Turn the Page, Manufactured Housing Making History

December 30th, 2018 Comments off

TurnThePageManufacturedHousingMakingHistoryMHProNewsLogo

There are words, and then there are deeds.

There’s smoke and mirrors, or the clarity born of facts, evidence, and sound reason.

It’s about time to turn the page. 2018 is about to come to a close. It will be several weeks before the industry at large knows the final tallies for HUD Code manufactured housing shipments for the year. But rest assured, about a dozen (+/-) MHPros already know pretty close to what the final count for 2018 will be.

You’ll get an idea too from one of the articles in a headline linked below.

Why did the Manufactured Housing Institute (MHI) invest a purported 5 figures in a video to promote how great they are? Is it because annual dues/membership renewal time was coming up? Did the Arlington, VA based MHI want to get into the pockets of independents in manufactured housing once again? Did MHI leaders want to collect more money from independents before the disappointing totals for 2018 would be revealed?

There are many ways to point to the tragic truth that:

  • thousands of manufactured housing (MH) independents,
  • numbers of investors, and
  • millions of consumers have debatably been conned, manipulated, and cheated out of greater wealth.

We never say things like that lightly. Keep in mind, we have done our share of ‘cheer leading’ on MHProNews and on MHLivingNews for the industry too. Cheer leading is easy.  Cheer leading, when it is honest, is fun.  Telling several thousand industry pros that they’ve been ripped off?  Not nearly as much fun.  Don’t blame the messenger for the #Nettlesome message, we’re just following the evidence, tips from sources, track record, and common sense.

There came a point in time when questions, evidence, and logic opened-our-eyes as to the obvious reasons why the industry has failed to progress. Why did RVs roar past MH?  Why is mainstream housing so high, when the value of manufactured and modular homes should mean that our MH industry should be performing at much higher levels too?

When affordable housing is in crisis, and MHVille will finish about 100,000 (+/-) shipments, how is it possible that voices from Arlington keep belting out that same old tired song?

There comes a point in time when the accumulation of voices that kept telling MHProNews, ‘something is wrong here’ begs for attention. We’re returning the favor that those voices gave to us.

There comes a time to turn the page.

But a way simple way to prove the truth about MHI is to invite the leadership of the Omaha-Knoxville-Arlington axis to do the right thing.  No excuses.  Just do one thing right, one time, on one specific issue.

Turn the page and learn more.

The Disney “Trailer” Controversy & MHI ‘Leadership’

Bragging is easy for some. But it’s performance that counts.

When MHI’s former chairman Tim Williams, who is also the president of Berkshire Hathaway owned 21st Mortgage Corp, says there’s a good case to be made that every problematic report, misuse of terminology, etc. should be challenged, it was a revealing statement.

We believe that Tim Williams was right on that point.

Why did Clayton, Warren Buffett or Berkshire Vice-Chair Charlie Munger respond to attacks on Clayton, 21st, or Vanderbilt Mortgage and Finance (VMF)? It can be oversimplified and summed up n two words.

Reputation Defense.

If Reputation Defense is good enough for Clayton, 21st, and VMF – then why isn’t a fact-based reputation defense of the entire MH industry every bit as important to MHI, or the Berkshire brands that dominate MHVille? Why has MHI already weighed in with Disney, to defend the industry’s reputation?

MHI and their masters will either weigh in on the Disney controversy – see the articles linked below – or not. It’s really that simple.

Our publisher, L. A. ‘Tony’ Kovach, has reached out to numbers of those MHI leaders on Friday. He did so bcc’ing numbers of MHI and non-MHI members. He also sent a message to an attorney who claims to represent MHI.

No excuses.  The truth will come out, period.

Either MHI and their Omaha-Knoxville and allied masters will act to defend the reputation of manufactured housing – as has:

–   Mark Weiss, JD, President of the Manufactured Housing Association for Regulatory Reform (MHARR)

–   Al Kemp, Executive Director of the Manufactured Home Park Owners (BC, Canada), and

Paul Bradley, President of ROC USA already have.

Or MHI won’t. Simple. Clear.  No excuses.

See what those 3 industry leaders had to say in one of the linked articles on Disney further below.

MHI-Inspired “Boycott”?

It spoke volumes that MHI purportedly had their part-time surrogate, George Allen, call for a “boycott” of MHProNews within hours of our article and most recent headline news update being published and emailed.

Antitrust Girard Gibbs law firm says this, “A group boycott occurs when two or more competitors in a relevant market refuse to conduct business with a specific individual or company. Individual companies may always unilaterally decide to stop doing business with another company, but agreements between competitors may violate antitrust laws.”

So, there is a legal expert’s view that an organized boycott can be an antitrust violation. That means that those who were behind the called for boycott, have placed themselves in the legal cross hairs.

Those who participate, ditto.

The hypocritical irony of the call for a boycott is that GF Allen has – when he was on the outs with MHI – called MHI and their masters, Oligarchs. Allen has said in his own words that the industry was being monopolized. But sadly, the retired Marine Allen has a purported reputation for saying and doing what he thinks will give him more money, leverage, and/or attention. Rest assured, if a group of independents offered Allen a pile of cash, based on his history, he’d arguably turn on MHI again in a New York minute. His own reputation after the SECO-connected legal fiasco speaks sufficiently of his credibility. Keep in mind that just because SECO isn’t in the headlines, that doesn’t mean that the investigation and case prep aren’t ongoing.

George can say whatever stuff he wishes to say or write – within the norms of the law, ethics, etc. – but facts still matter. If Allen had proven a single claims, that might have been interesting. But instead, bomb throwing without a shred of evidence, and a call for a “boycott.”  That’s called a red herring. It’s also arguably opened Allen – and those with him – up for legal investigation, and potential action.

It would also be the reasons why industry pros should say, ‘what are the folks in Arlington and Knoxville trying to keep us from reading?’

Short of successful criminal and civil actions against the Omaha-Knoxville-Arlington axis, the next greatest thing they fear is arguably exposure.  Once the mask is completely off, then their MHI connected ‘alleged’ con game is over.

DeceptiveTradePracticesManufacturedHousingInstituteDailyBusinessNewsMHproNews

As with any con, the faces smile while pockets are being picked. Is your firm one of those pockets being picked?

After all, if those in MHVille who see MHI in a protection racket/con game fashion are correct, then the little guys are paying to have the big guys destroy the little guys own interests.

Or as Marty Lavin, an MHI award winner put it in his words, MHI only works for the little guys when that happens to match the interests of the big guys.

Within an hour of being asked, Al Kemp – who was on vacation in Hawaii when his office had contacted him – within an hour, Al had written Disney a fine message.  It was a good compliment to those from Mark Weiss and Paul Bradley. Al thought it that important.

If Al Kemp, Mark Weiss and Paul Bradley did, how about MHI?

What excuse will MHI give? Does it matter? Or if they now act only because they were pushed into it, what glory is there in that?

Do you see why our publisher has at times used satire? Don’t the tragic jokes practically write themselves?

And if MHI or the Berkshire brands do – out of shame or embarrassment – finally weigh in with Disney on their terminology issue – and they should! – then here’s the next question.  Why haven’t they done a real reputation defense of the entire MH Industry for the last few years on all similar issues?

It’s debatably time to turn the page on the failed systems and problematic leaders of recent years.

In the articles and reports that follow, several themes will come to light.

1)    There are huge opportunities in factory-built housing.

2)    Manufactured homes are underperforming.  That’s opportunity in disguise, for those who know what to do.

3)    That logically means that MHI, their allies and surrogates, have ignored reputation defense.  Doesn’t that disproportionately hurt the little guys more than the big ones?

Our sources in Washington and other cities were investigations of the Omaha-Knoxville-Arlington axis are underway tell us that these things take time. You and thousands will need to be patient, just as we are.

But there will likely come a day when you’ll wake up to a headline that’s not found first on MHProNews, but rather will be in national media. Those imagined headlines could read like this:

  • Antitrust charges filed against major firms, and trade group, details at 10.”
  • “RICO-related arrests occurred at national trade association headquarters, details at 10.”

The mantra of a con artist is ‘never, ever give up the con.’ They – whomever are in that loop – won’t likely confess, unless it is part of a plea deal with federal/state investigators. They arguably won’t admit they’re deceiving the MH industry they claim to be protecting.

The powers that be certainly won’t want to face millions of manufactured home owners – who because DTS isn’t being properly implemented by MHI, Fannie and Freddie – are arguably be cheated of lower payments, and higher resale values.

Turn the page.

2018 is almost done. 2019 is almost upon us.

Thousands of more pros are logging on daily than at this time a year ago.  Why?  Because at a minimum, they – like you – are learning to be more skeptical of the ludicrous claims made by MHI and their puppet masters.

Anyone who can produce graphics like the above, and can still smile, ask for their year-end bonuses, and do so while they tell you that 100,000 (+/-) new HUD Code manufactured homes are sold in 2018 are selling and/or smoking something.

Buying or smoking what they offer is arguably bad for your health.

RuleNumber1NeverGiveUpTheConGodfatherDailyBusinessNewsMhproNews

Liars can lie with a straight face. Con artists can’t give up the con, because if they do, what’s left for them? Either MHI knows what they say they are doing – in which case shipments should be rising significantly, right? Or MHI and their Knoxville-Omaha masters don’t know what to do, in which case their failure to move the needle makes sense, but in that case, they shouldn’t claim to be leaders, right? Or, MHI knows what to do, and do what doesn’t work, which benefits a few that want to consolidate the industry into their hands at a discount – are there other logical alternatives? If so, please, explain it in writing, because MHI can’t or won’t.

Escaping the Grave? Affordable, Manufactured Housing News

December 23rd, 2018 Comments off

EscpaingTheGraveAffordableManufacturedHousingNewsMHProNews

A rut has been defined as an open-ended grave.

Habits can be useful, and good habits are necessary in one’s personal and professional life.

But problematic habits are a rut.  They may be comfortable, at least until the walls of the rut finally weaken and collapse.

If a collapsed wall of a rut is deep enough, if not escaped in time, that open-ended rut can become a grave.

The Challenge of Contemporary MH News…

CaseyMackLegacyHousingManufacturedTinyHomesKudosMHProNewsThe challenge of a pro-industry, pro-consumer trade journalist in manufactured housing today can be summed up like this. In an obviously underperforming industry, one must both challenge the status quo, while not alienating the core audience.

Furthermore, in case an insufficient number of the core audience fails to awaken from the sleep-walk of a potentially deadly rut, one must attract a new professional- and investor-audience that ‘gets it.’ Experience has shown that newcomers have at times rapidly lapped sleepwalkers, who by definition, are not performing to their potential.

That’s transparency.

Our site statistics, other third-party insights, and other metrics tell us we are successful in a variety of ways at threading those needles.

For example, the Manufactured Housing Institute (MHI) – which claims to professionally represent all aspects of factory-built housing – says there are some 40,000 people working in the manufactured home industry.  That seems like a low figure, for common sense reasons. The graphic below explains one of many reasons we think that MHI is ‘wrong again’ on claimed ‘facts.’

ClaytonHomes2017AnnualReportManufacturedHousingIndustryDailyBusinessNewsMHProNews

So, with it understood that some 40,000 (+/-) are working full-time in our industry, and knowing that every day north of 11,000 unique visitors are logging onto MHProNews, and they read an average of about 4½ articles each, that tells you just how powerful our market penetration is.

No data set is perfect.  But the vast majority of those professional readers here – third-party data, messages, calls, and common-sense all suggests – aren’t lawn mowers and line workers – whose work we respect, because those workers are essential to our industry. Rather, our trade media site of professional readers are the managers, owners, executives, investors, policy-makers, advocates, and other pro-doers.

IfMHProNewsIswritingAboutItIWantToKnowAboutItAgain, the biggest names – plus the mom and pops – and all in between are among most faithful readers of our proprietary e-list.

  • When facts are twisted by the powerful,
  • when pros get spin instead of the truth, or
  • professionals are squelched and told how to think or behave,
  • human nature often rejects those trying to push them around.

That push-back may not be an open rejection.  But people find ways to respond – such as by reaching out to MHProNews with the news tips that some of those ‘big boys’ hate to read.

We have a variety of ways – often, from insights directly from within companies and organizations – of knowing in a broad fashion who are logging on.  We aren’t Google or Facebook, so we don’t ‘see you’ on this site, but our email database and other insights suggest the following:

  • YouMHProNewsSeemToHaveConceptualIQThatIsMoreImportantThanSpellingAbilityAbout 97% of MHProNews readers are U.S. based.
  • About half of the remaining 3 percent are from Canada, the rest are often from ‘investor’ nations that have people with deep pockets, researching opportunities in factory-built housing.
  • While we have corporate plus independents of all sizes and types – retailers, communities, producers, etc., etc. – the very biggest names in our industry are among our most dedicated readers, per third-party reports.
  • Our open rate on our emails, and our click through rates dwarf others in media and publishing. All of this is from third-party information.
  • Our readership – which was already #1 in our industry – skyrocketed since we went to a more fact-check oriented format, about 16 months ago.  To be more specific, readership more than doubled in that timeframe.

It’s not because we are wacky ‘conspiracy theorists’ or mere ‘bomb throwers,’ as the blindly MHI favoring types want to project.  MHProNews carefully lay out the facts, show the money-trails, document public sources, and lay out the reasoning. It’s what the president of a well-known organization called our “street cred” that keeps him and thousands of others coming back.

The words of the late Howard Walker, ELS Vice Chairman, shared for publication with MHProNews.

What’s Coming in 2019

Looking ahead, MHProNews plans to roll out in the first quarter of 2019 the latest version of our already industry-leading MHProNews site.

As 2018 winds down, it is possible that manufactured housing will close again with perhaps a modest gain over 2017. That’s an embarrassment to anyone who truly understands our industry. Yet the true story of Rollohome reminds us that one could create in 2 years a company that could dwarf the industry’s current number 2 producer. In five years, Clayton, 21st, and VMF could be in the rear-view mirror.

In fact, among the tips – from multiple sources – is that increasing unrest is found at Clayton Homes among their team members.  It is obvious that MHI has fairly routine turnover and has suffered along with that problem for years.

Leadership isn’t about self-congratulatory posturing, like what we satirically call the Monopolistic Housing Institute – and their string pullers – have been doing. Leadership is about taking the bull of reality by the horns and working treacherous bullhorns around toward victory.

MonopolisticHousingInstitutelogoManufacturedHousingInstituteMHiLogoFairUseMHProNews306

JiuJitsu is what our industry has needed for some time.  Our sources, supporters, clients, and sponsors understand that reality.

We provide daily reality checks found nowhere else in the avoidably modest-today industry we affectionately call MHVille. But we won’t rest until MHVille honorably emerges to becomes MHLand, and then MHNation.

That’s the Manufactured Housing Revolution.

A few will of course check out, unable to deal with reality.  But far, far more MH pros and investors are checking in than the trickle that check out or knock us. A common comment from investors, researching our industry is this.  With the manufactured housing product such a good value, and given the affordable housing crisis, how can it be performing so poorly?’

TheyTheBigBoysThinkTheyOwnUsIndependnetsWhile a tiny few can’t handle the truth, over 11,000 daily per third-party metrics find what we publish relevant. In a modest sized industry, those totals are why we dwarf all the other trade publications in our industry, combined.

Perhaps the best compliment of all is that those who wish we and our fact-checks would vanish are among our most avid readers. Thanks.

In fairness to other who publish or blog in MHVille, there’s one other publisher in factory-built housing who could be said that he’s also trying to thread-the-needle that we do. But they don’t do fact checks, and all of the others are arguably different degrees of sellouts. Just look at who backs what, and that speaks volumes.

There’s one trade association – the Manufactured Housing Association for Regulatory Reform  or MHARR – that has been facts-, evidence- and reality-based for years. They are an independent producers organization, but have correctly called for a new-post-production trade body, because MHI has for too-long failed the majority of the industry.

MHARR Releases Study Recommending Independent Collective Representation for Post-Production Sector

There’s the larger trade body that so lacks transparency that they prefer half-truths and arguably deceptive spin to the public debate they refuse to have with us and others who are seeking to expose their purported con game.  We are publicly calling BS on many of their claims. They can’t even correct obviously flawed data, why not? Don’t they care about their own image and reputation?  The bottom line of their failures is evidenced by the shipments. The rest of MHI’s efforts are arguably smoke and mirrors.

TonyYouGuysAreTooSmartToBeInThisIndustryAn attorney claiming to be working for MHI, and interestingly across-the-river from Nathan and Mary Smith, has sent via FedEx a letter to our publisher.  Whining and crying, threats, etc. – instead of openly debating the issues.  If they could debunk our concerns, why do they dodge doing so? As we said some days ago, you aren’t drawing flak unless you are over the target.

Read the headlines, and you’ll know what kind of articles the claimed MHI attorney is whining about.

A non-MHARR member wrote earlier today to say, “…keep giving them hell.” That source is one of several that says there are growing reports of rumblings from within the ranks of Clayton and their Monopolistic Housing Institute puppets.

Our news tip sources make that point clear.

Our sincere thanks to all who make that the truth.

ItsATerribleIdeaHavingCommunitiesOtherDivisionInWithClaytonBerkshireLendersTo escape a rut, one must first realize the rut that you or others are in.  While we all will die at some point, let’s not die without giving this life our very best shot.

In an affordable housing crisis, when the National Association of Realtors says 8.3 million housing units are needed, MHVille is underperforming.  When MHVille has enhanced preemption that modular producers don’t, HUD Code manufactured housing is the obvious solution for many projects and needs. So the low production levels oddly have benefited just a handful that keep consolidating the industry at discounted prices, to the detriment of the many.

With no further adieu, dive into the headlines from the week of 12.16.2018 to 12.23.2018 that keeps readers coming back for more.  Merry Christmas to all.

Whistleblower! Ex-Clayton Homes Team Member on TV Denounces Manufactured Housing Giant’s Practices

December 5th, 2018 Comments off

WhistlblowerExClaytonHomesTeamMemberOnTVDenouncesManufacturedHousingGiantsPracticesDailyBusinessNewsMHproNews

Foreword: a Manufactured Housing Institute (MHI) member messaged our publisher, “You seem to have conceptual IQ [and] that is more important than spelling ability.”

That there are divisions in manufactured housing ought to be self-evident. That’s true for any industry or large group. But among the many questions that ought to be asked, are those divisions in manufactured housing (MH) bad?

Are some distinctions within the MH Industry useful — or even good?

Within companies there are different points of view too.  The larger the organization, the more points of view will exist.

It goes without saying that Clayton denies recurring allegations that have surfaced in 2018, that have been visible for some years in mainstream media. Before we get into the Clayton whistleblower mainstream TV news video, this topic is serious enough where it merits a giant step back for perspective.

MH Divisions

It goes without saying that neither MHI, nor the Manufactured Housing Association for Regulatory Reform (MHARR), are entirely monolithic organizations. Because there are some dual members of both national trade groups, there have at times been some in MHVille that mistakenly believe that the two are one in the same.

Hardly. A close look at the track records of the two trade groups make it abundantly clear that there are real differences in style, goals, and more.

There are those in manufactured housing who believe there should only be one national trade group.  To that point – we ask, if that is logical – then why are there so many trade groups in:

  • Mainstream housing: National Association of Home Builders (NAHB), National Association of Realtors (NAR), Mortgage Bankers Association (MBA), and on down the list or remodeling, finance, and more.
  • Automotive – According to Wikipedia, there are some 29 pages of associations in the automotive field. Just starting with A: Auto Care Association. Alliance of Automobile Manufacturers. American Automobile Association. American Highway Users Alliance. American Hot Hod Association. American Motor League. Association of Global Automakers.
  • How about RVs? There are producers, dealers, owners, suppliers, and a plethora of trade groups that represent the varied interests of Recreation Vehicles (RVs). FYI – for those who aren’t into RVing, an RV is not just a motorized vehicle, towable RVs are a huge part of the RV business. Some of those towable RVs are de facto a competitor to manufactured housing.  FEMA orders for RVs vs. MH are but one example.

So, if there are so many trade associations in other industries, why are there so few manufactured housing national trade groups?

That is arguably a problem for the manufactured housing industry.  There are inherent conflicts of interest in having manufactured home (MH):

  • Communities
  • Producers
  • Suppliers
  • Lenders and Financial Services
  • Retailers
  • Transporting and Installation
  • Professional Services and more

all in one trade association.

The proof is found in the results vs. the claims of MHI.  For all the bluster and what one ex-MHI member called their ‘Razzle Dazzle’ at appealing getaway spots, the declining sales of HUD Code manufactured housing for two straight months is all the evidence needed that MHI is at its core ineffective at best.  The report hot-linked via the box below can be read later for greater depth of understanding of this issue.

“Pants on Fire” – Latest New Manufactured Housing Shipment Report

As fabled author Adam Smith said in the Wealth of Nations,People of the same trade seldom meet together, even for merriment and diversion, but the conversation ends in a conspiracy against the public, or in some contrivance to raise prices.” Merely readingantitrust guidelines at an MHI meeting doesn’t automatically mean that monopolistic activity isn’t at play. When a high-profile congressional representative (see further below) and others in Congress raised that very concern about monopoly, why haven’t others in manufactured housing trade media done the same, save MHProNews?

The Elephant in the Room

It was almost funny when some years ago when a now-former MHI leader said at one of their meetings that the ‘elephant in the room’ was Danny Ghorbani and MHARR. That’s a tip of the hat to the outsized-shadow they’ve cast, but the obvious actual elephant in the room is Clayton Homes, and the array of Berkshire Hathaway brands working in manufactured housing.

There is one kind of value to having Berkshire in manufactured housing, but it arguably already existed with Sam Zell of Equity LifeStyle Properties (ELS) fame and is limited to this next point.

Warren Buffett has given his seal of approval on the common sense value of manufactured housing.

But beyond that, there has been years of “consolidation” of manufactured housing production, retail, lending, supply, and more in our industry ever since Buffett-led Berkshire Hathaway entered our industry.

Our HUD Code manufactured home industry’s sales have overall declined – not rose – since Clayton and Oakwood were acquired by Berkshire.

ManufacturedHousingSHipmentsBloombergQuintFactoryBuiltRebuidRecoveryDailyBusinessNEwsMHproNEws

See related report, linked here.

There are a variety of reasons why the Washington, D.C. based Manufactured Housing Association for Regulatory Reform (MHARR) has argued that there must be one or more new post-production trade groups. We’ll refer readers to MHARR’s report, when they declined expanding to compete with MHI, because they believe that the industry should be more like housing, automotive or other industries with a myriad of representative bodies.  That is a natural way of blocking conflicts of interest that are arguably evident at MHI.

MHARR Releases Study Recommending Independent Collective Representation for Post-Production Sector

It should be noted that the Manufactured Housing Improvement Act of 2000 (MHIA) was achieved when MHARR, MHI and state association came together on areas of mutual interest.  But that is different than unity under one umbrella, which has demonstrably resulted in far lower shipment levels than existed in the late 1990s.

Kevin Clayton has been in the mainstream news several times in recent weeks, since the MHProNews exclusive in the hot-linked box below was published.

GIGO, Esther Sullivan, Clayton Homes, Boston Globe, GSMOL on ‘Manufactured Insecurity-Mobile Home Parks and Americans’ Tenuous Right to Place’

But the reality is that what could have been done in 2011 to promote the industry and growth – according to Kevin’s own statement in a friendly video interview – has been allowed to drag on until 2018.  For whatever reasons, there is no denying that what MHI and Clayton have done in the last two years has had no appreciable change in the modest growth the industry has had, especially when compared to the strong growth of the RV industry.

ManufacturedHomeMHShipments1990-2017DailybusinessNewsManufacturedHousingMHProNews600

RVsshipmentsTrailedMH1998WinnebagoDailyBusinessNewsMHProNews

So while

  • MHI’s Lesli Gooch has defended Clayton/Berkshire against charges of monopolizing the industry in a response to Doug Ryan at Prosperity Now, or
  • Clayton Homes has denied to local, regional, and national media the varied allegations against them,

there is also no denying that the claims keep popping up. In fact, when MHProNews offers MHI or Knoxville’s brands the opportunity to respond to reports like this, they’ve passed.  Why, if they had a good defense, would they miss out on the opportunity?

It is arguably absurd that the elected leadership of MHI’s current and prior 2 chairman have had serious negative media coverage, and yet have been allowed to continue as chair.  What image does that give the outside world about manufactured housing, or MHI?

ManufacturedHousingInstituteMHIBoardofDirectors1242018DailyBusinessNewsMHProNews

It is also absurd that that all three of the current and prior chairs have clear and deep ties to Berkshire Hathaway.  The real elephant in the room is Clayton and the Berkshire brands. If they want to claim leadership of the industry – and MHI and Clayton repeatedly do so – then the results of the industry logically fall at their feet.

LouisianaManufacturedHousingAssociationOklahomaMHAOManufacturedHomeDailyBusinessNewsMHproNews

Louisiana is one of the top ten states for manufactured home shipments in recent years, per data collected by HUD and reported by MHARR. Clayton Homes has a serious presence in the state. Yet, sales are declining. Why???

And those results have been towards ever more consolidation of the industry in the hands of a few, including Clayton Homes and their sister companies involved in manufactured housing.

ClaytonHomesOakwoodHomesBerkshireHathawayMarketShareofManufacturedHousingEndof2003DailyBuisnessNewsMHanufacturedHousingIndustryProNews

One more point must be made. When the allegations of racism and other claims of financing malfeasance were lodged against Clayton and their related lenders – 21st Mortgage and Vanderbilt Mortgage and Finance – first surfaced, MHProNews and MHLivingNews leapt to their defense. Why?  Because we knew of no such examples, and asking some industry pros, they said similarly.

Lies, Advocacy Journalism and Statistics – Seattle Times/BuzzFeed Attacks, Warren Buffett’s Clayton Homes Defends – charges of Racism and Discrimination – Critical Analysis

But as the claims have continued, and other facts emerged, we looked deeper.  Our understanding of the issues has matured, in part with input from others in manufactured housing.  Unlike MHI or Clayton, which rarely wants to admit in public an error, our publisher has said ‘mea culpa’ several times, as we have pivoted to our clarified understanding.

ClaytonHomesSkylineChampionCavcoIndustriesMarketShareManufacturedHousingIndustryConsolidationGraphicPieChartMHProNews-e1528746976415

With that tee up, we now show the video from the Clayton headquarters – the Knoxville metro’s own TV news media – is shown below.

Former Clayton Team Member Blows the Whistle on TV on Clayton Homes Business Practices

With that backdrop is this ongoing controversy about Clayton Homes and concerns over racism and unjust lending practices.

Maxine Waters is among those who signed the letter that this local Knoxville TV news media report reflects.

ClaytonHomesSubsidiariesDiscriminateLowModerateIncomeMinorityBuyersHighCostLoansLeaveMaxineWatersCA-DClaytonlogo21stMortgageLogoVanderbiltMortgageLogo

One of several reasons to provide this to 2018 Knoxville TV news report to industry members at this time is that Waters will likely become the next chairperson for the important House Financial Services Committee.

CongressAsksDOJInvestigateClaytonHomesCreditTwitterWikipediaMHProNews

U.S. Representatives Maxine Waters (D-CA), Keith Ellison (D-MN), Emanuel Cleaver (D-MO), Mike Capuano (D-MA). Image credit, Twitter, Wikipedia.

Waters has called Clayton and Berkshire ‘near monopolies.’ That charge may take on new meaning in 2019. The Democrats have an anti-monopoly plank in their revised platform.

As the Daily Business News on MHProNews has previously documented, there are voices across the left-right divide that are seeing the challenges to small and independent businesses from monopolies.

Monopolies and growing consolidation over time causes ripples in costs to consumers, and for employment opportunities and thus wages too.

Some will act out of habit and ‘stroke the check’ to renew their MHI membership.

Others will feel compelled for reasons that sources say are akin to RICO related concerns.

For those who don’t want to be part of feeding the hand that bites them, this is a good time to step back and decide to cancel membership in Berkshire dominated MHI, and explore other options.

To learn more, see the related reports, and click on the hot-linked boxes further below.

Finally, it should be noted that Berkshire vice-chairman, and longtime Warren Buffet partner, Charlie Munger has said on camera that he doesn’t doubt that some wrongdoing has occurred.

While denying the thrust of the anti-Clayton claims, Warren Buffett has said similarly to what Munger has said.

It’s a complex puzzle.  But MHProNews is committed to providing the facts that unravel the fog in a way that no others in MH trade media will give you.  That way, you can make more informed decisions to operate your business.

What follows are a series of screen captures of news headlines from across the country.

These screen captures are from this morning, 10.22.2018, at the times shown.

GooglesearchNewsHeadlines10222018ManufacturedHousingIndustryDailyBusinessNewsMHproNewsPage1Top5Hits

There are two communities that sold for a total of $165 million dollars. That’s one of the headlines that professionals – notably those in or tied to the communities sector – are keenly interested in reading about.

 NewYorkAttorneyGeneralSettlesCaseSunCommunitiesManufacturedHousingDailyBuisnessNewsMHProNews600

Next, the State of New York’s Attorney General settled a case a big case with Sun Communities and others in the manufactured home community (MHC) business.  The litigation involved rent-to-own or lease-purchase options. Keep in mind prior news we’ve covered on the Daily Business News on MHProNews that related to that hot topic, starting at this link here.

Consumers/MH Shoppers

Now, imagine yourself as a typical American.  Picture that you are not in the manufactured home industry.  You know only what you read, see, or hear from the mainstream news media.

This imaginary person is seeking affordable housing.  You are more likely to be thinking the words ‘mobile home’ instead of ‘manufactured home,’ right?  After all, that is what Foremost told us in their survey, linked here.

 Page1GooglesearchMobileHomes10222018-600

Page1bGooglesearchMobileHomeNews10222018-600

What if you are one of the claimed 25 million unique visitors that MHVillage says visits their website each year?  Please, keep scanning, and keep that mind open for what follows.

Page2GooglesearchMobileHomesNews10222018-600

Page2bGooglesearchMobileHomesNews10222018600

This Google search is a common result. Page after page of what appears to be mostly bad news.

Objectively speaking, isn’t this what millions of Americans think about ‘mobile homes’ or more properly, manufactured homes – right?  Millions wonder, what is the cost for them to get a lower price?  Millions think no further than the headlines like those, shown above.

2018-06-22_0521ConversionRatiosPerMHVillageLogoManufacturedHousingIndustryDailyBusinessNewsMHProNews600

Data per MHVillage, collage by MHProNews.  This is not a slam on MHVillage, rather it is a reality check that neither they, nor anyone else in MH trade media tackles with the serious view required to solve the problem of an ongoing drum beat of negative news.  This list of news articles above is unedited, as it appeared this morning. Solutions will be explored in an upcoming report.

It is headline news like the above that is part of the reason why MHVillage – or for that matter, most every manufactured housing operation in the nation – has such a low percentage of closings vs visitors to their websites or business locations.

That sadly low closing ratio are common, even among the giants.

This is under 400 words. It’s the first part of today’s manufactured housing professional wake-up call.  More to follow, as we lay out not only the challenges, but also solutions.   ## (News, analysis, and commentary.)

There are others, of course, that see the Clayton brand as friendly or benign. But even they don’t want to cross them…do they?

The ‘800-pound gorilla’ in the manufactured housing room is Clayton Homes. Not many in the industry are willing to publicly name them, unless it is to praise them. A trade media competitor admitted in writing to MHProNews that we write about the topics – like Clayton and their monopolistic moat – that others talk about at the bar, or during a private professional meal.

That aside, here’s a multiple layered surprise.

Clayton has closed about 100 retail stores net in about 7 years. That’s a surprise to many.  But it is part of one of several Daily Business News stories from this past week.

Keep in mind, that Clayton is still buying MH retailers, even as they are closing their own failing retail sales centers. Think about that data-point for a few moments. The industry is slowly growing, and Clayton Homes are closing manufactured and modular home retail stores?

We plan a special report on that topic in the days ahead. But keep that factoid in mind – given to us courtesy of Kevin Clayton, and Berkshire Hathaway – because it is a reminder that they are big, but not invincible. They may have a moat, but not everything that Clayton touches turns to gold.

Mobile Home Explosion in a Manufactured Home Community Caught on Camera

March 20th, 2018 Comments off

MobileHomeExplosionInManufacturedHomeCommunityCaughtOnCameraDailyBusienssNewsMHProNews

An explosion at what appeared to be a pre-HUD Code mobile home located in a manufactured home community was caught on a police dash camera.

The explosion occurred at the Cypress Mobile Home Park, in Cypress CA, near Los Angeles.

Police not only caught the incident on camera, but first responders also save an occupant of that home.

It was very dark smoke coming out of every window at this point,” said Officer Melissa Grove from the Cypress Police Department, per KABC.  Three different versions of the video are posted below.

Neighbors said one man had already been burned, while another was alongside the home attempting to douse the flames. With the fire burning out of control – heroically – officers went in to get him out.

We pulled him. He was hanging on to something very tightly, and that broke, and we got him out right before it blasts,” Grove said.

It was really shocking, especially when you’re not expecting it,” said Officer Ed Pastor from the Cypress Police Department.

Orange County firefighters said it was oxygen tanks inside the dwelling that caused the explosion. Firefighters were able to douse the flames before they spread to any other neighboring homes.

The Take Aways

Industry professionals have numerous possible lessons to learn from this story.

  • The local media’s report appears to be accurate in saying that the residence involved was a true ‘mobile home,’ meaning a unit built before the HUD Code for manufactured housing went into effect.
  • The neighboring homes appear to have been manufactured homes, as dash cam video seems to indicate.
  • As MHLivingNews and MHProNews have often reported, true mobile homes or even older trailer houses are more susceptible to fire than manufactured homes, which are perhaps a bit safer against fire than conventional housing, according to the National Fire Prevention Association (NFPA) research.

February 13th, 2018 Comments off

There are several developing stories with focused upon the manufactured housing industry in process.

Several news tips have come in, including responses from sources such as the Urban Institute.  We are giving them an opportunity today to clarify, before we publish.

Which brings up these 2 questions.

Who is telling the good news stories about the manufactured housing industry?  Because there is plenty of good news to share. Or…

Who is defending the factory built home industry against problematic reports, be it from researchers, media or whatever other sources?

Current and long-time prior Manufactured Housing Institute members, Frank Rolfe and Marty Lavin raised important concerns on how a failure to address problematic reporting – or failing to tout good news – are key issues that holding up the manufactured housing industry’s sales and growth.

Who’s Telling the Good News?  Whose Defending the Industry?

We recently looked at the power of narratives, repeated over and over, and how they can influence and essentially brainwash those who don’t realize what is taking place.

These are just a few of the articles on MHLivingNews that Protect, Educate, and Promote (P.E.P) the manufactured home industry and its homeowners.

Meanwhile, MHI – who has a many times greater budget and numbers of highly-paid professionals who are supposed to be doing P.E.P. for the industry, where are there similar effort, visible daily to the public?

Lavin is an MHI award winner, and a success story in communities, retail and finance.

The truth is there for anyone who have the eyes to see.

We’re awaiting an update from the Urban Institute (UI), but note that there is only one issue they’ve raised with our reportone.  And we believe they are demonstrably mistaken about that sole issue that they raised.  UI was given links to each of the articles we’ve done that mention them, but we’ll share just this one link for now.

Was the Urban Institute Misled, Duped, or Part of a Manufactured Housing Industry Scam?

ICYMI, check it out – because by not taking issue with the vast majority of what has been published, they’ve logically largely confirmed in their response today what the reports spotlight. “We Provide, You Decide.” © ## (News, linked context, analysis, and commentary.)

“No Other Options” – Frank Rolfe’s Pad, MH “Parks” Tug-of-War, Good, Bad or Meh for Manufactured Home Communities, MH Industry?

February 6th, 2018 Comments off

FrankRolfeHomeSainteGenevieveMONatGeoNationalGeographicMobileHomeParksManufacturedHomeCommunitiesDailyBusinessNewsMHProNews1063Frank Rolfe has become a well-known personality in the manufactured home industry.

He’s been called a genius. Others take issue. For example, sometimes, Rolfe says “mobile homes,” and they are indeed a pre-HUD Code home.  But other times, he says that, and he’s talking about a manufactured home.  On terminology alone, he’s controversial.

For some, Rolfe is an industry rock star. Others don’t understand, or don’t want to understand, why he is getting so much media, as well as manufactured housing industry, attention.

Particularly since that New York Times article hit, there’s been a wide range of industry reactions, as the article and quote below reflects.

Sensationalistic ‘Cold Hard Lessons of Mobile Home U’ New York Times article  by Gary Rivlin draws Manufactured Home Industry Ire, Desire and Fire

FrankRolfeMHIHypocrisyQuote-MHProNews

MHProNews and our sister site has covered those Rolfe-related controversies from a variety of perspectives.

Nat Geo says on their YouTube page about their series, “About Explorer: Explorer, the longest-running documentary series in cable television history, honored with nearly 60 Emmys and hundreds of other awards, continues as a series of major specials on the National Geographic Channel…”

Literally millions of Americans have read about or viewed our industry through the prism of Frank Rolfe words; he and his colleagues operations.

Against that backdrop is the first part of a two-part insights into the ongoing saga of Rolfe, and how he has influenced the public perception of manufactured homes and communities.

This NatGeo “Explorer video above is vintage Rolfe.

It could be used to inspire investors to take a deeper look into the industry.

It can also be used by resident activist groups, as has the video in the article, linked below.

All of it begs the question, what’s been the net impact of Rolfe on the manufactured home industry?  Particularly, the land-lease community sector?

FrankRolfe$2000MobileHomesNatGeoYouTubeDailyBusinessNewsMHProNews

Still from NatGeo video, posted above, on this Daily Business News report.

Or, how has he influenced the industry’s discussion about itself?

Frank Rolfe: Pressured into Silence? Manufactured Housing Industry, and Journalism

Some are strong defenders of Rolfe, saying he turns around problematic properties, and improves them.  He’s doing residents and those communities a valuable service.

Others believe he’s a lightning-rod, one used by resident activist groups such as MH Action, among others.

Whichever perspective you, or your circle, holds about Rolfe – what’s clear is the Rolfe has been a media magnet. Part of the landscape of the manufactured home industry, particularly the community sector, is shaped by this prominent Manufactured Housing Institute (MHI), National Communities Council (NCC) member.

Some members love it, others, not so much, when Rolfe says something factually true like this.  For millions of Americans, there is “no other option” for them to own than by living in a “mobile home park” like one he and his colleagues operate. “We Provide, You Decide.” © ## (News, analysis, fact-checks, and commentary.)
