Stephanie Reid Raises Undocumented Immigrants Getting Ripped Off by Manufactured Home Communities Issue

In a release to the Daily Business News on MHProNews today was a Q&A by Stephanie Reid.  Reid was “formerly on staff with the Senate Select Committee for Manufactured Homes,” said the GSMOEF – the GSMOEF, or the Golden State Manufactured-Home Owners Education Fund, which is affiliated with the Golden State Manufactured Home Owners League (GSMOL).

 

It will be recalled that GSMOL provided the initial tip to Manufactured Home Living News (MHLivingNews) that Manufactured Housing Action (MHAction) was being funded by the Tides nonprofit. Not only did their report prove to be accurate, it led to the discovery that Warren Buffett – via so-called ‘dark money’ funding of NoVo Foundation – which in turn was the top donor to the Tides.

Question:  I own a mobilehome park where there are many abandoned homes.  Can I sell them without registering as a real estate agent?

 

Background:

Although I heard from only a few park managers and realtors about this issue, it was a volatile-enough problem that it needed to be included in this series.

The majority of calls on this subject were from residents who reported many observations of illegal acquisitions.  The most egregious example – of, well, theft – were of a few MHP owners and managers who routinely “sold” abandoned homes to persons who were living in this country without proof of citizenship.

The “undocumented” resident would pay for their MH in cash installmentsThen, when the resident paid the last installment on their home, the park owner or manager would order the undocumented resident and their family to leave the park immediately under threat of being reported to immigration authorities.

The family would flee the park and the home was then sold to the next undocumented family with the same outcome.

A penalty of $2,000 would hardly dissuade a theft of a home that would yield thousands more, if the theft was prosecuted at all.

Answer:  Generally, the answer is “no”.  First, in order to act as an agent between a seller or buyer of a used mobilehome or manufactured home, you either must be registered with HCD as a “manufactured home dealer” or with the Bureau of Real Estate as a licensed real estate agent.  Acting as an unlicensed dealer or agent can result in criminal penalties, civil penalties, and citations of up to $2,000 for each illegal sales activity.

The only exception to this is if the prior residents/homeowners have “walked away” from the homes, a park owner may sell them if he/she first obtains the right to ownership through a court action for the judgment of abandonment (Civil Code Section 798.61) or after a warehouse lien sale (Civil Code Section 798.56a).

After that, if the park owner intends to rent, sell or salvage the units, the park owner must go to HCD and transfer title to his or her name, which includes paying all property taxes or HCD fees that are owed.  HCD also has special procedures for when the prior registered owner cannot be found or when there are unpaid or unsatisfied loans on the home.

Only after registering as the new owner may the Park owner (who is now the homeowner) rent, sell, or salvage the abandoned homes.

Jury Awards Millions to Residents in Suit Against Controversial Community Operator

AP and numerous local media announced last week that residents in a manufactured home community in California won a multi-million-dollar judgment from a jury.

 

A jury has awarded more than $5.5 million to 31 residents of a Southern California mobile home park[sic] rife with problems including sinkholes, sewage backups and rats,” said AP and KUSI.

Lead attorney against the Kort & Scott owned property “…Brian Kabateck says the residents, many elderly, lived in squalor at the property that was once a trash dump for the city of Long Beach,” per AP.

The local media news video below was posted prior to the settlement, but tees up some of the background and issues involved in what many in that area view as a scandal.

 

 

The property went into bankruptcy, prior to the judgement, per the Long Beach Post.

 

 

The people who bought this in 2014 knew what they were buying. They paid $23.5 million and they saw this as their personal ATM machine and they didnt 1 want to do any repairs, they didn’t want to do any fixes,” attorney for the community’s residents, Brian Kabateck said, per KABC.

The defense attorney for the property owners told prospective jurors that it was known that the development was built on a landfill, explaining that residents were given disclosures about that point.

That apparently didn’t sway jurors.

After being sued for neglect and other causes of action, “owner of North Long Beach mobile home park [sic] files for bankruptcy,” according to the Long Beach Post.

The owners of Friendly Village Mobile Home Park1, who have been sued by tenants over their alleged neglect of the North Long Beach park, filed for bankruptcy” in October, court records show.

A Beverly Hills attorney representing Friendly Village in the bankruptcy proceeding, Howard I. Camhi, did not comment to the Long Beach Post at the time, nor did Phil Woog, the Costa Mesa attorney defending Friendly Village in the civil lawsuit.

Industry veteran Marty Lavin, JD, has previously opined in several commentaries that community operators bear responsibility for business practices that instigate resident, legal, and regulatory furor.  Resident groups, such as MHPHOA and GSMOL, are among those that routinely beat-the-drums about Kort and Scott, which arguably causes issues for other community owners that don’t engage in similarly controversial practices.

Last year MHProNews noted that local media failed to present another Kort and Scott community’s perspective, but in this Long Beach case, it seems that the California firm declined the opportunity.

By contrast, MHProNews reported last week on an uproar in another state, where that manufactured home community operator promptly replied to our request for comments. Why would billionaire Warren Buffett, his family, and related foundations make ‘charitable’ contributions of Berkshire Hathaway stocks, cash, and/or grants to a left-wing activist-organizations that in turn paid MHAction, which disrupted HUD Secretary Ben Carson’s address to the Manufactured Housing Institute (MHI)?

It was a resident group member that tipped the Daily Business News on MHProNews to the statements by the president of the Golden State Manufactured-Home Owner League (GSMOL) that MHAction – Manufactured Housing Action – was getting funding from the Tides Foundation.

Manufactured Home Resident Group President Cautions Against MHAction, Surprising Background Reveal to Manufactured Housing Action

 

The Tides in turn gave to MHAction, stated the GSMOL President Michelle Smith.

Smith blasted MHAction for trying to wrongfully take credit for work that they – GSMOL – had in fact done.

What Smith didn’t say was the “dark money” trail from Buffett – who’s Berkshire Hathaway conglomerate owns Clayton Homes, 21st and Vanderbilt, among several other firms connected to manufactured housing – has purportedly funded MHAction.

But Tides and groups funded by Buffett and billionaire George Soros haven’t funded through intermediaries  MHAction alone.  There are other radical activist groups that have been funded too.

  2. “Frank & Dave,” RVHorizons, and Mobile Home University (MHU),
  3. or the Blackstone Group

feel about having Berkshire money flowing into anti-business protests that have been aimed at them?

MHAction – through the Tides Foundations, and via other mechanisms – are connected

  • to Black Lives Matter,
  • New York Communities for Change (NYCC),
    AntiFa (so-called Antifascists, who ironically use the brownshirt and violent tactics that fascists used),

It’s no secret that the Western Manufactured Housing Communities Association (WHA) and GSMOL are often at loggerheads with each other.

But are each group missing something in this revelation?

How is it that Democrats are getting backers like:

  • state resident groups are also often backing Democratic candidates?
  • In California, sources say that the WMA backs Democrats too.
  • Who is fooling whom?

Paying to Stir Up Trouble…

Manufactured housing is a microcosm of what is taking place in other parts of the national scene.  There are paid agitators in Washington, D.C. and other places. There are organizations that have formed with money from billionaires and others that are organizing the protests that disrupted

 

 

More on this in the days ahead. But suffice it to say for today that the billionaires are paying to stir up trouble for the members of the industry on several levels.

Part of the image issue of our industry is fueled by the protests of MHAction and others.  That impacts not only those who are being protested, but arguably, the industry at large.

And the party that Buffett and Soros backs are the Democrats.  The Democrats are the ‘beneficiaries’ of AntiFa and related groups, that operate similarly to how MHAction are being used in MHVille. In fact, as a prior report revealed, MHAction attends other leftist groups protests, and vice versa.

Where is MHI on this?  Oh, yes, pardon me.  They are being funded by Berkshire Hathaway too.

Speakers Address Rights of Manufactured Home Community Residents

Over 150 residents representing 30 manufactured home communities (MHCs) attended an informational seminar in Pismo Beach, California hosted by Golden State Manufactured Home-owners League (GSMOL), San Luis Obispo Mobilehome Residents Assistance Panel and North Santa Barbara County Manufactured-Homeowners Team. David Loop discussed the steps involved in attaining community ownership status, while Bruce Stanton, GSMOL’s corporate counsel, addressed rental agreements, as well as rules and regulations within communities. As MHProNews has learned from santamariatimes.com, Carl Eric Leivo also spoke of the rights of MHC residents.

Proposed Measure would Challenge Conversions

Updating a post from March 22, 2013, we reported on the legislation in the state house the Golden State Manufactured-Home Owners League (GSMOL) in California is promoting, and what has been added. As we stated, AB 1205 would provide mediation services between resident and management to resolve disputes; and AB 692 provides grants and loans to make repairs to MH and/or add accessibility features. MHC Residents Seek Closure Ordinance

The dailypilot informs MHProNews from Costa Mesa, Calif., just south of Los Angeles, a number of MHCs, especially those with a view of the ocean, may be on the verge of conversion to condominiums or other types of development. The Golden State Manufactured-Home Owners League (GSMOL) has been meeting with residents of some of the 18 MHCs in Costa Mesa seeking support to encourage city council to pass an ordinance governing the closure of MHCs. A measure was approved by the planning commission about ten years ago but failed to pass the city council. That initiative began following the closing of two MHCs in which some of the residents allegedly faced an uncertain future when they did not receive fair compensation.
