Public Reactions to HUD Secretary Carson’s “Innovations in Housing” Promoting Manufactured Homes

HUD Secretary Ben Carson is making good on his word on May 7, 2019 to promote manufactured homes as part of his prescription for a better America.

 

In a video interview with right-of-center Fox Business yesterday, Secretary Carson said the following.

 

 

 

Fox summed the video up on their YouTube page this way, “Housing and Urban Development Secretary Ben Carson discusses how the government plans to address cost and resilience issues associated with housing.”

As a potent exercise in gauging the public response, MHProNews copied the first of several public comments that were posted on 6.3.2019, the date the video was posted.

The numbers under a name of the posted comment are the numbers of likes at about 7:57 PM ET, on 6.3.2019.  There were 126 Comments posted by that time, and 4,363 views, 264 likes (thumbs up) vs. 9 thumbs down.

Money, Minorities, Manufactured Homes – Foiling the American Dream of Affordable Housing

At the heart of what’s known as the American Dream is the ideal of home ownership and private property.  While millions may want affordable rentals, what study after study reflects is that the vast majority prefer to own rather than rent.

 

When millions are misinformed about a subject, it begs several questions. Among them – why is there misinformation? Cui bono? Who benefits from the misinformation?

Affordable housing is in crisis in every state in America. Go north of the border to Canada, a similar scenario exists there too.  

 

Land is plentiful in North America. The question of transportation to and from places of work or business is an issue, as congestion in cities like New York leads some there to ponder a tax each time a vehicle enters as one so-called ‘solution’ to their challenge.  Isn’t it interesting how some quickly turn to a tax – a penalty or cost – that discriminates disproportionately against the least economically advantaged? But let’s move on to the central issues noted in the headline.

Home ownership is generally the better financial option over renting, so long as someone can afford the investment in making the purchase and plans to stay for several years. The renter pays for their housing, just as the person with a mortgage pays for a home. The question is does renter ever own what they are paying for or not?  Isn’t the renter paying the landlord to build equity, that if it were a mortgage to buy, would otherwise benefit the tenant?

Wealth creation is aided by home ownership. HUD Secretary Ben Carson made that point repeatedly during his stops in the U.S. after he became the head of the sprawling federal agency.  Home owners, said Secretary Carson, have an average household net worth of some $200,000. By contrast, renting households only had a $5,000 average net worth, the famous brain surgeon said.

The GAO determined in 2014 that manufactured homes are the most affordable kind of housing, often less costly to own than to rent. Then why has HUD, state, and local governments paid lip service to affordable housing for so many years? Because the most proven affordable permanent home in the U.S. (or Canada) is a manufactured home. Yet they are increasingly being marginalized or discriminated against. Information Wars

A Manufactured Housing Institute (MHI) member who is not a dual member with the Manufactured Housing Association for Regulatory Reform (MHARR) told the Daily Business News on MHProNews that he is “ready for info wars.”

It was a keen insight. It was a kind of polar opposite to Skyline’s Terry Decio’s lament to MHProNews a few years ago, “I’m tired of being the best kept secret. I’m ready to help house America.”

Those are statements from two different MHI-only member producers of manufactured homes. Both consciously or not are fingering the same issue. Information. Understanding. That de facto points to their opposites or possible causes, which are misinformation or misunderstanding.

In the Bible there is a story told of a man who finds a treasure in a field. He hides it again, goes and sells what he needs to in order to buy that field and own the treasure legally. That treasure hunter didn’t want the facts of his discovery to become known, or else he might lose his opportunity.  That story has many morals, insights, and takeaways. One is that knowledge was a potential advantage — but limiting that knowledge for a time was an advantage to that person who wanted the treasure.

Whoever better controls the understanding of manufactured housing can influence the value of manufactured homes and businesses in the factory-built housing industry. Misinformation benefits some, while harming others.  Hold that thought.

 

 

The Vast Right Wing Conspiracy?

While there are agendas and bias in media, and it has long been so, it would be an exaggeration to say that all news is fake news. MHProNews believes in a wheat and chaff approach with all people, sources, and things. Keep the good wheat, ignore the rest of the chaff.

Hillary Clinton, while First Lady to then President Bill Clinton, spoke of “a vast right-wing conspiracy” against her husband and herself. It was utter nonsense, of course, a mere head fake to distract from the reality that caused Bill Clinton to be impeached and lose his license to practice law. But it was also an absurd claim on its face, given that at that time much of the media was in primarily progressive or left-leaning hands.

Talk radio host Rush Limbaugh was a rising star and a favorite target of the left in those days, just as CNN, MSNBC, the Washington Post or New York Times are targets for several voices on the right today.

Each has a point, as right-or-wrong, they all have hidden or open agendas.

Far better to note or find the unvarnished truth than buy into someone’s spin. But as Shadows of Liberty reflected, or more recently Sharyl Attkisson has documented, various media have their own unique agenda(s). But that doesn’t require secret society meetings or a formal conspiracy to coordinate those voices.

The keen insight of Reagan Administration Secretary of the Interior, James Watt notes below is still apt. Google doesn’t have the exact quote, but his keen insight goes something like this.

I don’t believe that most of what some call conspiracy theories are actually conspiracies. What I do believe in are people
with common interests, acting in ways that benefit their common interests, and that common purpose may appear to be conspiratorial
.’  – James Watt, former Secretary of the Interior.

Let’s use a hypothetical example. If you hire a motivated kiss-ass, and you let the kiss-ass know that you want X instead of Y, watch that kiss-ass work hard to deliver X to the best of her or his ability.

So Warren Buffett of Berkshire Hathaway fame doesn’t need a memo to go out to the Urban Institute or the Manufactured Housing Institute (MHI) in order for them to behave in a certain way. Kevin Clayton doesn’t have to send a memo to MHAction, asking them to protest group A, instead of group B. All that is needed is to hire or recruit people who behave in certain ways. Behavior becomes fairly predictable, once a person or group are understood.

Hypothetically, if Buffett wanted to use Berkshire’s deep pockets potential to buy all of manufactured housing up, he could. What stops him from doing that are antitrust laws, the legal barriers that keep someone or some organization from monopolizing a marketplace.

So if you wanted to monopolize a market, and avoid federal or other legal scrutiny, how would you do it? Using the purported Buffett method, you buy a castle (a metaphor for a fine business in a sensible industry) with a good Moat, and then you deploy everything you can to widen and deepen that Moat slowly over time. You drive competitive players out, by what may appear to a causal observer to be market forces.

Never forget that even during medieval times, castles and their moats were in fact breached. It takes courage, intelligence, and sound planning, but the artificial moats that hinder manufactured housing could be breached by using a robust application of existing laws.

 

Part of how that could theoretically be accomplished is to weaponize media and public perception against that business’ interests. One might blur the distinction between a mobile home, a trailer house, and a HUD Code manufactured home. Make the term ‘trailer trash’ truly demeaning. Increase the regulatory barriers for that product/service. Force the little guy out of business entirely, causing an independent to sell out for less than their intrinsic value. If there’s no sale, watch their business go bankrupt.

Never mind, to the mercenary greed of those who might use this method, that tens of millions are harmed by such a process. Pay no heed to the social, taxpayer, or other cascading calamities this tragic ploy sparks.

 

 

In science, one might not always be able to directly prove X. But one might eliminate several possibilities as explanations for X. For the truly fortunate scientist, they can both demonstrate a smoking gun evidence for a hypothesis, and also use Occam’s razor to eliminate other possible explanations too.

Buffett’s Berkshire could afford to educate the public about manufactured homes quite readily in the course of perhaps a year or two. You wouldn’t use stupid advertorials to do that if you have access to billions, and could make hundreds of billions in gross revenue annually from a potential business.

 

You might instead:

   use your extensive media contacts, to consistently correct every bit of misinformation that exists. Berkshire brand 21st Mortgage CEO Tim Williams suggested something similar. And/or,

   use your own BH Media Group to correct the record day-by-day until people grasp the amazing reality of manufactured homes.

   You might have MHI publish openly – rather than hide or fail to publish on their website (one of several examples, is linked here) the most effective third-party information or arguments for manufactured housing.

   You might not allow Clayton Homes staffers to use the term ‘mobile home’ or even ‘trailer house’ in videos or social media posts that they do (examples on YouTube).

   You might ask your billionaire buddy who owns Netflix or Amazon to put out a new hit TV series that has the hero and heroine living in a manufactured home, and have friends that do too, the polar opposite of having something like the Trailer Park Boys. Make manufactured home living cool and smart. Stress how environmentally sound manufactured homes are, how much more appealing they are, and of course how much money you save.

   You might have a new resident manufactured home owner group form that works with industry to successfully address issues, instead of working against the interests of industry.

   You might allow the Government Sponsored Enterprises (GSEs), that you once held stock in, to enter the manufactured home market in a robust fashion, instead of in a toe in the water way.

   You might use your clout at HUD to get the 10/10 rule dropped on FHA Title I loans.

   You might use your clout at HUD to get them to enforce manufactured housing’s enhanced preemption, so that local zoning officials don’t keep minorities or others from buying a manufactured home, and benefiting from it.

 

The list could go on, but do you see the point?  Isn’t the list above the common-sense or obvious things you’d do if you actually wanted to promote manufactured home living into a mainstream form of housing?

That begs the question. Why instead has the Omaha-Knoxville-Arlington axis failed to do such obvious things?  We believe these to be people of above average intelligence and motivation. Then how does one explain their repeated failures for some 15 years to do the obvious?

 

 

Explaining ‘Leadership’ Failures  

The industry’s so-called leaders have arguably failed on several levels to do whatever is obviously in the industry’s best interests if robust growth were the immediate goal.

Which leads one from direct evidence of purported restraint of trade and market manipulation and indirect evidence like the above to a vexing, but logical conclusion. The powers that be not only don’t mind minorities or others to be trapped in renting for years on end.  Rather, it benefits the billionaires and multiple billion dollar value operators in a twisted way to keep millions trapped in poverty, if the goal is to consolidate the affordable manufactured home industry slowly over time. It fits the Buffett quote below to the tee.

Sometimes the truth is hiding in plain sight. Follow the facts, evidence, and the money.

What are the contrary arguments to such evidence? That’s a fair question.  We’ve asked that too. 

So we invited Kevin Clayton, Tom Hodges, Tim Williams, Rick Robinson, Lesli Gooch, and outgoing MHI president Richard ‘Dick’ Jennison to discuss or debate that contention in public and on video. They declined time and again for some two years now.

Instead, the powers that be since Tunica are suddenly putting out a flurry of MHI memos. Manufactured Housing Institute Members Defending MHI, Great Debate About Manufactured Home Industry Progress, Problems, and Profits

 

The industry’s giants can’t have it both ways. Logically, no one can. If you treat people and professionals like cattle, they get tired of not being heard and of getting herded. When you treat individuals like they are your chattel, their natural tendency is to rebel.

But the point in this article is simple. The value of manufactured homes is amazing. It is what Ron Thomas, Sr. called “a phenomenon.” But that phenomenon is misunderstood. During an affordable housing crisis, creating so much misinformation around the solution that is hiding in plain sight requires something bordering on a magic trick.

But when an echo chamber effect is established, then the steady drum beat of a false narrative can seemingly become believable. Look at the Trump Campaign-Russia collusion narrative. Tens of millions bought that lie. Millions still want to believe it, after it has been debunked by what the president called over a dozen “angry Democrats” – attorneys who indeed favored Democratic candidates, and also worked for Special Counsel Robert Muller.

Fact Check, Darren Krolewski, MHInsider Claim on 2019 Louisville Show Attendance

Darren Krolewski, Co-President at MHVillage and publisher of their MHInsider magazine made another bold claim in their most recent issue.  As regular and close readers of MHProNews fact-checks may recall, a problematic claim was made in their prior issue too, and no known correction of that factual error took place.

 

In that prior instance, they made an outrageously high claim for the number of new home sales that claimed were being made by a Clayton Homes retail center.  Even MHProNews sources with Clayton denied the accuracy of the overblown MHInsider reported statistics.

In this fact-check instance, Krolewski personally said that in 2019, they had the biggest attendance of any Louisville Show in the 60-year history of the event.

First, common-sense alone tells an informed manufactured home industry reader or investor that when this segment of the factory-built home industry is at only about 75% under its last peak in 1998, that outrageous claim on its face doesn’t make much sense.  There were thousands of more retailers years ago, not to mention more communities, suppliers, producers, lenders and so on.

Second, the industry today is doing only about 20 percent of what it produced in the early 1970s. See the shipment graphic, provided by another Manufactured Housing Institute (MHI) member, Skyline-Champion (SKY).

Third, Danny Ghorbani used to run the Louisville Manufactured Housing Show as a vice president for the Manufactured Housing Institute in the 1970s. When asked by MHProNews about the attendance, he said the show drew roughly 10,000 attendees a year back in the day.  That would be several times higher than the 2019 turnout.  Ghorbani stressed that the show was a national event then, and is only a regional show now.

Keep in mind as well that the number of new home display units in Louisville declined in 2019, a fact they show management, MHVillage, and MHI can’t hide.  At its peak, by contrast, the Louisville Show used to have over 150 or more factory-built homes on display.  That’s several times bigger than what the show has been in recent years.  Homes used to occupy several show halls. This year, exhibitor space and display unit totals both decline.  Is MHVillage/MHInsider giving cover to MHI for troubling signs ahead?

What Does This Obvious Error by MHVillage/MHInsider Means?

At a minimum, this is another example of either an obvious error that a manufactured home industry knowledgeable editor should catch, or perhaps is an example of a deliberately false or “fake news” claim.  The problem is this is a pattern of repeated errors, not a one-off.  See another recent example from MHInsider below. But why would they be making obviously mistaken or fake claims?

Legacy Housing monitored their results of their most recent promotion.  Casey Mack, made the following statement. Additional details are found here and here, or further below.  Rephrased, part of this might be puffery on the part of MHVillage/MHInsider.  They may be posturing for the sake of advertisers.   But beyond that, this purported pattern of “fake news” all seems to point in one direction.  Namely, to make the readers of such false information believe that times are better than they actually are.  The industry in numerous markets is in months of decline, not growth.  Where is there such an admission by Krolewski, MHInsider, or MHI?

While several speculative notions could be floated as to why this occurs, one point is clear.  MHInsider repeatedly themselves makes or publish the claims of others that appear exaggerated on their face or are perhaps deliberately misleading.  Either way, it is part of an ongoing pattern that pro-Manufactured Housing Institute MHInsider has exhibited for some time.

These are the issues that cause manufactured home retailers real or metaphorical heartburn. Why doesn’t MHInsider, MHR, or other industry publishers aligned with MHI cover these same concerns?

The Daily Business News on MHProNews believes in accuracy.  While anyone – including us – can get typos or such accidental mistakes, factual errors beg for correction. Where is MHInsider’s mature admission of such mistakes?

MHVillage’s MHInsider on Clayton Homes, Manufactured Housing Industry Fact Check – Why Correct Data Matters

It is stating the obvious that facts and sound data matters to investors, advocates, public officials, and industry professionals.

 

The thirst from accuracy is voiced from inside and outside of the Manufactured Housing Institute’s (MHI) member ranks.  Just as Warren Buffett might turn cool on a possible deal that was discovered to have incorrect information, so too those who are studying manufactured housing might not be as impressed by an organization’s claim if other data that they release proves to be wrong.

 

For that reason, as an example, Franke Rolfe and Dave Reynolds or RV Horizon’s/MHUniversity got tired of complaining about a lack of good data available from MHI or anyone else regarding the total number of land-lease manufactured home communities.  They’ve told MHProNews that their ‘hand count’ of all manufactured home communities took two people two years, and they identified about 44,000 communities.  The pair said they think there may be a few hundred more nationally than that 44k, but that those other properties would have as few as 2 sites.

The problem with manufactured home community (MHC) counts is made more challenging because some states require that every community be registered, but roughly half of the nation does not.  So, there is no accurate ‘master list’ in each state that could allow a simple contact of every state to yield a national total.

 

Fact Check of MHInsider on their Clayton Homes Claim

With that principle of the importance of accuracy of data in mind, we turn to a factoid stated in MHInsider in the January/February 2019 Louisville Show issue.  In it, they claimed that Clayton Retail’s Williams-burg Square location in Frazeysburg, Ohio sold some 2,000 homes in 2018.

The 2018 report is not yet available, but Kevin Clayton’s own annual report for 2017 stated that “Clayton Retail sold over 18,000 homes to families.”  They said that there were 361 total stores in the U.S.

  • So, if that 2017 total were exactly 18,000, it would mean the average Clayton owned retail center would sell 49.86 a year, just under 50 homes a year per store.
  • A Daily Business News with MHProNews source with ties to Clayton said there might be 2 Clayton retail locations in the entire nation in 2018 with 1/10th of the total sales that MHInsider inaccurately claimed that the Frazeysburg, Ohio location sold.  That source tells us that the typical Clayton store sells about 50 to 60 homes a year.  It’s a number which roughly lines up with what Kevin Clayton’s report cited above claimed.

Even if someone didn’t know industry trends, a close reading of the same MHInsider article would suggest as much.  Not far from that same photo, their column stated that the entire state of Ohio only sold about that number of homes. See the screen captures, above and below.

We contacted Darren Krolewski, who is listed as the publisher of MHInsider.  Let’s note in fairness that they do print a slick looking magazine. But the topic today is accuracy.

As of the time this article was written, Krolewski had not replied to the question about the factual accuracy of their article. Perhaps, Krolewski was just busy.

Anyone who pays close attention to the HUD, MHARR, IBTS or even MHI data should have know better.

Confidence by investors and others is based in part upon certainty.  Uncertainty in data creates less confidence among investors and others.

While MHI’s amen, echo chamber corner is arguably finding MHInsider to be useful for their purposes.  But usefulness for Arlington doesn’t mean it is adding to the confidence of investors.

Facts and figures should be accurate. Manufactured housing is underperforming. That’s a fact.

The extended forecast for the 2019 Louisville Manufactured Housing Show projects possible snow and bitter cold temperatures, per AccuWeather, as the graphic below from about 5:15 AM ET attests.

 

 

Weather has long been a factor in attendance at the first trade show of the year.  Exhibitors risk millions of dollars collectively to attract a crowd, whose size depends in part upon Mother Nature, travel, and road conditions.

Oddly, MHVillage has Tweeted a photo of their educational seminars that shows numbers of vacant seats.  Apparently the ‘educational’ attraction of the event has declined.  Why has standing room only turned into so many vacant seats?

It seems that educational attendance isn’t all that has sagged. So too has the manufactured home industry’s new HUD Code manufactured home production and shipment totals in recent months.

An affordable housing crisis is raging, and yet the Omaha-Knoxville-Arlington connected alliance seems unable to move the needle on key issues.  Their ‘service providers’ are repeating the avoidable mistakes of the past, why?

What the Omaha-Knoxville-Arlington axis are apparently good at is photo opportunities that produce no measurable results, other than more consolidation of communities, retailers, and producers. Is that an accident, or the intent?

What are they thinking?  It seems that the only answer that industry’s so-called leaders have is to silence the messenger of reality and fact checks, instead of dealing with the core issues that are costing the industry billions of dollars annually in sales.

Louisville and Tunica Manufactured Housing Shows, Controversial Profitable, Problematic Issues Loom

Manufactured housing trade show season begins in only a few weeks. First at Louisville, then about 2 months later at Tunica, independent producers of HUD Code manufactured homes, state coded modular housing, ANSI code RV ‘Park Model,’ and tiny houses are among the types of factory-built housing products that are routinely on display.

 

 

In addition, there are dozens of exhibition booths, with products, services, and associations being represented.

The formal show dates are as follows:

  • Louisville Manufactured Housing Show are Jan 30, 2019 – Feb 1, 2019
  • The Tunica Manufactured Home Show dates are March 26-28, 2019.

 

 

Good, Bad, and Controversial

These association-connected industry-only trade events are an important part of the industry’s business model for numerous operations.  Millions of dollars in business is done every year at these venues. That’s good.

There are several controversial aspects to these events in recent years, some of which are problematic, missed opportunities, or potentially risky – and that’s arguably bad.

For example, informed sources with deep ties to Show Ways Unlimited, the contracted event company, have told the Daily Business News on MHProNews that Clayton Homes has purportedly attempted to undermine the Tunica Show.

 

Tunica, Nashville Trade Shows and Manufactured Housing Glory Days

 

An award winner with connections to the association that runs the Tunica Show told MHProNews recently that, “I have consistently said over this last decade that SOME in our industry focus on an entirely different goal every morning: “What can I do today to make my competition go away?” – vs. merely trying to grow one’s sales, profits, CSI, etc.  It was a reference to Clayton Homes, 21st Mortgage, Vanderbilt Mortgage and Finance, Shaw, and other brands operating in the professional side of the manufactured housing industry – MHVille.

Furthermore, show sources remind MHProNews that Clayton Homes only entered the Louisville Show initially as a “defensive” move, which they naturally tried to use to grow the Berkshire Hathaway “moat.”

It was largely independents – not Clayton – that brought the Louisville Show back.  That was accomplished working in conjunction with MHProNews to make the event a success. MHProNews drew praise from show management and association leaders alike, as the example further below reflects.  As one source said, the only difference between the declining years of manufactured housing’s Louisville Show and the successful turn-around of the same Louisville Show was the promotional work of MHProNews.  While the industry was in decline, that was essential.

Now that the industry is modestly growing, running a decent show is arguably easier.

A source at Show Ways also accused “the Claytons” of sabotaging the Carolina trade show, which has since been canceled. They are concerned that Tunica could go the same way.

 

 

MHVillage – a high-profile member-supporter of MHI – have been given a leadership role at these events, in “educational,” and other matters.  Where has MHI leadership led the industry?

The industry has quietly spoken about MHVillage’s interestingly named, MH Insider.  Has there been anything but praise from MH Insider toward MHI or Clayton?

The industry’s members have left scores of copies of that glossy, slick-publication unread, on the racks. See that photo, taken on the last day of the show, further below.

 

Every Year, the Same Questions from Exhibitors

Factories bear the brunt of the cost for putting on a trade show. Booth exhibitors pay to display too.

Those exhibitors have asked MHProNews’ publisher – L. A. ‘Tony’ Kovach – for years, ‘why aren’t these trade shows opened up to the public?’

Good question.

At the Kentucky Expo Center (KEC), RV and boat shows are among the events that have “public days” have been done for years. When RV sales soared past manufactured housing in the last 2 decades, one must ask, why aren’t these costly MH Industry events also extended for a few more days, like some RV events have done?

Yes, there’s added costs, but there’s more benefits too.

The old Bartle Hall MH Show in Kansas City had public days for manufactured housing.  More recently, so did the Tulsa Show.  Thousands of locals came to tour manufactured homes on those public days.  That can only be a positive for the industry. The Ohio association had a public show too.

Danny Ghorbani, former MHI VP, later MHARR’s President and CEO.

According to former MHI Vice President Danny Ghorbani, the industry had two national shows up until the mid-1980s.  At Louisville, per Ghorbani – who was in charge of the event circa 1976 to 1985 – after the completion of industry days, manufacturers turned over the displayed models homes to their retailers.  Those public days were successful for the industry.

Public days also attracted positive regional and national media.   So, while there was some added costs, there was a serious, positive payoff.

Sources also say there were more international visitors to the event in those days too.  The Louisville event was far bigger, as the graphic further below suggests.

After Ghorbani left MHI to help form what is now MHARR, the Louisville show became a regional show, operated by 5 state associations, that contracted out show management.

 

It Was Successfully Done Before, Why Not Today?

Show Ways Unlimited – who operate the two trade shows now – has given their formal reasons for why they don’t do public days. But privately, it is hard for them – or anyone else – to argue that there are good reasons to do public days at Tunica and Louisville.

In hindsight, the question is arising — is that lack of public days one more ploy by MHI backed Clayton, et al?  Even if not, isn’t it an obvious oversight?

According to Danny Ghorbani, there were homes throughout the show hall, not just one wing. There were so many shows, models were on display outdoors too.

 

Dennis Hill and Retirement

Furthermore, Dennis Hill is going to step aside at some point in time. When that happens, what will happen to the independents and non-Berkshire Hathaway exhibitors – especially if pro-MHI, pro-Clayton forces – like MHVillage – take over the show completely?

These are real issues that the manufactured housing industry’s independents need to address.

In the meantime, the parent company for MHProNews – LifeStyle Factory Homes, LLC – could provide the industry’s independents with several ways to turn the tables on MHI and the big boys like Clayton, 21st, Vanderbilt, Shaw, MHVillage, and others closely aligned with them.  Those MHI insider forces arguably have manipulated matters to favor the ‘insiders’ at various events.

MHProNews blows away the engagement rate of all other industry trade media, per third party information and visual evidence, like what these photos on the last day of the show last year revealed.

For example, the MHVillage’s Louisville and Tunica websites have purportedly been arranged, to spotlight ‘MHI Insiders’ over independents.  For example, notice how they conveniently have the drone fly over the MHI booth, and the 21st Mortgage booth too?

The same is true of the MHVillage (MHV) led ‘education.’  It must be noted – not as a put-down, but as an evidence based reality – that Darren Krolewski has admitted publicly in front of dozens of industry professionals at Tunica last year that he can’t explain why so few visitors to their website actually become buyers.

Using their own data, just a small fraction of a single percent of MHV surfers become manufactured home buyers, and most of those buyers turn to a pre-owned home, not a new manufactured home.

The industry doesn’t need more glossy happy talk. It needs reality, which includes proven ways to grow the industry to its true potential, which during an affordable housing crisis should be 5 to 10 times (+/-) current shipment levels.

 

 

Boosting Results for SPOTLIGHTED Independents

The issues noted herein or elsewhere could be flipped, by creating synergies with LifeStyle Factory Homes owned trade show websites in conjunction with select independents.

Given the large investments that companies make to display at Louisville and Tunica, some additional marketing support only makes sense to help insure a more successful event for a given company.

These 2 trade events could also be used as opportunities to better establish new post-production associations to compete with MHI and the ‘big boys’ allied with the Berkshire brands.

The original Louisville and Tunica show websites are now the web properties of LifeStyle Factory Homes, and can be used to promote SPECIFIC companies – like your company – before, during, and after a given event.   That can be done with budgets starting from $500 to $15,000 (+/-), the later of which can include videos and other longer-term promotional items.

Or, live educational events could be included for select company(ies) products and services.  Those educational events can be organized to promote a company-specific product or service.

As the promoters of MHIdea have noted,if the industry keeps doing the same things, the same ways, with the same people, then those companies will keep getting the same results.’

The latest MHI email – if accurate – no longer projects an increase of shipments to 100,000 units for 2018. That’s a warning sign.  As Jenny Hodge at MHI said in their emailed message today:

The seasonally adjusted annual rate (SAAR) of [new HUD Code manufactured home] shipments was 92,236 in October 2018, down 2.8% from the adjusted rate of 94,877 in September 2018. The SAAR corrects for normal seasonal variations and projects annual shipments based on the current monthly total.” Are these the people the industry’s independents need to be following?

More details will be provided in the days ahead as plans and potential synergies emerge.  The return of more ‘dealer days’ could be a win-win-win. Those kinds of proven concepts need to be revived, and could be in 2020. But in 2019, more successful promotion of specific companies could set that stage.

As Tim Williams, President and CEO of 21st Mortgage Corp – and the prior Chairman of the Manufactured Housing Institute (MHI) – keenly phrased it: “I know that Tony [Kovach, publisher of MHProNews] has corrected errors when they are brought to his attention. His publication accepts opinion articles or will share views in interviews that may differ from his own published position. My impression is that Tony isn’t looking for ‘an amen corner,’ rather, he wants a variety of views that get people to think, talk and take action.

The reason that comment of Williams is so timely is because

  • MHI’s SVP Lesli Gooch, Ph.D., and
  • Clayton Homes President and CEO, Kevin Clayton

both recently made oblique responses via MHInsider to concerns raised by voices here on MHProNews.

Clayton and MHI’s Gooch were likewise obliquely replying to voices from across the Potomac River from Gooch’s office in Arlington, VA.

What they did was what one industry observer called “razzle dazzle.”

  • They didn’t directly respond,
  • they didn’t refute a single concern.
  • Rather, it was arguably cheer leading.  Spin. Misdirection.  ‘The future is this way! – with nary a thought as to what the recent past tells us about those who are speaking, and what their past behaviors have allegedly wrought.

Weaponizing or Surprising the News?

Agree, disagree – or fold your arms without any position or comment – but don’t suppress free speech.

When government surprises free speech, there are constitutional remedies.

But the issue of free speech, controlling what is or isn’t published, and suppressing speech, become trickier when it comes to when a corporation silences, spins, or unjustly parses information.

Most manufactured home industry professionals don’t realize the scope of the Berkshire Hathaway (BH) Media Group’s direct assets. Beyond these, there are other media ties and interests that they arguably can leverage. Why haven’t they? How does this reality compare with the claims of Kevin Clayton and MH Insider?

This is why those who publish, speak, or act in public have to be held to account.

Fact checks are useful in that regard.  A frank discussion on transparency, in the spirit of the late ELS Vice Chairman, Howard Walker’s words (linked below) would be welcomed by many in the industry, including within MHI’s membership.

Let that discussion be done on video, so all can see it.  There are several upcoming events where that could be done, or it could be handled virtually, with no travel needed.

  • Wouldn’t an open conversation be a step toward increased MHI and Clayton transparency?
  • If there is nothing to hide, then why are they ducking the conversation and relevant topics?
  • Why oblique replies, that duck serious issues, instead of direct replies to fact and evidence-based questions and concerns?

Control of the Media

In serious MHVille trade publishing, essentially, all but MHProNews have arguably been co-opted to various degrees by the “big boys,” logically in pursuit of controlling the narrative, in pursuit of their own agenda.

That agenda has for some years, included more consolidation, per industry sources, including those in MHI, or formerly with them.

MHProNews looks at the facts, considers the sources, and follows the evidence. Earlier last year, and for years before, MHI routinely replied promptly to all our inquiries. But since we’ve spotlighted the problems and concerns, they’ve gone silent. Why? If the facts are on their side, why not make or offer a cogent explanation?

We’ve asked before, why didn’t Berkshire Hathaway use their own newspapers for years to reply to flawed reporting about the manufactured home industry?  After we raised that questions a several times, magically, the Omaha World-Herald newspaper that Berkshire owns published an article on manufactured housing.  While it wasn’t perfect, it was a start.  What’s next? Will more industry pressure make them do it more often?  If not, what excuse will they give?

Where is the support for the National Association of Realtors ® report by Scholastica ‘Gay’ Cororaton that was overall so positive for manufactured housing?

As of yesterday afternoon, no obvious support online was discernable by a Google search for Clayton, Berkshire, or MHI and the NAR’s positive report about manufactured housing.  Why haven’t they beat the drums publicly on that NAR “Making the Case for Manufactured Homes,” or the more recent report linked here?

Going forward, if Kevin is serious about getting help from “Warren” on the image/education issue, from now on, instead of the low-brow-outcomes from email or other limited visibility shares – why not give professional BH Media Group and their other media communications assets the nod to carry such good news as Cororaton’s report?

Wasn’t what Kevin and Lesli Gooch said in print arguably indirect reply to issues we’ve raised?

There is no reason why MHI, and/or Clayton and other Berkshire brands couldn’t use their media holdings or connections to clear up each and every misconception about manufactured housing. Buffett did respond to direct slams on Clayton by the Seattle Times.  If what Kevin Clayton says is sincere, then why have the BH Media Group not done the same for every misrepresentation about manufactured housing?

Is MHI still supporting Vic DeRose at HUD for the Office of Manufactured Housing Program administrator position?  Who replaces Pam Danner is obviously important. MHI could easily strive to work for someone good, or someone equally problematic in place.  Why would they allow that to latter to happen?  Why did they allow Pam Danner to remain so long, when they admitted to the Washington Post to making no direct pushback? The reason given by some industry veterans for MHI’s foot-dragging is that heavy regulations harms smaller companies more than bigger ones. Since MHI is praising S 2155’s MLO rule change, why didn’t they do that same deal 3 years ago, during the Obama Administration, when the CFPB reportedly made that option possible via consumer groups and non-profits, had MHI agreed to dropped the points-and-fees?  After 3 years, they did just that – drop the chase for more points and fees.

How can they be so often wrong?  Or misleading?

Isn’t their effort to control the media narrative within the industry part of that pattern? And isn’t their failure to defend and promote the industry, part of the problem?

If MHI or Clayton are the solution, then why have so many retailers and independent producers gone out of business, or were economically pushed into a sale to one of the big boys?

Smoking Gun 3 – Warren Buffett, Kevin Clayton, Clayton Homes, 21st Mortgage Corp Tim Williams – Manufactured Home Lending, Sales Grab?

That’s not to say that everything that MHI does is wrong.  Ditto that for Clayton/Berkshire.  But given the history of often false or misleading statements, why should anything new be expected?  Kevin is saying now that they will promote, but in the video linked here, Clayton said they were ready about 7 years ago to do an image/education campaign.  Why did they wait?  Was it to consolidate more?

As an independent publication, service provider and consultant that MHI long praised, their behavior-changes starting in 2014 forced us as a business enterprise to look more closely.  Why did they arguably try to undermine our pro-Industry operation – while we were a dues paying, supportive members?

If they did it to us, what’s to keep them from doing it to you and your operation too?  As or more important, haven’t they done it to thousands of businesses already?

If the evidence suggests – and neither Clayton nor MHI will deny or defend to the contrary – that they manipulated the market to the detriment of the industry, why should industry professionals trust or believe them now?

If they did it before, what’s to keep them from doing it again?  And if we and so many others who have raised such concerns were wrong, why aren’t they using their vast media resources to routinely correct the record on manufactured homes?

 

The Bottom Line?

Not only is capital and access to lending power, but so is information.  There are several voices outside of manufactured housing that believe they are behaving in a monopolistic fashion.

To be forewarned can lead to being more prepared, more cautious, and prudent. The collage is made up of elements from SECO, with text graphics by MHProNews.

From time to time, a variation on the question is asked, ‘What happened to the reports about Tom Lackey, Stoney Pointe manufactured home (MH) community, missing titles, owner-carry, SECO and all those consumers who lost their homes?’

 

 

The short answer?

Based on the latest reports to the Daily Business News on MHProNews, this is not likely a dead or forgotten travail,

Rather, its more likely the quiet before the next storm.

Why? Because there are several ways that this tragic series of incidents are very much brewing. Let’s run through some of the elements.

 

First, for those not familiar with the matter or who need a refresher, click the link below, or other related reports through this, and at the end of this post.

 

Spencer Roane w/Southeast Community Owners (SECO), Praises Tom Lackey, Accused of Rent-to-Own Manufactured Home Sales Improprieties

 

Second, there have been multiple outreaches by media related to this case. They have reportedly contacted Lackey, and numerous others in the industry. Some of those outreaches by media have been referred to, or directly contacted the publisher of MHProNews. Rephrased, we don’t think there are possible problems, we’ve got strong reasons to believe this is ongoing. It could surface perhaps more forcefully in round two than the earlier round of troubling media reports.

 

Third, there has been legally-related outreaches to MHProNews on several industry issues – including Tom Lackey/SECO/Stoney Pionte – referred to our publisher.

 

Fourth. Based upon those third-party inputs and outreaches – plus tips from industry readers with ties to SECO – this provides a brief update on what appears to be underway about the allegations swirling around this troubling series of incidents at Stoney Pointe, and their related ‘finance’ operation in northern Georgia.

 

We’ll begin by reminding readers that allegations are just that; Lackey and those connected to SECO are deemed innocent in the eyes of the law, until proven guilty by a plea arrangement or conviction.

There are indications that multiple agencies are investigating, as well as “plaintiffs attorneys.” 

1) The Georgia Department of Banking and Finance is reportedly investigating. Such matters can take time, as interviews are done, and a case is built. It could be months before something official is heard.

Per industry sources, officials in GA are keenly interested in the contract for title/rent to own related problems. Rephrased, there are indications that not just Lackey will be caught up in this matter legally. Rather, others connected to SECO are = per sources – being scrutinized too.

 

2) Tom Lackey has reportedly told a small circle of SECO connected contacts that he is suspending his contract for title/rent to own business. Consider that in the context of the above and what follows. Coincidence?

Caution is urged to all of those who have been connected to SECO’s ‘education’ on seller financing. You may want to seek legal counsel.

 

3) SECO has yet to remove Lackey from their planning team. Amazing, but true. There are two well know Vietnam veterans involved in MHVille who are connected to SECO. Vets – which this publication respects and thanks for their service – exhibit at times an interesting type of loyalty. Industry sources close to the matter have mentioned that in this context, as loyalty to Lackey. As noted previously, linked reports can be read later for increased depth on this topic.

4) There are reportedly at least two levels of legal investigations underway. One is from public officials. The other is from reportedly multiple attorneys interested in filing suits over claims related to the consumers allegedly wronged in this matter.

 

5) SECO promoters, including MHVillage, continue to promote the next event without any warnings or notices to their past or prospective attendees. Is there possible liability for those involved?  Better ask the private attorneys, public officials, or get your own attorney to explain what the potential risks and ramifications are reportedly connected to this ‘vexing mess.’

 

There are those in MHVille who continue to be silent, or even defend Lackey and SECO’s ties to this multi-layered, problematic series of concerns.

While some have thoughtfully informed MHProNews, does the silence of others say to communities and other industry professionals that nothing is wrong? Are they being made aware of the possible ramifications? Are SECO board members, or even those who have previously registered to attend, aware that they could be witnesses? Or worse, possible targets?

How would mainstream media view the industry’s promoters and attendees, in the wake of those who allegedly lost their ‘investments’ with Lackey’s operations?

What has been done to past SECO attendees – including those who have done/are doing ‘seller financing’ and/or ‘contract for title’ ala Lackey – to mitigate their risks?

There is no immediately evident clues from SECO or MHVillage promotions on any of those very real concerns and questions. Why haven’t other industry bloggers or publishers raised these issues, to give potentially hundreds of industry pros fair warning?

Mistakes that are corrected are arguably what honorable adults in business strive to do.

That said, let this stand as a reminder that ‘education’ at SECO may – per sources – have in some fashion contributed to what occurred.

Certainly – per our sources in media, legal, SECO connected, and the broader MH industry – there is a likely of more ‘bad news’ to come from outside media and legal issues.

Do you want the welder with one class worth of experience, or do you want the welder trained under and expert, and who’s been an apprentice for several months, or a year?  Doesn’t more training produce better work and results?

Modern manufactured homes are widely misunderstood. If this weren’t true, you’d be selling many times more manufactured homes at your location(s) than is currently true.

Because the problem – ignorance, prejudice, bias, NIMBY, and misunderstanding are well known – the highly profitable solution becomes clear. It’s simple, yet profound.

The solution is market-based, local-level educational efforts. 

Education must be on two levels. Professional education, plus the education of the public including  opinion influencers. 

Well qualified home buyers, which routinely describes those buying conventional housing, shop for weeks or months (sometimes, years) before making a decision.  They may only call, message, or come out to look after they’ve been doing their homework online or doing drive-by-looks for weeks or months. That means your online strategy must account for that reality. 

For the personal engagement with consumers, if you handle them professionally, they may make what seems to be rapid decision. But remember – in fact, they’ve been shopping for quite some time.  If they come to you, that often means you have to screw up to not sell them. 

So don’t screw up.

Every location that wants to grow sustainably needs one or more apprentices.
