State Sues MHC Owner over Rent Arbitration

Rehoboth Shores near Long Neck delaware   ron MacArthur  cape gazetteThe Delaware Attorney General’s office has filed a lawsuit against Chicago-based Hometown America Communities Inc., the owner of three Delaware manufactured home communities (MHC ) for allegedly pressuring tenants into waiving their right to arbitrate rent increases, according to delaware1059.

Residents at Angola Beach Estates, Rehoboth Bay and Barclay Farms in Camden saw their rents rise due to “anticipated litigation costs,” according to the complaint. As MHProNews understands, in exchange for what the residents were told was a discount from a much larger rent increase, they had to agree not to arbitrate the increase.

DE AG Matt Denn said that is not allowed under the MH laws of the state. The complaint was filed, Fri., Nov. 13, 2015. ##
