Earning More Honest, Honorable Manufactured Home Industry Profits in 2019

Every business professional or account worth their salt does a financial analysis.  Serious investors in the equity markets or who want to risk money in a property or enterprise want data and evidence too.

 

Two articles on varied topics posted today on the Daily Business News each have a kind of lesson learned.  Those lessons could be summed up like this. The opportunities for affordable housing are immense in the U.S. Yet, manufactured housing (MH) is underperforming.

Why?

In fact, the MH industry is hovering near historic lows by several measures. This is despite the fact that there have been several generally positive, third-party reports on manufactured housing in 2018 alone.  As usual, we’ve covered those good reports on the Daily Business News on MHProNews, along with hundreds of other topics.

MHProNews has done extensive fact-checks in 2018.  We’ll finish the year with this one more, for the sake of the industry’s business professionals, investors, advocates, officials, and policy wonks.

For the purposes of this report, we are not going to dispute the claims of MHVillage (MHV) shown below.  We’ll simply take their own claims at face value.  The data was pulled from their MHV site on 12.30.2018 at about 3:30 PM ET.

Similarly, for the purposes of this analysis, MHProNews won’t dispute the claims of Alexa.  Generally, to get this level of data from Alexa, as is shown below, one must register a site.  So presumably, MHV and/or their sister operation registered their website.

This reflects several points that MHProNews has made for years, including, but not limited to the following:

  • The vast majority of those who consider a manufactured home never buy one. It is, per MHV’s data, over 99½% that don’t buy from them. Of course, they may buy elsewhere, but other statistics demonstrates that #nettlesome point that manufactured homes are not being bought at the rates or percentages in numerous years past.
  • While that is a problem, it is also an opportunity in disguise for those who learn how to convert lookers and visitors – online, as well as at sales centers and communities – into paying customers.
  • Those that buy a manufactured home on MHV are predominately used home shoppers, MHVillage Co-President Darren Krolewski said as much in Tunica before a live audience of dozens of industry professionals in 2018, in response to a question from MHProNews.
  • Krolewski also admitted publicly at that same event that he doesn’t know why the conversion ratios are so low.
  • As low as MHV data revels its conversion ratios are, if one takes the Manufactured Housing Institute (MHI) claims seriously about reaching an audience of tens of millions in 2018, their pathetic conversion ratio data makes MHV look like superstars. Sadly, when MHI’s own claims are properly understood, they arguably make MHI “promotional” efforts look foolish at best — or exaggerated, deceptive, and ignorant at worst.
  • In fairness to MHV, they likely are – because they are a predominately publicly-focused website – higher in total traffic than MHProNews, which is laser focused on professionals. Meaning, their traffic data-points and MHProNews would be apples and oranges for those who are targeting a Business to Business (B2B)  vs. a Business to Consumer (B2C) audience.

ICYMI, it is also worth noting that on the last day of the Tunica Show, just shortly before the show closed, the following photo was taken. There are others like it for more racks, as the insert reveals. MHVillage’s “MH Insider has not resonated with the B2B audience. They have advertisers, to be sure, but the readership – based upon the clear visual evidence below – is lacking.

One could go deeper, but this is sufficient to make the following points.

  • Whatever MHI and MHV are doing, it is insufficient to dramatically move-the-needle in new manufactured housing results.
  • The same point could be made about Berkshire Hathaway owned MH industry giant, Clayton Homes. Why they do, what they do, their data for 2017 claims they were 47.7 percent of the industry’s total sales. They’ve arguably spent millions on promotion. But the entire industry is still only going to finish 2018 with about 100,000 (+/-) total sales for the year, as suggested by MHI’s own most recent SAAR forecast.

This leads us to inexorably the following conclusion.

 

Without Changing the Behavior, the MH Industry Won’t Improve Enough to Achieve its Potential

It is no secret that MHI and some of their surrogates have worked for some years to derail and undermine MHProNews, for whatever reasons one may wish to speculate. That began prior to MHProNews’ serious fact-checks and investigations, which began when an MHI member gave a news tip about Richard ‘Dick Jennison and Lesli Gooch, so one shouldn’t think that MHI tried to derails us to ‘retaliate.’  If anything, MHProNews was frankly slow-to-respond.

The video below could be seen as a mainstream media summary of recently reported scandals.  The video news is from Kevin Clayton/Clayton Homes’ own base of operation headquarters, in Knoxville, TN.

 

 

The video above lays out facts, allegations, and federal investigations that MHProNews – and numerous others in mainstream media – have independently reported on.  So, no one can claim with a straight face that MHProNews is making up news, rather, we are the primary news source that can be trusted to report-on and thereby hold the powerful to account.

The Manufactured Housing Institute leadership, and the Berkshire brands operating in manufactured housing, objectively have their own image problem.  While Clayton says they’ve paid no fines lately, they’ve previously admitted in public to paying fines and having to refund money on home loans in the not-too-distant past.

The last MHI chairman who had no public scandals was Don Glisson Jr. MHI’s prior president left with a series of statements that all pointed to similar problems MHProNews has also reported. While Clayton’s Tom Hodges has had no negative news tided to his name, Clayton Homes has had numerous issues reported in mainstream media over a period of more than a decade. See the video posted above as but one example, from 2018.

“Manufactured Housing Institute Attorney” Letter and MHProNews Response

An attorney who claims to represent the Manufactured Housing Institute (MHI) has sent a ‘demand’ letter to MHProNews.  No proof of his representation of the Arlington, VA based Monopolistic Housing Institute, otherwise known as MHI, has yet been offered, but has been requested.

 

The attorney’s letter has obvious errors in it.  So, rather than reproduce it at this time, the Daily Business News on MHProNews will provide the following public response to said attorney, his firm, and anyone who may be connected with an attempt to avoid debate of manufactured housing industry issues through purported ongoing intimidation tactics, this most recent one delivered on the Saturday before Christmas.

Let me hereby restate my request that you document your claimed representation of the Arlington, VA based Manufactured Housing Institute (MHI), along with any other manufactured home (MH) industry professional relationships, such as Nathan and Mary Smith of Fort Mitchell, KY.  Nathan is a partner in SSK Communities, and has or does sit on at least two MHI connected boards, their Executive Committee, and their MHI PAC.

As noted in my initial reply, Nathan and Mary Smith live in Fort Mitchell, KY. Your firm’s website states you have offices across the river in Cincinnati, OH, as well as in Fort Mitchell, KY proper.

That and other prior points in my first message to you on 12.22.2018 hereby restated, if you indeed represent MHI, let me give you a Christmas gift of more billable hours from that Arlington, VA based trade group.

We once more reject the premise of your letter as errant, baseless in law.

In addition to my previous written requests, please provide the following:

  1. A copy of all Manufactured Housing Institute (MHI) current and past bylaws, dating back 20 years.
  2. A copy of all past and present MHI staff members, dating back 20 years, including their titles, head photos, and last known contact information. Include the following: if they have separated from MHI, what was the cause of their departure? We’re monies expended by MHI to those departed members that included a non-disclosure agreement? Why was a non-disclosure agreement (NDA) needed for each of those departed MHI staff members?
  3. All current and past MHI members including their designated representative’s last known contact information, including title, phone numbers, and email addresses, dating back 20 years to the present.
  4. As you may or may not know, Clayton Homes and their affiliated lenders – Berkshire Hathaway owned firms – have been accused of racism. It is said that nothing of consequence at MHI happens without the okay of Clayton and those Berkshire brand MH lenders. There are federal investigations reportedly underway into charges of racism and other allegations. MHProNews and MHLivingNews previously asked Clayton and MHI to issue a specific written condemnation of racism, which they both declined to do. Why is that, please? Can you explain why they declined to issue a condemnation of racism in writing to the manufactured home industry’s largest and most-read trade publisher?
  5. Can you explain on MHI’s behalf why they seem to have an all-white staff?  Why they have been disproportionately Anglo for some years?
  6. Are you aware that MHI and Clayton Homes has been allegedly connected with several violations of antitrust laws? Can you explain on their behalf how the evidence provided at this link isn’t a violation of antitrust laws?
  7. Are you aware that MHI and Clayton Homes has been tied to allegations of the misuse of the U.S. Mail? Are you and your firm aware that they have been accused of other civil and constitutional rights violations?
  8. Are you and your firm aware of the wide latitude that news media has in using an organization’s logo or other images under FTC fair use guidelines?
  9. Are you and your firm aware of the many apparent conflicts of interest between MHI, Clayton Homes, and other Berkshire Hathaway brands operating in manufactured housing – and the balance of the manufactured home industry that MHI claims to likewise represent?
  10. Please provide all incorporation documents, and itemized budgets, of MHI for the past 20 years.
  11. Please provide the minutes of all meetings between MHI staff, MHI members, Fannie Mae, Freddie Mac, the Federal Housing Finance Agency (FHFA), or any other parties regarding manufactured home lending of any kind in the last 20 years?
  12. Please provide the minutes of the meetings in bullet 11 above, and all documents, videos and other electronic records – including their power point and Las Vegas presentation – about their so-called “new class of homes.”
  13. Please be aware that MHI has been accused by their own past and present members of pressure, ‘strong arm tactics,’ threats, bullying, intimidation, innuendo – aimed at members, prospective members, and non members – as well as other activities which may violate state and federal laws.

This is my initial request, which will be followed by others, once you document your relationship with MHI, Nathan and Mary Smith, et al.

As we believe that this so-called trade group operates in a fashion that may violate state and/or federal RICO laws, please preserve your own records and communications, that of your firm, and have MHI preserve all documents and records, including but not limited to, electronic and encoded communications.

Finally, my time and that of our firm has value. We are widely recognized manufactured home industry experts.  As this link and the videos below reminds all, we have been praised verbally and in writing by past and current MHI leadership, as well as others in manufactured housing firms of all sizes. So, all time lost to this bogus allegation of yours, and any other efforts will be the subject of any counterclaims that may arise.

Such counterclaims may or may not be limited to MHI, Berkshire Hathaway brands operating within – or influential in relationship to – manufactured housing, MHI Executive Committee members, et al, and if they are found to be operating in violation of RICO, postal, or other state/federal laws, to you and your firm.

Rephrased, we believe there is evidence that:

  • MHI operates as a purported racket on behalf of others,
  • that they deceive and manipulate their own members, which could be construed as deceptive trade practices or other actionable subjects.

So, if you and your firm understand these issues, and you or your firm cross any legal lines, then in addition to counterclaims for damages against MHI and any of their members supporting such a claim, we will also as needed potentially seek your/their disbarment and/or others sanctions as warranted.

It is becoming clearer to many that MHI, the Clayton brands, 21st Mortgage Corp, Vanderbilt, and other Berkshire Hathaway brands operating in manufactured housing are unwilling to discuss/debate issues and concerns on their merits.  They would rather attempt purported distraction, intimidation, undermining, and smear tactics.

 

 

If they have the mettle to truly lead for the sake of the many and not their own interests alone, then:

  • let them step up to the plate and participate in a public discussion at with L. A. ‘Tony’ Kovach and others MH industry pros he selects to appear on stage at Louisville with an independent moderator and agreed upon format.

 


  • Let that discussion of their allegedly monopolistic actions of financing, capital and the marketplace – including – but not limited to recent concerns about their claimed manipulation of the GSEs and this new class of homes – be recorded on video so that the entire industry, state and federal officials, and all other interested parties can see for themselves the reality of the claims vs. MHI, Clayton et al’s responses.

 

If they haven’t figured it out yet, they may be Goliath, but David still has his slingshot.

Our aim here at the parent company for MHProNews is not just for 2019, or 2020, but for years beyond.

The system wasn’t rigged against independents operating in manufactured housing overnight. The GSE ‘Duty to Serve’ mandate wasn’t weaponized against home owners and professionals interests overnight either.  Legal, research, publishing, federal, state, and other actions take time to address and redress the wrongs purportedly done by MHI and their string-pullers against the interests of thousands of manufactured housing companies, and millions of manufactured home owners.

Facts are #NettlesomeThings.  We’re not attorneys, but we can read and research as well as some in media, and better than others.

The reality is that if MHI, Clayton, or anyone else wants litigation over news stories that have provided evidence, and uses all of the proper disclaimers, then such baseless legal action can cut both ways. We’d love to take a good look at MHI’s, Clayton’s and 21st’s books – among others in the Berkshire Hathaway orbit – how about you?

That could be as powerful as certain news tips.

Optimism Among U.S. Manufacturers at Record High Heading into 2019

There is a blizzard of emails that hit the MHProNews inbox daily, so frankly, at first this report was initially overlooked.  It wasn’t until we saw the White House release on this same topic that we circled back for the toplines of this report.

While NAM represents sentiments of manufacturing in general, it certainly is a useful insight for the producers of manufactured housing.  It is also useful for those who are market watchers, investors or those working at other levels in the factory-built housing industry.  Why?

Because the broader manufacturing sector is booming.  Manufacturers are often somewhat happier about an issue like tariffs, that are rankling investors.

Much of what is imported from nation’s like China are finished goods, produced in a factory. If an improved trade deal emerges from the drama of 2018, that will be welcome news.  But if not, it is entirely possible that even more manufacturing will return to the U.S., and that is good for America too.

Two more points, before turning to some toplines from the related White House press release.  First, as factory-producers and developers know, there are a growing number of imported units coming into the U.S.  Tariffs – if the trade tiff continues – could arguably mean that some will turn to a domestic builder instead of one from China.

Second, all news has to be considered carefully, mainstream or other news.  Right or wrong, 92 percent of the news – per third party research – has been negative toward the Trump Administration. It is thus useful to periodically see that vantage point, to balance out the headlines from the left and right that we present each evening during our market recap.

With that intro, let’s look at the latest news and views from the White House.

Optimism Among U.S. Manufacturers at Record High Heading into 2019

 

“American manufacturers think the future looks bright,” Joe Williams reports for the Washington Examiner.

 

“Nearly 89 percent of the 539 companies polled by the National Association of Manufacturers in the fourth quarter held a positive outlook for their business, bringing the yearly average to 92.4 percent, the highest in the survey’s 20-year history.”

Saturday will mark the one-year anniversary of President Donald J. Trump signing historic tax cuts into law. “Kevin Hassett, chairman of the president’s Council of Economic Advisers, said strong capital spending and economic growth are proof that the good times can be sustained,” Gabriella Muñoz writes in The Washington Times. “We got exactly the growth affect we predicted last year,” Hassett said.

 

 

“Thankfully, the era of broken promises ended in 2016,” Dr. Alveda King, niece of Dr. Martin Luther King, Jr., writes in the Ledger-Enquirer. “For Trump, strengthening American communities is fundamental to American success. The FIRST STEP Act does just that by establishing job-training initiatives to better prepare prisoners to re-enter society after they are release.”

 

 

In USA TodaySecretary of Agriculture Sonny Perdue writes that the Trump Administration’s new proposed Supplemental Nutritional Assistance Program (SNAP) rules will encourage productivity instead of poverty. “The president has directed me, as Secretary of Agriculture, to propose regulatory reforms to ensure that those who are able to work do so in exchange for their benefits.”

 

 

“During the 2016 campaign, President Trump promised blue-collar and low-wage service sector workers that he would improve their lot. A new labor-market study by a major business group suggests he’s kept his word,” the Investor’s Business Daily editorial board writes. “The study by the Conference Board, the New York-based global business organization and think tank, found that blue-collar workers aren’t just doing better, they’re now in short supply.”

An Area of Agreement Between Warren Buffett and MHProNews

Warren Buffett doesn’t likely lose any sleep thinking about what the Daily Business News on MHProNews publishes. He reportedly leaves sleep loss and heart burn mostly to his company CEOs.

 

  • With baseball season over,
  • the end of college football’s season in sight,
  • and with the pros season not far behind,

we thought we’d close out this evening with a fun video that makes a simple but common sense point for investors to consider.  It’s actually a favorite analogy of Buffett, per his own paper’s website, Omaha.

Let’s tee it up like this.

Don’t watch the market closely,” Buffett said in 2016 amid wild market fluctuations, per CNBC. “If they’re trying to buy and sell stocks, and worry when they go down a little bit … and think they should maybe sell them when they go up, they’re not going to have very good results.”

 

On another wild day on Wall Street, what are Buffett’s tips?

  • Wait for the right pitch.
  • Invest in something that makes good sense.
  • Don’t get goaded into a bad pitch (a bad deal.)

Those points of agreement noted, don’t push us too much further, because that will lead us to the kind of reports like the ones linked further below.  We wanted to demonstrate that there is always common ground to be found for people of good will and integrity.

Drama.

Some of it is ‘manufactured drama.’

Some of it was arguably avoidable drama, as in the case of Cavco Industries, whose stock has tumbled over an SEC subpoena over trading by Joe Stegmayer, MHI’s Chairman and now ex-Chairman and CEO at CVCO.

There are legitimate disagreements on issues that people can have. But aren’t people’s home’s sacred?  Is it OK to have leftist agitators forcing people they disagree with out of public restaurants, where they are enjoying a quiet meal?  The WaPo video above makes that tie-in too, showing a brief clip of Ted Cruz being confronted with angry protestors at a restaurant.

Notice that the common thread here is that these cases are routinely left-wing, anti-Trump activists.

Senator Rand Paul (KY-R) was attacked and injured outside of his home by a neighbor.  Louisiana Representative Steve Scalise was shot and almost killed while playing baseball with others from Congress.  Someone also was arrested mailing what looked like pipe-bombs to various Democratic backers, political figures and pro-leftist CNN.  All of that is tragic, on either side of the political aisle.  But the reality is that it is more common – and specifically organized on the left.  On the right, the early indication is that no-explosions purported pipe-bomb mailer was that he acted alone.

The 45th President condemned it all, on both sides of the aisle. But the expected House Financial Services Chair Maxine Waters (CA-D), was encouraging people to push back at conservatives in public places.  Waters isn’t alone.  Senator Cory Booker (NJ-D), a potential presidential candidate, encouraged people to go up to Capital Hill and get into the opposition party’s faces.  That’s a clear, bright line distinction.

So too is the notion that to date, there are not reported ties between conservative billionaires and violent protesters.  By contrast, Warren Buffett, George Soros and other billionaires have per Open Secrets and other sources provided money to foundations that in turn paid groups that organized such AntiFa style tactics.

 

RBG’s Fall and the Midterms

Supreme Court Justice Ruther Bader Ginsburg (RBG), a progressive or leftist judge, has reportedly taken a fall and has suffered injuries.  Certainly, everyone should wish her well and pray for her recovery.  But it is a stark reminder of just how important the GOP holding onto the Senate, and expanding their margin is.  If another Supreme Court opening occurs in the next 24 months, President Trump could get another pick in his first term of office.

Those Errant Public Opinion Polls

Florida News Network’s Larry Spillman raised the topic this morning about several polls that showed Mayor Andrew Gillum (D-gubernatorial candidate) and Senator Bill Nelson (FL-D) several points ahead, just days before the election. Spillman asked a polling expert, how did the polls get it so wrong? The polling expert answered that this way, “Polls are based on assumptions.” Polling uses statistical models based upon turnouts.  ‘Flawed baselines, amplify flawed results,’ said Spillman.

On Monday evening, well before polls closed, Fox News stunningly announced the House was going to be won by Democrats. That was based upon exit polls, and other research.  While it was ‘accurate,’ did making the announcement hours before polls closed in western states cause how many voters to just go home?  Would Jon Tester (MT-D), for example, have won in Montana? Per Helenair yesterday, with 562 of 669 precincts reporting, Democratic Senator “Tester had amassed 234,025 votes, or 50 percent of those cast, to [Matt} Rosendale’s 222,544 votes, or 47 percent.”

In Indiana, some sources claim that backers associated with Senator Joe Donnelly (IN-D), who lost to Republican Mike Braun, provided campaign support to a Libertarian candidate in that state.  While Braun won anyway, had the totals been closer, that kind of trickery – which may be legal – is nevertheless an indication of how the left often ‘plays the game.’

The good news is that with a media that researchers say is biased some 90 to 92 percent against President Trump, the GOP still picked up seats in the Senate.  A split Congress is better than an entirely hostile one.

  • Massive Money
  • Media
  • Manipulation
  • Threats and intimidation were part of the run-up to 2018, and have picked up immediately afterwards, with this incident at Tucker Carlson’s home.

MHProNews reported that 7 of the top 10 U.S. billionaires are pro-Democratic.  So are others, like Tom Stayer, and George Soros.  Democrats often decry ‘dark money’ in politics, but they have the lion’s share of it. In fact, that is part of the Democratic game.  Point fingers at your opponent, and accuse them of racism, fascism, making false statements, or whatever, while they are the ones who are using strong arm tactics.

Tim Williams of 21st Mortgage wasn’t wrong when he said that the “progressive agenda” is a threat to MHVille.  Its just that Williams himself backed a progressive, as has Clayton, MHI, and Berkshire Hathaway’s Warren Buffett.

As Marty Lavin has said,

  • pay more attention to what people do than what they say, and
  • Follow the money.

The industry’s investors and independents did okay on Tuesday.  There is clear evidence that good information, and strong leadership can pay off.  The positive economic track record is there for the 21 months since the president took office.  To win in 2020, to free the industry from the corrosive and costly effects of billionaire leftists, their media allies, and their thugs, the battle has begun.

There are good reasons to be open to concepts from across the left-right divide, as pro-free enterprise, pro-Constitutionally limited government MHProNews has exemplified for years.

Among the stronger voices for successfully promoting manufactured homes in a positive light has been those coming from the ROCs, or Resident Owned Communities.

Resident ownership isn’t the only solution for affordable quality living, as Paul Bradley has told MHProNews, but ROCs are a proven one.

As one reads this op-ed by Tara Reardon, consider doing your own letter-to-the-editor, at least once a year in your own market(s).  Don’t make it a plug for your business, or the odds are good it won’t be published.

Do make such a letter educational, as Reardon has done.

Manufactured (or mobile, as most people call them) homes represent the largest stock of unsubsidized affordable housing in the United States, with nearly 18 million Americans calling them home.

But despite their clear economic and lifestyle advantages, some people consider manufactured homes a last resort, rather than a great choice. That’s because of outdated notions about the quality of the houses, the communities where they’re located and the people who live in them.

The mention of manufactured homes often conjures visions of old dilapidated trailers, and it’s true that they still dot New Hampshire’s landscape. It’s also true that you’ll find broken-down and neglected site-built homes along many a country road.

Modern manufactured homes are built to federal code, in a controlled environment, and can contain all the modern amenities that we HGTV-watchers dream of. These homes are not only well-built and attractive — they’re also affordable. The average cost to build a manufactured home is 50 percent less expensive per square foot than a comparable site-built home, excluding land cost.

My family recently moved from a big home where we raised kids and held large-family gatherings, with plenty of space and bathrooms, and a large lawn that required lots of upkeep, to a smaller downtown home on a 0.11 acre lot. I, like many empty-nesters, am relieved not to have to heat and light all that
extra space, not to mention the yard work and the clutter we accumulated just because we had the room.

My neighbors are just feet away, and we happily coexist in the dense urban block. I see and greet my neighbors far more often. I knew when Frank got a new knee and what time the kids leave for school. Chester and his dog, Honey, greet me on my way by. If they needed help, or something were amiss, I would know instantly. We now walk to our jobs and to Main Street. That is what I love about living in my neighborhood.

So why do we have this vision in our heads that living in a manufactured-home community is undesirable?

I work with folks in New Hampshire’s 126 resident-owned communities (ROCs). Their homes are small, but more than adequate for their needs. Their utilities are affordable and their space comfortable, on one level and easy to maintain. Their car is quickly accessible, parked right next to their homes. They own their homes and pay taxes on them just like I do.

These homeowners collectively, as a cooperative, own the land under their homes and manage their communities. They know if an elderly person’s shades aren’t raised in the morning, help might be needed. Their streets are private and more narrow, perfect for walking or bike riding.

My experience has shown me what a great housing option this is for more than 7,200 New Hampshire households. Yet some towns’ zoning ordinances include their manufactured-home regulations in the section that deals with campgrounds!

Worse yet, some towns require that manufactured homes be located at least 25 feet from the property line (a typical restriction) unless the adjacent property is zoned residential. Then the setback requirement doubles to 50 feet!

We have an affordable-housing shortage, and folks way smarter than I have pointed to manufactured housing as one solution. It makes sense, and for this housing to realize its potential, professionals who sit on planning and zoning boards, city councils and select boards owe it to their communities to understand the realities of modern manufactured homes. They’re likely to be surprised that they’re not the “trailers” they remember.

Manufactured-home communities combine the practical aspects of the tiny house and cluster development trends that have drawn a lot of positive attention. It is time to honestly consider all housing options, and not only consider manufactured housing as a component of the solution we are looking for, but to start planning our communities to include this common-sense housing choice.
