must Promote These Two Words

There are times that simplicity is useful. Consider these facts.

 

·        There is an affordable housing crisis.

·        HUD Secretary Ben Carson and thousands of others say that local zoning and placement (barrier) issues are harming the nation.

·        Conventional builders (National Association of Home Builders, factory builders, others) say that zoning, regulatory, and placement issues are harming the nation and affordable housing.

·        But the simple application of two words that are already law could solve much of this almost immediately.

 

What are those two almost magical words?

Enhanced preemption.

Under the Manufactured Housing Improvement Act of 2000, there is a provision that ‘enhanced’ federal preemption. That provision has been used on occasion, but not routinely.

If HUD Secretary Ben Carson ordered the Office of Manufactured Housing Programs (OMHP) to fully implement enhanced preemption on HUD Code manufactured housing, local barriers that so complicate the issue of manufactured housing could melt away.

The Manufactured Housing Association for Regulatory Reform (MHARR) is already behind this concept.

The Manufactured Housing Institute (MHI) was part of the coalition that made enhanced preemption part of federal law.

 

 

There are state association executives that already know about this provision of the current manufactured housing law, believe in it, and want to put that provision to work.

There are HUD Code producers that of course know about enhanced preemption.

Implementing those Two Words = Enhanced Preemption = under the MHIA of 2000 could change the fortunes of potentially millions of Americans over time.  It would boom the production side of the industry.  Others could enter the industry and tap into the millions of affordable housing opportunities that those two words would unlock.

Unique Shipping Container Home, Lessons for Factory Builders, Manufactured Home Professionals

Spoiler alerts. First, this isn’t a tiny container house.

 

The second spoiler alert is that this video doesn’t give the cost of the completed project.  What we know from other container housing projects is that they are significantly higher than a HUD Code manufactured home.

But what makes this one interesting is that:

·        It was a DIY project.

·        So, the construction cost may well have been ‘closer’ to a similar sized manufactured home, and less than a conventional house.

Here is what their YouTube webpage said.

Seven gray metal rectangles create a stacked array of straight lines on a quiet street in New Orleans. These shipping containers once traveled along the Mississippi River.

Now stationary, they make up the extraordinary home of Kicker Kalozdi, founder of premium bag company DamnDog, and his wife Anne Kalozdi, who is a biomedical engineer. They designed and built this house made out of shipping containers… despite having had no real experience building a house before!

It’s an interesting design.  Another reason to showcase this is that this video has had approaching 300,000 views in about a week online.

We’ve observed previously on the Daily Business News on MHProNews that container housing – especially single-section container homes – reflect an kind of American search for the single section HUD Code manufactured home alternative. A single sectional home looks better than a container does for a house. That’s a fundamentally educational or marketing issues. It is a wake up call. It is an opportunity in disguise.

There are already some 22 million in the U.S. living in
pre-or-post HUD Code homes, but what is the potential for the market?

 

Several reports independent of the manufactured housing industry in 2018 established the value of modern manufactured homes.  Several stated that manufactured homes were an important part of the solution for the affordable housing crisis.

A summary on several of those third-party studies that reflected positively on manufactured homes is linked here and further below, following the byline and notices.

So, there are already groups that see the value of manufactured homes, but there are also those outside of MHVille that think of our form of factory-built housing as homes for the poor, working, or lower middle class.  Some in our industry believe something similar. But is that a fair assessment?

The short answer to that subtopic is ‘yes and no.’ How so?

On the one hand, researchers reveal that the average income of HUD Code manufactured home residents is significantly lower than that of conventional housing. That’s a large market that is worth serving.

But it would ignore the reality that thousands who make far more than the average – and chose manufactured home living. Manufactured homes are desirable regardless of income.

  • MHLivingNews has interviewed millionaires who live in manufactured homes. There are also reports there of billionaires who own manufactured homes – even a single sectional.
  • MHLivingNews has also interviewed upper middle class owners of manufactured homes. There are likewise numbers of prior owners of conventional housing that own and praise their manufactured homes.

Which bring us to the broader question. Given the fact that numbers of upper-middle-class, plus some millionaires and billionaires have a manufactured home, what is the manufactured housing market potential? Let’s look.

First, to understand the answer to the question, first time readers and those new to manufactured housing must realize that for decades, there have been upscale manufactured homes and entry level HUD Code homes. It is somewhat similar to entry level cars, boats, RVs, other big ticket item industries.

With those thoughts in mind, here’s a snapshot of who could be a potential manufactured home customer.

  • Renters,
  • First Time Home Buyers.
  • Upsizers – including those who may own a conventionally built or other house, but want a larger floorplan home,
  • Downsizers – including those who own a conventional housing unit,
  • Retirees, and
  • Second or vacation home seekers.

 

Rephrased, almost anyone who is properly exposed to the realities vs the myths might want a manufactured home. Renters alone represent some 100,000,000 in the U.S., per CityLabs. iPropertyManagement says that about 33 percent of all households are in rental housing.  That one demographic group – renters – is enough to keep manufactured home producers busy growing in a sustainable way for years to come.  And the 2018 research by the National Association of Realtors (NAR) reflects the fact that millions of those make enough money to qualify for a manufactured home.

 

 

One more Factoid – What’s the Potential in Your Market?

Pointing to Census Bureau information, Melisa Data says that every year in the U.S. “an overall percentage of 14.19 percent annually” are moving from one housing unit to another. That means about 1 in 7 on average in your market are going to be moving every year.  Imagine that every 7th driver, every 7th person at a store, house of worship or wherever you encounter Americans are going to be moving this year.

Viewed as a marketer or sales professional should see this, that’s a huge and ongoing pool of potential prospects. Which begs the following questions.

  • So why are so relatively few prospects coming into your manufactured home community or street retail sales center?
  • Why are significant numbers of those coming into a sales center or community credit challenged than the pool seeking conventional housing?

Each of those 2 bullets are marketing, public relations, and educational issues.  But the fact that some prospects are well qualified, means that others like them can be attracted too. The fact that some millionaires and billionaires own a manufactured home, mean that more could be attracted too.  A look at the data with clear eyes tells the savvy that properly understood, the potential for manufactured housing is astronomical.

Which also means that the industry is underperforming, and it also means that those willing to apply the Sam Zell dictum could soar.  “When others are going left, look right.”  That ‘right’ is manufactured homes, communities, and other segments of the business.  Many underperforming means others could and should be outperforming and wildly prospering.

Bottom Line Takeaways for Industry Professionals? 

Whatever the agenda or reasoning process of others who seek to explain manufactured housing’s relatively low performance, the outline above reveals something brighter and more opportunity laden.

It’s an obvious advantage to be able to sell a product or service that costs less than competing alternatives. At present, manufactured homes are the lowest cost permanent housing choice made in the U.S. or Canada.  Here in the U.S., manufactured homes have the advantage of enhanced preemption. There are also multiple story options for manufactured homes that are rarely consider outside of this publication.

The statutory Manufactured Housing Consensus Committee (MHCC), meeting in Washington, D.C. from September 11-13, 2018, tackled a lengthy agenda of proposed items, including proposals derived from deregulatory comments filed by MHARR (and other stakeholders) pursuant to Trump Administration Executive Orders (EO) 13771 and 13777, concerning a wide range of matters, including the Subpart I regulatory process, multi-unit manufactured homes, so-called “add-ons,” on-site construction and HUD’s proposed “frost-free foundation” Interpretive Bulletin (IB) (all of which were raised and addressed in detail by MHARR in its February 20, 2018 manufactured housing program deregulation comments pursuant to EOs 13771 and 13777), as well as separate comments regarding the U.S. Department of Energy (DOE) Notice of Data Availability (NODA) on proposed manufactured housing energy standards (see also, article below). HUD’s ultimate disposition of these (and other anticipated) deregulatory recommendations by the MHCC (and other program stakeholders), will be a key test of the implementation of the Trump Administration’s deregulatory policies at HUD, including the strength and persistence of Trump Administration appointees at the agency, as contrasted with the entrenched regulatory bureaucracy at HUD and other federal agencies including, but not limited to, DOE.

 

  • Subpart I Procedures: The MHCC approved a motion to reduce the frequency of in-plant record reviews in 24 C.F.R. 416(a)(4) from “at least” once per month to once per quarter (MHCC Log Item 153).  Industry members will recall that when Subpart I was amended in 2013, as a consequence of a Petition for Rulemaking filed by MHARR seeking wide-ranging reforms to the overly and unnecessarily-costly Subpart I process, HUD – in the final rule (i.e., after the rulemaking comment period had expired) – surreptitiously inserted language in the rule requiring “at least” monthly IPIA record inspections. MHARR, at the time, and ever since, has strenuously objected to the needless and unduly burdensome “monthly” record inspection mandate — including calls to eliminate that baseless mandate in its June 7, 2017 EO 13771/13777 comments to HUD and its February 20, 2018 comments regarding the specific application of EO 13771/13777 to the HUD manufactured housing program. While mandatory quarterly inspections will still unnecessarily constrain IPIA discretion to conduct fewer inspections for manufacturers with proven compliance records, the change would nevertheless help to reduce regulatory compliance costs from current excessive levels and represents a step in the right direction.

 

  • Energy Regulation: The MHCC took several important steps on energy regulation.  First, by a vote of 17-1, following extensive comments by MHARR’s representative at the meeting, the Committee rejected a motion by a former MHCC member and energy special interest participant in the DOE Manufactured Housing Working Group (MHWG) that would have put the MHCC on a path to actively consider DOE’s high-cost June 2016 manufactured housing energy standards proposed rule, even though that proposal has effectively been superseded by the August 3, 2018 DOE NODA. Put differently, that proposal (MHCC Log Item 170), would have done an end-run around DOE’s retreat from the fundamentally tainted and arguably scandalous June 2016 DOE proposed rule, and would have retrenched that proposal, effectively, as a potential HUD standard. In addition, the MHCC (with significant input from MHARR’s representative at the meeting), only days before the September 17, 2018 DOE NODA comment deadline, adopted resolutions strongly expressing its continuing disapproval of DOE’s extremely costly and market-disruptive energy proposals for HUD Code manufactured housing (see, article below for the text of the MHCC’s resolution), and calling, as well: (1) for continuing HUD engagement with the MHCC on this matter; (2) for HUD’s Policy Development and Research (PD&R) office to develop information and data on potential energy regulation cost impacts on manufactured housing within sixty days; and  (3) for DOE (and, effectively, Congress) to re-delegate the entire matter of manufactured home energy performance back to HUD. MHARR, as the only national industry organization to continually oppose this rulemaking from its inception and at every stage, will continue to make this matter a top Association priority going forward.

 

  • Frost-Free” Interpretive Bulletin and “Field Guidance”: The MHCC also took action on MHARR’s call in its EO 13771 and 13777 deregulation comments (see, February 20, 2018 MHARR comments at pp. 28-30) for the withdrawal of HUD’s proposed “Frost-Free Foundation” Interpretative Bulletin, which would unilaterally and unlawfully change the existing federal manufactured housing installation standards be equating “acceptable engineering practice” — currently permitted by section 3285.312 of the standards — with the requirements of the American Society of Civil Engineers 32-01 reference standard in every instance.  By a unanimous vote, the MHCC recommended that HUD withdraw the existing proposed IB – the development and publication of which MHARR had strenuously opposed in written comments filed with HUD in 2017 and in direct meetings with HUD Secretary Ben Carson and senior-appointed HUD officials – and that further action on an amended, legitimate IB be referred to the MHCC’s Regulatory Subcommittee. Going forward, in addition to necessary changes to any IB, MHARR will also seek a parallel MHCC resolution for the withdrawal of HUD’s Frost-Free Foundation “Field Guidance” memorandum, which preceded the proposed IB and has not been rescinded.  This Frost-Free “Field Guidance” memorandum was addressed in MHARR’s February 20, 2018 EO 13771/13777 comments, which called for the withdrawal and/or invalidation of multiple “Field Guidance” edicts that were issued by HUD without MHCC review and recommendations as required by the Manufactured Housing Improvement Act of 2000.

 

  • Carports, Garages and “Add-Ons”: The MHCC, in addition, addressed multiple proposals dealing with standards changes and/or the withdrawal of HUD “Field Guidance” memoranda (which were never submitted to or addressed by the MHCC, in violation of the Manufactured Housing Improvement Act of 2000) concerning carport-ready homes and attached garages. In part, the Committee voted to recommend the withdrawal of HUD Field Guidance memoranda requiring Alternate Construction (AC) approval for carports, by effectively classifying carport-ready designs as involving an “add-on.” The Committee also adopted a resolution supporting amendments to various sections of the Procedural and Enforcement Regulations to permit specific “add-on” structures, including garages. Again, each of these changes have been specifically addressed and advocated by MHARR in both written comments and direct interactions with HUD officials.

 

  • Multi-Family Manufactured Homes: Lastly, in response to a specific proposal (MHCC Log Item 160) addressing, among other things, the definition of the terms “dwelling” and “dwelling unit” within the Part 3280 Manufactured Housing Construction and Safety Standards, HUD confirmed that a previous MHCC proposal to permit “multi-unit” manufactured homes – crafted and approved by the MHCC with the strong support and significant substantive input of MHARR – will be included in upcoming standards revisions currently being developed by HUD.

While, as is demonstrated above, the MHCC made important progress in a number of key areas, and particularly with respect to deregulatory proposals submitted in response to HUD’s manufactured housing program-specific EO 13771/13777 regulatory review, significant portions and aspects of the nearly 250-pages of proposals forwarded to the MHCC by HUD (essentially passing-through deregulatory comments submitted by 157 organizations and individuals) remain to be considered and addressed.  MHARR, therefore, will continue to aggressively seek proper HUD engagement with the MHCC, timely MHCC consideration of deregulatory proposals and participation in the program EO 13771/13777 process, and both timely and proper follow-up by HUD in accordance with both EO 13771/13777 and all applicable provisions of the 2000 reform law.   

 

MHARR STRONGLY OBJECTS TO NEW DOE ENERGY PROPOSALS

 

            MHARR has filed comments strongly opposing alternative new energy proposals put forward by the U.S. Department of Energy (DOE) in its long-running and irretrievably-tainted manufactured housing energy standards rulemaking.

In written comments filed on September 17, 2018, MHARR, in response to an August 3, 2018 DOE Notice of Data Availability and Request for Information (NODA) regarding a series of “alternative” DOE proposals for manufactured housing energy criteria, objected to the adoption of any proposed manufactured housing energy standards based on – or derived from data developed during – the fundamentally tainted, illegitimate and fatally-flawed “negotiated rulemaking” process conducted by DOE in 2015 and 2016. That process, as demonstrated by documents obtained by MHARR pursuant to the Freedom of Information Act (FOIA), was structured by DOE and special interest allies as widow-dressing after DOE, by its own admission, “impermissibly” distributed copies of a draft energy rule to many of the same special interest groups.

Noting that manufactured homes, built in accordance with existing HUD standards, already achieve whole-house energy operating costs that are less than – or, in the case of electricity — only slightly higher than those for other types of homes, at a significantly lower purchase price that is inherently affordable without the need for costly government subsidies, MHARR stressed that the “alternate” DOE proposals (as well as the June 2016 DOE proposed standards) would either: (1) exclude hundreds-of-thousands (and potentially millions) of households from the manufactured housing market and homeownership altogether, with no possible offsetting benefits; or (2) offer minimal benefits to those not altogether excluded from the market at a significant additional initial cost of as much as $5,000.00 for a double-section home in Climate Zone 3 that would harm home purchasers and negatively impact competition within the manufactured housing market to the extreme detriment of smaller, independent manufactured housing producers.  

            As the only national industry association to continually and consistently oppose DOE energy standards for manufactured housing – during the “negotiated rulemaking” process (and even before), during the June 2016 DOE rulemaking process (including a direct meeting with the Office of Management and Budget’s Office of Information and Regulatory Affairs (OIRA), which ultimately rejected the DOE proposed rule), and now in response to the 2018 NODA – MHARR successfully pursued MHCC comments opposing both the June 2016 DOE proposed rule, and now the NODA “alternate proposals,” with the MHCC stating in a resolution:

“The MHCC objects to the timing and substance of DOE’s request for information and content of the Proposed Rule. [The] MHCC … sees a need for significant review of work done previously as well as further review of conclusions reached in this Notice of Data Availability. The time allotted for comment in this notice is insufficient for the committee to properly consider all of the questions posed by DOE.  We strongly urge the Secretary of HUD to exercise his option under 42 U.S.C. 17071(a)(2) to seek further and ongoing counsel from the Manufactured Housing Consensus Committee (MHCC) regarding proposed rules published by the Department of Energy (DOE) in the Federal Register Vol.83 No. 150.  In accordance with HUD’s preemptive authority under 42 U.S.C 5403 (g), it is the belief of this committee that the goals of affordable and safe energy efficient housing would be best served by re-delegating this regulatory authority to HUD/MHCC.”

MHARR believes, and has advised DOE, that it essentially has three possible courses in this matter, either – (1) abandon any manufactured housing energy rulemaking; (2) re-start its manufactured housing energy rulemaking process from the beginning, to eliminate any ongoing taint or prejudice from the improper and illegitimate “negotiated rulemaking” process; or (3) face potential litigation if it fails to act in accordance with either of the foregoing courses of action.

 

As it has been from the outset, possible DOE energy regulation, and aggressive, consistent opposition thereto, is – and will remain – a top regulatory priority for MHARR.

Before the recap, further below, and today’s industry-connected commentary, we will begin with a programming note.

 

There is a local post-production issue that is brewing. It is part of a national pattern. The topic is classic efforts to zone out current and future manufactured homes (MH). It is a big issue, one that both national MH associations has noted. But it falls in the self-stated area or interest for the mission of the Manufactured Housing Institute (MHI). Rick Robinson, MHI General Counsel and Tom Hodges, JD, who sits on the Executive Committee for Clayton Homes have been contacted by MHProNews. We’ve documented the contact with MHI and Clayton’s attorney. The local officials involved, plus a number of other attorneys and other interested MH parties have also been contacted.  

MHProNews will let you know who does what.  

An initial report on that hot button, local issue that could impact communities, retailers, residents, and others is drafted and awaiting publication early tomorrow morning here on the Daily Business News on MHProNews.  

The draft can be changed if/as parties respond. Actions speak louder than words. That’s tomorrow’s sneak peak. 

 

Shift One

We will shift gears twice before getting to our headline news recap. Here’s the first shift. Our focus is Texas, and MHVille. But first this disclosure.

This writer has witnessed first-hand politics in three different nations. Iran, Hungary, and here in the U.S. In all countries, you can find candidates who can say or promise anything to get elected. As someone who loves her native land, as someone who went to medical school in the noble nation of Hungary, I can tell you that we were happy to support candidate-now-President, Donald J. Trump in 2016. Fair minded people agree that like his style or not, he has been working day-by-day at keeping his campaign promises.  

That’s why millions love President Trump. That’s also why so many hate him. There is nothing more dangerous to the left wing of the U.S. than a businessman turned politician like POTUS Trump. Recall that 21st’s Tim Williams observed that the progressive movement is at the top of the threats to manufactured housing.

President Trump has also threatens several in the “establishment” or “RINO” wings of the Republican Party. He has made enemies. One might say, he’s made the right enemies.

Now look at the history of Senator Barack Obama, who was previously an attorney and community organizer for ACORN.

On October 18, the Wall Street Journal (WSJ) wrote: “We’ve written about them for years, but Acorn is now getting more attention as John McCain’s campaign makes an issue of the fraud reports and Acorn’s ties to Mr. Obama. It’s about time…”

FactCheck is a “Project of The Annenberg Public Policy Center.” It is funded by the Annenberg Foundation, and has received major donations from Facebook. Follow the politics, follow the money. Facebook founder Mark Zuckerberg is pro-Democratic, and admits he and his many of his companies people are left-leaning. This is what Tim Williams notably said is a threat to MH.

Inside Philanthropy reported about FactCheck that “The organization’s biggest funder is the Annenberg Foundation, which has given over a million dollars to FactCheck.org in the past two years. We can’t resist pointing out the irony here: Walter Annenberg, the newspaper magnate behind this fortune, was not above using his publications to slant the news to advance an agenda.” 

This is part of how “news” is shaped. This is why we’ve shared Sharyl Attkisson’s media chart, and the video documentary, Shadows of Liberty.

This is why it pays to “follow the money,” as Marty Lavin, JD, has said.

At the same time as the WSJ quote above, part of what Fact Check wrote is this, quoting from a McCain-Palin ad.

Announcer: Massive voter fraud. And the Obama campaign paid more than $800,000 to an ACORN front for get out the vote efforts. 

Pressuring banks to issue risky loans. Nationwide voter fraud. Barack Obama. Bad judgment. Blind ambition. Too risky for America.” It is part of a longer message that included, Senator McCain saying, “I’m John McCain and I approve this message.”

Left-leaning backed FactCheck claimed there was no real evidence ACORN. Here’s a key part of how they said it.

On Oct. 16 The Associated Press quoted two “senior law enforcement” officials as saying that the FBI is investigating ACORN seeking “any evidence of a coordinated national scam.” The following day the Obama campaign’s lawyer, Robert Bauer, sent a seven-page letter to the attorney general claiming that federal law enforcement officials were being improperly used to help McCain by suppressing the vote through “unsupported, spurious allegations of vote fraud.” He asked that the investigation be transferred to the special prosecutor investigating the U.S. attorney firing scandal. The McCain campaign issued a statement in which spokesman Ben Porritt called Bauer’s letter “outrageous” and “absurd” and a “heavy handed tactic of attempting to criminalize political discourse.” 

But so far ACORN itself has not been officially charged with any fraud. Aside from the heated charges and counter-charges, no evidence has yet surfaced to show that the ACORN employees who submitted fraudulent registration forms intended to pave the way for illegal voting…”

But here are two kickers, all of which impacted manufactured housing, but part of which continues to impact manufactured housing, most notably the community sector. 

Less than 18 months after FactCheck said ACORN was ok, the Week reported Scandal-plagued community group ACORN is formally disbanding. It will reportedly reorganise all of its local and state chapters as independent, non-affiliated organizations…”  

And one of those radical spin-off groups from ACORN is connected to MHAction!

Wikipedia notes that in 2009, Project Veritas used an undercover sting operation to help expose the corruption at ACORN. Here’s how Project Veritas described it. “The Power of Citizen Journalism. This Investigation didn’t just expose the corruption at ACORN. It also stunned the corporate media organizations by bringing to light the power of citizen journalism.”

We’ve shown Project Veritas videos before, and can to this point recommend them. They do the work real journalists ought to be doing.

The New York Times reported on October 10, “Mr. Davis said Mr. Obama had worked as Acorn’s lawyer and conducted training events for its leaders. He also noted a payment the Obama campaign made in February to an Acorn affiliate…”

PolitiFact came to a similar conclusion about the McCain ad against ACORN, and then Senator Obama’s role in ACORN, as did FactCheck.  

Who funds PolitiFact?

Per their own website, major donors include the Ford Foundation, which Kevin Clayton has spoken about. It also includes the Bill and Malinda Gates Foundation, which Warren Buffett has made big donations to, and both Gates and Buffett supported Senator Obama and Secretary Clinton for president.

That’s a tiny example of how ‘the game’ of politics and businesses are played in the U.S. This is why following the money, and following the history, are important.  

Don’t be revolted or turned off, vote against those behind the scenes donors who seek to manipulate voters.

Mr. Obama was and is charismatic. But his history is quite like how Dinesh D’Szousa’s video documentaries portrayed him. As president, what the Obama Administration did was harm the independent interests of manufactured housing communities, retailers, producers, independent lenders, and the majority of professionals. He doubled the federal debt in 8 years, after hypocritically condemning President Bush for his lavish spending.  

It may not be politically correct to some, but these are all demonstrable facts. Your ability to advance depends upon acting upon reality.  No one else in MHVille gives you this kind of background, evidence, checking of fact-checkers – all of which impact businesses like yours. 

 

Shifting gears again to Texas and MHVille

That’s a long lead-up to this short commentary. The number one state in manufactured housing for new HUD Code homes is Texas. Texans sell the most new manufactured homes. Texans build the most new HUD Code manufactured homes too.

So what happens in the Texas Senate race could be huge, as a recent Daily Business News on MHProNews report further below outlined.

The contest is between Democratic Party candidate Ted Cruz and Beto O’Rourke, who faced off in their first televised debate.  

 

We favored Donald J. Trump over Senator Ted Cruz (R-TX) in 2016. In this contest, MHProNews asks you to support Senator Cruz as better for our industry than Congressman O’Rourke (D-TX).

Senator Cruz has taken positions useful for manufactured housing, like the passage of tax cuts, and S. 2155, the “Economic Growth, Regulatory Relief, and Consumer Protection Act.” That’s the bill that rolled back some of Dodd-Frank, that former President Obama promoted and signed into law.

O’Rourke is slick. But his track record aligns with the Clintons and Mr. Obama. See the video. It’s a spirited debate. Watch how O’Rourke plays the game, because his appeal is emotional. He looks sharp, talks sharp.  This is a microcosm of other states too. Left-wing, big-donor money is pouring into O’Rourke’s campaign and allied super-PAC.

But O’Rourke’s policies would be bad for manufactured home owners, businesses, and investors. We suggest you see for yourself, and then get your colleagues to vote accordingly.  See the related reports, among the other stories for the week that was, all of which are found below.

Their promotion began about 2 weeks ago.  Third-party site statistics today indicate that articles on the topic have drawn more than 8,000 hits.  Based upon feedback from the field, part of the reason may be the opportunity to get new home inventory that’s priced right and is ready to go, when other producers are several months out to get a new order.

Capital, financing, regulatory and other internal or external hurdles have hampered the recovery of manufactured housing (MH) for some 15 (+/-) years.

 

Certainly, jobs and the general economy are also factors in selling more manufactured homes, as publicly traded companies in manufactured housing often tell their shareholders or potential investors.

Areas in America that lost factories have ripple economic consequences, said noted manufactured home industry finance, retail, and communities veteran, Marty Lavin, J.D.

Some places were as devastated by years of trade questionable U.S. trade policies as if they had been war zones, said Lavin, in his analysis linked below.

Free Trade or Economic War?

While there are plenty on Wall Street types that fret and disagree with the Trump Administration agenda, some are now seeing it as Lavin expressed exclusively to MHProNews weeks ago.

There are plenty of naysayers across the left-right political, economic, and media divide on the issue of trade.

I actually think he’s (Trump’s) right on the big picture on trade,” Eric Lonergan, macro fund manager at M&G, said.

Lonergan doesn’t necessarily agree with the administration’s rhetoric, but he is confident that the principles are sound, he told CNBC on Wednesday.

Lonergan added, Europe is free-riding global demand, running huge trade surpluses and nobody has really stood up credibly to that ideology until Trump.”

CNBC’s accompanying take is that “Trade relations between the U.S. and some of its biggest trading partners — Europe, China, Canada and Mexico — are at rock bottom several months after Trump first threatened to slap import tariffs on steel and aluminum imports after alleging trade abuses.”

As if to confirm Lavin’s and Lonergan’s thoughts, enter Arancha Gonzalez.  Gonzalez is the executive director of the International Trade Centre (ITC), and said that Europe and the Trump Administration could be closing the gap on trade talks.

The EU is saying two things. The first thing… is we will not negotiate under a threat, we will not negotiate with a gun to our head. But the second thing the EU is saying (is) that, alright, if there is a particular sector causing difficulties to the U.S. like vehicles, let’s sit down and discuss,” Gonzalez told CNBC’s Joumanna Bercetche on Wednesday.

In the video interview that follows, the president teases with a smile that the various nations in the trade feuds are calling routinely.  He confidently expects new, better trade deals for America.

If so, that would further fuel economic growth, which should benefit workers, and the MH industry’s continuing recovery.

Ben Shapiro Nails It on Taxes, Regulations, and Affordable Housing – Under 2 Minute Video Must View for MH Industry Pros

Ben Shapiro is a renowned conservative political pundit, syndicated columnist, lawyer, and NYT bestselling author. He is Editor-in-Chief of news and opinion site The Daily Wire and host of the popular video podcast, The Ben Shapiro Show,” says his YouTube page.

 

Fox News has called Shapiro “a leading millennial conservative.”

In the under-two minute video clip below, Shapiro joined Fox & Friends to discuss the new “head tax” in Seattle.  In it, he rapidly lays out the case that should have affordable housing advocates – including manufactured home professionals – on the edge of their seats, with note pad in hand.

Shapiro says that high demand, and over-regulations on developing are part of what’s fueling soaring housing costs.

A profile video on the fast-talking attorney is below.  Shapiro’s approximately 100 million page views a month Daily Wire is roughly 30 times more than what Webalizer says industry-leading MHProNews traffic is. He clearly must have something to say that people want to read and hear.

While the evidence-and-logic focused attorney doesn’t mention any specific kind of housing in the first video, common-sense suggests that the modern manufactured homes that HUD Secretary Ben Carson called “amazing” in recent Senate testimony are an important part of the solution to the affordable housing crisis.  You don’t have to be a brain surgeon to realize that almost everything we use comes from a production center.

The logic of factory-based home building is proven, and necessary.

Affordable housing is a non-partisan issue, as Danny Ghorbani – an engineer and the retired founding president of the Manufactured Housing Association for Regulatory Reform (MHARR) – has often said.

With this more business-friendly regulatory environment under the Trump Administration, the time is now to promote a better understanding of the factors that fuel economic growth.

Lower taxes, less and more common-sense regulations, are spurring the economy.

The Treasury took in a record amount of taxes last month, even though there’s been a big tax cut.  The formula that the Daily Business News has noted worked for Democratic President John F. Kennedy and Republican President Ronald Reagan, is also working for pragmatic President Donald J. Trump.

If the industry can cut through the D.C. noise, and get HUD and FHFA to enforce existing laws, the result will be a revival of manufactured housing (see related reports, below).  Thus private enterprise – in the form of routinely unsubsidized manufactured homes, as Secretary Carson said – can be an important part of the solution to the affordable housing crisis.

Note that “progressive” (read, Democratic) Jeff Bezos led Amazon, and equally progressive led Starbucks are among those hollering the loudest about the new Seattle head-tax.  Doesn’t Amazon’s threat to not build there make the point that higher taxes harm an economy?

Issues of taxation and regulation, as MHProNews has said for years, can be summed up like this.  The power to tax or regulate is the power to destroy. Manufactured home industry professionals, investors and advocates need to see the reality of that logic.  It is up to professionals to point to events both past and present that prove that to be so. Historic! Affordable Manufactured Housing, Local/ National Politics, Professionals, Investors and the Home-Buying Public

About a century ago, Sears sold pre-cut kit homes by catalog as one way to obtain that affordable American Dream of home ownership.

As Americans have long been a people ‘on the move,’ the original trailer houses started to pop up in the 1930s.

 

Those true trailer houses – that was their proper name – had to be ‘parked’ somewhere. Thus evolved the first ‘mobile home parks.’

 

Over time, trailers evolved into mobile homes. While most where built by companies that cared about quality, enough problems over issues such as thin and poorly insulated walls or fire safety, occurred that in 1974 – with the cooperation of many in the industry – a set of federal construction and safety standards took place.

Just as phones have evolved over the last roughly 100 years, so too has factory built homes evolved. Trailers led to mobile homes, which later became manufactured homes. Each was an important, evolutionary step. See the Walk Down Memory Land story linked here, or the two videos, above.

 Those standards were were by law regulated by the Department of Housing and Urban Development (HUD). Thus was born the HUD Code for Manufactured Housing.

 

The article above was published last year, so now it has been 41 years and counting since the first manufactured home was built. Since June 15,1976, the day the first HUD Code manufactured homes were built, there have been no more mobile homes built in the USA. That many of those pre-HUD Code mobile homes were better built than many thought is attested to by the fact that roughly 2 million of them still exist today. Thousands upon thousands of those older, true mobile homes have been updated.  They attract and keep people like the Chione family (see video interview below), who used to own conventional housing, who are now very happy in their more affordable, quality lifestyle.

 

That said, numbers of those older mobile homes that aren’t updated tend to have more fires than modern manufactured homes.

The older mobile homes that aren’t properly installed are also more windstorm prone.  So as news watchers note, those old mobile homes are often destroyed in tragic ways. 


As the graphic reflects, hundreds of thousands of mobile homes and manufactured were being sold every year.

Pre-HUD Code mobile home shipments peaked in the early 1970s at numbers well over 500,000 new housing units a year. As the video interview with the engineer below reflects, conventional housing adopted some production saving techniques from the mobile and manufactured housing industry, to keep their costs lower than they would otherwise be too.

 As engineer Skip VanZant says in the video interview below, factory built homes influenced conventional housing in some ways, just as site-builders also influence manufactured and modular home builders today.

 

 

A variety of conditions, including poorly underwritten and thousands of fraudulent loans were made in the 1990s. Manufactured housing had its version of the conventional mortgage/housing crisis about a decade before. But unlike the conventional housing lenders circa 2008 and its aftermath, manufactured home lenders that had loans that went sour a decade before got no federal bailouts.

Most of the personal property/home only/“chattel loan” lenders in manufactured housing left the space, never to return.

Even with higher interest rates on most chattel loans than conventional housing, which exists because there are no federal guarantees and other common-sense market forces, the cost AND PAYMENTS on most manufactured homes is LOWER than other forms of housing. But other lenders either never entered into the questionable practices that caused the meltdown, or they instituted safeguards that cleaned up bad practices.  There was no need for a manufactured housing version of Dodd-Frank post 1998-2003, because the loans were not taxpayer backed, and because the industry painfully cleaned up its own mess.

Mainstream Housing Compared to Manufactured Homes, by Informed Consumers

Informed consumers like Jerry and Karen McKibben are but one of many examples of well-to-do home owners who opted for the manufactured home lifestyle.  

 

The McKibbens did so after careful study of the facts about the manufactured homes of today, vs. the mobile homes of yesteryear.

More than one veteran finance pros of that era told MHProNews phrases said that conventional housing lenders did similarly to what caused the MH Industry’s 1998-2003 meltdown.  When “no doc,” ”liar loans” were made by the millions in the run-up to the 2008 mortgage/housing crisis, many of those customers may have been better suited to manufactured homes. But the conventional housing market made buying a new or existing site built house easy.

Not to be overlooked, was the buyout of Clayton Homes in 2003 by Warren Buffett’s Berkshire Hathaway. The subsequent buyout of Oakwood Homes by Buffett’s firm was later rolled into Clayton.

As this next chart reflects, the decline in shipments continued. The 2008 Conventional Housing Crisis, also impacted Manufactured Homes too. It was in mid-October 2009 that what we called today MHProNews was first published. The first mission was to get the industry to believe Itself again.

Meanwhile, federal support for the GSEs and the conventional housing market continued, but not without a price. The Dodd-Frank born Consumer Financial Protection Bureau (CFPB) took over the relevant parts of the SAFE Act.

Now recall that manufactured housing played no appreciable role in the multiple trillion dollar housing collapse. Manufactured home lenders played no role in that debacle. But the was punished, so to speak, along with the rest of the housing markets lenders.

 

As a result of a combination of factors, including regulator risk and relatively low volume of new manufactured home sales, several lenders who were profitable and prudent exited the market.  U.S. Bank is the best known.  Months before that event, MHProNews published an article entitled The High Cost of Low Volume Sales. It presaged in some ways the U.S. Bank and other industry exits.

That these are serious issues are demonstrated by facts from MHI’s members, such as Clayton Homes or MHVillage. Clayton Homes has had cumulatively had millions of views of its videos. Even though they are the largest factory builder today, and sell roughly half of the new homes shipped last year, why aren’t their sales far higher?

MHVillage understandably boasts of millions of visitors each year.  But their own statistics reveals that they are converting only a tiny fraction of those into buyers.

Clayton and Cavco are #1 and #2 in industry production today. 20 years ago, it was Fleetwood and Champion who were the top two producers. With all of their marketing dollars, Clayton (or even Cavco) are growing at a slower pace than the industry at large. Pretty pictures, great websites and Facebook likes have value. But if that alone were enough, wouldn’t those two largest MHI members be growing faster than say Sunshine Homes, or New Durham Estates are?

What MHLivingNews and our related client experiences have demonstrated is this. Serious home buyers who are well qualified or who want to pay cash want answers, not slick ads. Tom Fath and Stan Posey said it well.

Just answer this. What good reason did MHI, 2, 3 or 4 years ago have for not promoting their own member’s – MHLivingNews – MHProNews – best practices, pro-growth efforts?

Education, and information are keys.

That education and information is necessary for professionals as well as for the general public.

Before MHProNews began seriously spotlighting the weaknesses at MHI, the question has to be asked.  Why did MHI undermine, and/or fail to support our pro-growth, educational efforts? Even when those efforts would have benefited MHI and their members?

The bombshell this week revealed by interim Democratic National Committee (DNC) Chair Donna Brazile stated that the Clinton campaign colluded with the DNC to rig the nomination process in favor of Hillary Clinton.  When asked this week by CNN, Senator Elizabeth Warren (D-MA) said she absolutely believes that the nomination process was rigged.

 

For close observers of the electoral process, none of it was a surprise. Many of those items about the “rigged system” and others were noted by MHProNews in the run-up to the election.

What was the surprise is that such a high ranking Democrat as Donna Brazile came out and said the system was corrupted in print. As the Daily Business News summary this week reflected, Brazile also tossed President Barack Obama under the bus as a cause for the Democrats poor financial and other party woes.

Warren Buffett supported Clinton, early on and proudly.

How did that make sense, for the owner of the industry’s largest manufactured home lenders and producers?

Why did 21st President and CEO Tim Williams say to an MHI audience that the threat to the MH industry was coming from progressive thought? Yet, Chairman Buffett was supporting that same progressive ideological stance by supporting Hillary Clinton?

Wall Street and Warren Buffett wanted Dodd-Frank kept in place. Why?

Is it because heavy regulatory burdens drove so many smaller lenders out of business?

Why did progressives like the Seattle Times, or CFED (since rebranded as Prosperity Now) attack Buffett, Clayton and his lenders? Why do they do so still? Do they really not see eye to eye on this relatively modest changes to Dodd-Frank that the Preserving Access to Manufactured Housing Act seeks?

If that is so important to the future of the industry, why is Buffett’s Clayton buying up retail locations, suppliers and production?  Is it a conflict of interest for Clayton to dominate the Manufactured Housing Institute (MHI) and yet be buying up conventional home builders now?

Why has no one else in the industry noted that Buffett also has made a move in the real estate brokerage?

Housing will always be needed. Alan Amy isn’t alone or the first to suggest that the billionaires want to dominate manufactured housing.

Manufactured homes are the future of housing.  But there are caveats, which the Manufactured Housing Association for Regulatory Reform (MHARR), MHProNews and MHLivingNews have documented over the course of the years.

The race for control of Congress in 2018 and the next presidential cycle in 2020 began just after the end if the last election.

President Donald J Trump, and his Vice President Mike Pence, began and have stayed on message with their agenda, saying they will be in the promise keeping business.

While MHProNews was editorially supporting the Trump campaign, MHI has not yet denied that it had two pro-Clinton speakers on their stage last year in Chicago, just days before the 2016 election. There was no formal endorsement of Clinton, but MHI was also predicting that the Senate would go Democratic too.

Tim Williams was Chair at the time. When the Obama Administration had promised to veto Preserving Access if it passed, why was there no hint that the election of then candidate Trump and the GOP holding the Senate would be good for Preserving Access? Instead, what was said was that MHI would approach both parities and seek that bi-partisan effort that had already failed for 5 years.

 

If MHI was serious about getting Preserving Access passed, why didn’t they promote any of the articles or videos that MHLivingNews and MHProNews produced in support of those efforts?

Doesn’t Equity Lifestyle Properties (ELS) Sam Zell suggest the answer?

Didn’t failure to secure an independent lending base for the industry cost the industry big bucks?

Who’s failure was it, if not MHI’s? It wasn’t MHARR’s bill, it was MHI’s bill. Unofficially, MHARR sources have told MHProNews for years that if any member of staffer of Congress asked them, they always said they supported Preserving Access.

But MHARR felt that Duty to Serve was the better course. Isn’t Zell’s logic and MHARR’s alike?

The record reflects that this publication was supporting MHI’s Preserving Access efforts. We did so even when there was a steady stream of allegations and actions by MHI staffers, presumably with the consent of executive committee members, to undermine us, even as we were members and supported their efforts.

Next Friday, MHARR members meet by conference call. Among their decisions will be if they expand their membership to include the post-production, meaning lenders, financial services, communities, retailers, services, transporters and others that MHI now has as members.

The signals are mixed, and we aren’t going to predict if MHARR expands or not.

But isn’t there a need for an association that is going to faithfully represent the industry’s post-prosecutor without the kinds of apparent conflicts of interest that Buffett-dominated MHI has?

It is important to note that most of MHI’s members de facto have no say in the governing of the body. While there are several boards, only the four person MHI Executive Committee has the final say. 

The facts, concerns, allegations and opportunities the industry has are hiding in plain sight, are thus not? Good people have worked for years to support MHI’s efforts. What has over 15 million in spending over 5 years achieved?

 

The Trump Administration has signaled that it will take a look at anti-trust issues. Some say that hasn’t yet occurred for a variety of tactical and strategic reasons. If it does occur, will that in time look into the anti-trust, racial, and other concerns about Buffett/Clayton and their lenders raised by Democrats like those shown?

MHI and Berkshire Hathaway units like Clayton, VMF and 21st have routinely been given the opportunity to respond to such issues. In Deadwood, MHI Sr VP and General Counsel! Rick Robinson said, “Tony, I won’t be taking any questions from the press” in front of dozens of people.

Robinson is a good speaker, good writer and likeable person, says MHProNews publisher, L. A. “Tony” Kovach. The questions that they duck and dodge will only continue until they are properly addressed in a transparent way, he opines.

Why has MHI taken so many logically flawed positions, such as de facto supporting Pam Danner, when the Trump Administration would make it easy to replace her?

 

If there is a problem with the facts as laid out, MHI, Berkshire Hathaway or their surrogates are hereby invited again to respond. Why have they routinely ducked, dodged, detracted, distracted, and defamed instead? 

It’s your industry. Will you wait for a monopolistic operation to gobble you up for pennies on the dollar some day? Perhaps to wake up on day 5 years or so from now, and see that Manufactured Housing is doing tens of billions more a year in business? Only to see that your business was worth more than you obtained?
