Bipartisan Call for FEMA to Intervene, Now

The New York Times reports that Senator “Marco Rubio and Democratic U.S. SenBill Nelson on Monday said in a letter to FEMA’s director that the alternative housing must be deployed.”

 

Those alternative units requested that Brock Long, the director of FEMA, deploy RVs and FEMA Manufactured Housing Units, or MHUs.  Regrettably, MHU wasn’t the terminology used.

In a release to the Daily Business News on MHProNews, Senator Rubio’s office said that, the two Florida senators plus “U.S. Representatives Neal Dunn (R-FL), Matt Gaetz (R-FL) and Al Lawson (D-FL) requested FEMA Administrator Brock Long quickly approve the State of Florida’s request for direct housing assistance for areas hit by Hurricane Michael.  Housing assistance requested includes recreational vehicles, mobile homes, direct lease and other needed resources in the affected areas.”

Dear Administrator Long:

It has been more than two weeks since Hurricane Michael made landfall in North Florida, and many are still struggling to repair and rebuild their lives. Schools in the most heavily impacted areas remain closed, and people are still working to find alternative housing solutions due to their homes being uninhabitable. The magnitude of this storm requires the use of all available resources from FEMA to ensure recovery. As such, we ask that you quickly approve the state of Florida’s request for direct housing assistance in the affected areas.

Hurricane Michael caused catastrophic damage across the Panhandle of Florida. The requested resources, which includes recreational vehicles, mobile homes, direct lease, multifamily lease and repair, and group sites, must be deployed immediately in order to reduce suffering and allow displaced individuals to recover from the storm. Effective housing alternatives are critical in the Panhandle’s recovery effort, and the swift approval of Florida’s request will ensure that needed housing resources are deployed. Northwest Florida suffered catastrophic damage to its housing stock, and those Floridians will need every available federal resource to aid in their recovery.

Timeline of Rubio Actions Related to Hurricane Michael:

  • On October 24, 2018, Senator Rubio, Nelson were joined by Representatives Dunn, Gaetz, and Lawson in urging Secretary Ross to approve the Governor’s request for a federal fishery resource disaster declaration due to Hurricane Michael’s impacts on the Florida Panhandle and its fishing communities.
  • On October 22, 2018, Rubio urged Secretary of the Air Force, Heather Wilson, to repair and restore the F-22 Raptors damaged in Hurricane Michael to mission capable status as soon as possible.
  • On October 22, 2018, Rubio encouraged FEMA Administrator Brock Long to implement recommendations outlined in a report by the Office of Inspector General in order to help Florida repair and rebuild from the devastation caused by Hurricane Michael, and future storms.
  • On October 16, 2018, Rubio urged Secretaries Carson, Mnuchin, and Director Mulvaney to provide federal relief for Floridians impacted by Hurricane Michael.
  • On October 16, 2018, Rubio met with Franklin County and Gulf County officials to discuss the ongoing recovery efforts after Hurricane Michael.
  • On October 15, 2018, Rubio surveyed the damage caused by Hurricane Michael and met with local officials in Marianna Florida.
  • On October 15, 2018, Rubio urged Secretary of Education Betsy DeVos to assist Florida schools affected by Hurricane Michael, particularly, by quickly approving Project SERV applications, which are critical to recovery efforts
  • On October 15, 2018, Senators Rubio and Nelson, with members of the Florida delegation, sent a letter urging FEMA Administrator Brock Long to approve Florida Governor Rick Scott’s request to initiate the Transitional Sheltering Assistance (TSA) program for the remaining 13 counties impacted by Hurricane Michael.
  • On October 12, 2018, Rubio surveyed the damage caused by Hurricane Michael in the Florida Panhandle.
  • On October 12, 2018, Rubio and Nelson with Rep. Neal Dunn urged Secretary Wilson and General Goldfein to expedite repair and restoration operations at Tyndall Air Force Base, which was critically impacted during Hurricane Michael.
  • On October 11,2018, Rubio and Nelson urged Secretary of Veterans Affairs (VA) Robert Wilkie to authorize increased outreach efforts and benefits assistance for Florida veterans impacted by Hurricane Michael.
  • On October 11, 2018, FEMA Administrator Brock Long briefed Rubio on damage caused by Hurricane Michael.
  • On October 10, 2018, ahead of Hurricane Michael’s landfall, Rubio urgedAttorney General Sessions, Health and Human Services Secretary Alex Azar, and Internal Revenue Service Commissioner Charles Rettig to assist communities affected by the storm.
  • On October 10, 2018, following Hurricane Michael’s landfall, Rubio, Nelson and Florida Representatives urged President Donald Trump to approve Florida’s request for a major disaster declaration. Today, the President approved the State of Florida’s major disaster declaration.
  • On October 9, 2018, Rubio joined Senator Nelson and Florida Representatives in urging President Trump to approve Florida Governor Rick Scott’s request for a pre-landfall emergency declaration ahead of Hurricane Michael.

It should be noted that the latest information this morning indicates that Florence may be weakening. But even if the storm stalls, it could result in tremendous rainfalls, that can lead to flooding and other life-threatening safety issues.

This week, three major storms threaten American communities across an area spanning nearly 5,000 miles: Hurricane Florence (the Southeastern coast), Tropical Storm Olivia (Hawaii), and Tropical Storm Isaac (the Caribbean).

Hurricane Florence in particular poses a catastrophic threat to millions living in North Carolina, South Carolina, Georgia, and Virginia. The storm is expected to produce total rainfall of 20 to 30 inches, with isolated amounts up to 40 inches. “These numbers are hard to comprehend, but based on past experience, this amount of rain produces life-threatening, catastrophic flooding,” the National Weather Service tweeted.

President Donald J. Trump met with Homeland Security Secretary Kirstjen Nielsen, FEMA Administrator Brock Long, and other senior officials yesterday in the Oval Office to discuss preparations. “Hurricane Florence is setting out to be a devastating event,” Administrator Long said, comparing its potential to Hurricane Hugo in 1989.

The Administration is focused on helping state leaders and the general public alike before, during, and after the storm makes landfall. “We’re supporting the governors with achieving their life safety evacuation and movements,” Administrator Long said. “We’re focused on mass care and sheltering. And then we’ll be focused on helping them to execute their response and recovery goals.”

Earlier this week, President Trump approved emergency declarations for SouthCarolinaNorth Carolina, and Virginia. “I’ve spoken with the governors,” President Trump said yesterday. “They’re prepared. We’re prepared.”

Hurricane Irene was a storm that hit North Carolina a few years ago that can give some insights into what the Federal Emergency Management Agency (FEMA) is doing to prepare for the expected strike Friday of Hurricane Florence. FEMA stressed yesterday that they’ve learned from every prior event.

 

Manufactured Housing Units (MHUs) are one of several options that federal officials can respond with when it comes to disaster relief/emergency housing needs.

Texas, Florida Hurricanes Slam September Hiring, First Jobs Drop in Years

The unemployment rate fell to 4.2 percent from 4.4 percent, the Labor Department said Friday, the lowest level since February 2001,” AP said.

Manufactured housing industry lenders have told MHProNews that the hurricanes are adding wrinkles to their collections processes, as those impacted by storms are struggling to regain their footing.

Sellers, as has been previously reported, are feeling a very different set of impacts as FEMA and longer wait times are adding to independent retailers stress.

There is legitimate reason for concern,” Crawford told MHProNews. “If they [FEMA] commandeer a large portion of production/plants, all of us independents are going to feel that hit and, depending on your suppliers, that could be a BIG hit.”

We can see why FEMA buys direct from manufacturers to expedite new homes to those [storm victims] who lost their homes,” Rodriguez said. He is “Absolutely” sympathetic to the needs of those tens of thousands of hurricane victims.

However,” the Tejas Homes leader asked, “who is looking out for the long-term viability of the [independent] retailer organizations?”

More Impact from FEMA to Come?

Ross Kinzler told MHProNews that he expects other kinds of impact ahead on manufactured housing independents — producers, and retailers.

Kinzler – the actively retired Wisconsin Housing Alliance’s (WHA) prior executive – said, “…HUD code labels should not used for FEMA,” a point he’s made for several years.  The harm it produces to the industry, “has played out time and again.”

Watch as the Harvey units flood back into the retail market in 24 to 36 months, depressing new home shipments,” Kinzler predicts.

If the past is any experience, the industry could go from feast to famine rapidly, if the proper steps aren’t taken.

You can’t sell in bulk to FEMA…AND sell full price units later without taking a hit,” Kinzler said.

Emergency Request For Proposals for Manufactured Homes, Deadline Tomorrow

EmergencyTxGLOProposalsRequestedDailyBusinessNewsMHProNewsThe Texas General Land Office (GLO) is Requesting Proposals from qualified Respondents to manufacture and supply residential Manufactured Housing Units (MHUs) as temporary housing for Texas residents affected by Hurricane Harvey in designated areas along the Texas coast and inland,” said the agency in a release.

DJ Pendleton and the TMHA are “currently aware of at least one major staging area in Herne, Texas.  We suspect additional areas will soon be developed, and have heard one such area might be near the San Antonio area,” they said in a statement to MHProNews.com.

The services solicited herein include the manufacture and delivery of the MHUs to staging areas designated by the GLO in Rockport, Corpus Christi, and Houston, Texas,” the Texas GLO said.

The solicitation, see below, includes transportation, installation and maintenance of said MHUs.

The Daily Business News (DBN) on MHProNews has been told by informed sources that Berkshire Hathaway owned Clayton Homes plans to increase their industry dominance in the retail sector.

Strategies to accelerate their dominance will be accelerated in the coming months, per sources in the Manufactured Housing Institute (MHI), among independents and those within Clayton’s team.

In Tulsa, Oklahoma’s ‘manufactured home row,’ the majority of the HUD Code retailers there are now corporate stores, instead of independents.  The buyout by Clayton of award winning Home Mart is just accelerating the process that the Atlantic projected in a story that sparked controversy a few years ago.

A growing number of retailers are selling out to Clayton Homes, as MHProNews has been reporting.

Now those concerns and report comes on the heels of word that Clayton’s manufacturing ‘doesn’t have a choice,’ per high level sources within Clayton Homes, but to provide homes for disaster relief to the Federal Emergency Management Agency (FEMA).

That says award-winning retailer Bob Crawford, “…all of us independents are going to feel that hit and, depending on your suppliers, that could be a BIG hit,” the message to MHProNews read.

Countermeasures?

There are several reports of how independents are planning to – or already are – adapting to the growing “threat” of Berkshire Hathaway’s dominance of the manufactured housing industry, including at the retail and production levels.

MHI has been dominated by Berkshire Hathaway owned units, along with former Clayton executive, Joe Stegmayer led Cavco.  The Manufactured Housing Association for Regulatory Reform (MHARR) has published a list of concerns about Pam Danner that numbers over 2 dozen “Abuses” points, see that, linked here.  While MHI claims to oppose Danner’s over-reaches, industry observers note that MHI has dodged the obvious solution of asking for Danner to be removed from her current role over the manufactured housing program at HUD.

Neither MHI nor Clayton has yet responded to MHProNews about these growing industry concerns.

FEMA, Clayton Growing “Threat” to Independent “Non-Corporate” Companies – from Omaha

Reporting from Omaha, Nebraska. “Not everything is some dark conspiracy,” an informed source said to MHProNews.

Clayton and their [Warren] Buffett owned sister companies didn’t plan [Hurricane] Harvey. But they are benefiting from it in direct and indirect ways, that will allow them to increase their hold over manufactured housing [retail, production]. Ultimately, FEMA will de facto help them topple one or more independents [producers],” that source said.

Competing Narratives?

An independent, respected and award-winning retailer, Frank Woody of Texas-based Republic Manufactured Housing Corp, told MHProNews in an on-the-record remark, the following.

Tony [Name of Clayton executive] “…told me this week that NONE of his plants should be putting me or anyone else off because of FEMA. He said they are shifting production around and using the new Athens plant.  He said by law they have to take FEMA orders,” Woody said. I don’t know if they are building them at Athens, or the Ft. Worth S. Energy plant.  I should know the answer in a few minutes.”

Also, Legacy has turned down FEMA in Texas, but accepted them in new S. East US plant,” Woody stated in an emailed statement.

Woody added that his high-level source at Clayton “would not lie to me.”

Gus Rodriguez of Tejas Homes in Conroe, TX, has been told something by CMH which seems to be at odds with what Woody is saying.

We can see why FEMA buys direct from manufacturers to expedite new homes to those [storm victims] who lost their homes,” Rodriguez said. He is “Absolutely” sympathetic to the needs of those tens of thousands of hurricane victims.

However,” the Tejas Homes leader asked, “who is looking out for the long-term viability of the [independent] retailer organizations?”

Award Winning Industry Veteran Sounds the Alarm for Independents

In a message to MHProNews, an award winning industry veteran said about…“FEMA:  IF they commandeer a large portion of production/plants, all of us independents are going to feel that hit and, depending on your suppliers, that could be a BIG hit.”

The source insisted, “That would make the danger much greater for the independents.”

Industry lenders have also expressed concerns about the impact of Harvey and Irma. That will be part of an upcoming report on the lending/disaster connections.

How FEMA Could Foster Berkshire Hathaway’s Grip on Manufactured Housing

If retailers are starved for inventory for months, several will fail or sell out as time progresses,” a source stated. “If more independent retailers are starved out, that only means Clayton will grow more, without appearing to be [doing so via] monopolistic practices [to DOJ].

Some independent HUD Code builders will sell out, will be compelled to do business with Clayton retail, or will be forced out, because there will not be sufficient retailers left to sustain them.  Those independent [producers] will ride high for months. But when the reality of fewer independent retailers hits, that’s when they [HUD Code builders] will be faced with only a few options. Berkshire will win by default.”

Sources connected to independent producers tell MHProNews that FEMA has allegedly not been even-handed in its information flow to non-MHI member companies.

FEMA Source Initially Responds, Then…

A FEMA source initially responded briefly to MHProNews, but has since gone silent on follow up questions.

That, industry members and analysts say,  may also be another indication that those who aren’t in MHI’s “pocket” will tend to get less access to information – and other benefits? – than those connected to MHI.

It should be noted that while the Manufactured Housing Association for Regulatory Reform (MHARR) is normally responsive to MHProNews inquires on this subject – perhaps due to meetings or other factors – there has been no official word from that organization which represents independent HUD Code producers.

More Insights, Allegations

Another informed source said in a message that, “It’s difficult for MHI [Manufactured Housing Institute] to deny what’s already obvious to the[mainstream] news media, politicians, bureaucrats, and non-profit groups have said [about allegedly monopolistic practices].”

“Monopoly” is a word being heard from Washington, D.C. politicos, non-profits and others. Use the Daily Business News search tool to see more reports on that issue.

Berkshire Hathaway dominates MHI through their various production, lending, retail, and supplier units. During the Obama years, they had great influence in Washington.  MHI postures actions designed to look like they are fighting HUD, CFPB, etc.” the source said to MHProNews.

But the reality is, they [BH manufactured housing units] are making money and dominate the [MH] industry as a result of Dodd-Frank. Heavy handed HUD or other regulations weighs more heavily on smaller or lower volume companies. Whether MHI succeeds or fails at their lobbying, BH [Berkshire Hathaway] profits,” that source stated.

That, say several sources, are part of a pattern that allows federal agencies to de facto benefit larger companies, which disadvantages others who have fewer resources.

A source told MHProNews that independents “can’t take a victim mentality.”  They must be pro-active, to find the ways they can maneuver past the various threats and still survive and profit.

Non-BH lenders are providing feedback to MHProNews about their concerns that this growing FEMA connected crisis can create for independents of various niches within manufactured housing. Another report on that issue should be published next week.

Report – Memo Confirms FEMA Can ‘Take Over’ Manufactured Housing Production

FEMACommandeerManufacturedHousingProductionCentersLast week’s exclusive report on the Daily Business News advised industry professionals that letters and calls to HUD Code producers can mean that the Federal Emergency Management Agency (FEMA) can essentially ‘take over’ a production facility.

Industry association professionals, speaking off the record, confirmed the concerns of HUD Code producers.  A manufactured home retailer told MHProNews that, “CMH was crawfishing delivery dates today.”

That statement about Clayton manufacturing was on Friday, a similar concern was heard from another retailer, but CMH has not yet confirmed or denied that report.
