A federal judge in Texas has struck down Affordable Care Act. “In a ruling sure to be appealed to Supreme Court, Texas court says the ACA, also known as Obamacare, can no longer stand without the penalty against the uninsured,” said NBC News.

 

 

The Friday night ruling was the result of a legal challenge begun by a coalition of Republican controlled states, shown in the still video graphic.

Manufactured housing producers are among those firms that have had to struggle with the impacts of the law.  Various suppliers and other mid-to-larger firms were also impacted. It was an issue at Manufactured Housing Institute (MHI) meetings when the bill first passed.  That  was an ironic twist, because Warren Buffett, Nathan Smith, and several other leaders connected with MHI supported the Obama Administration’s passage and defense of the so-called Affordable Care Act (ACA).

MHProNews has long taken the position that the ACA bill’s intention may have been good, but that it was fatally flawed in execution.  We cited Thomas Sowell’s wise analysis of the bill, shown below, as but one reason why the law would never work.

ObamaCare remains in place until the court challenges are finished, per initial reports.  This is likely to head back to the Supreme Court. There, it could well face it’s final defeat, on the same or a similar basis that this federal judge in Fort Worth ruled last night.

U.S. District Judge Reed O’Connor in Fort Worth said, “The Individual Mandate can no longer be fairly read as an exercise of Congress’s Tax Power and is still impermissible under the Interstate Commerce Clause — meaning the Individual Mandate is unconstitutional,” per NBC News. “The Individual Mandate is essential to and inseverable from the remainder of the ACA.”

Without it, Congress and the Supreme Court have stated, the architectural design fails,” according to O’Connor. “It is like watching a slow game of Jenga, each party poking at a different provision to see if the ACA falls.”

The CBS News video doesn’t mention that President Donald J. Trump and many Republicans have publicly embraced the most popular part of ObamaCare, coverage for pre-existing conditions.  It remains to be seen what a divided Congress in 219 – with Democrats controlling the House, but Republicans stronger now in the Senate – and President Trump will do.

 

No Immediate Change for Now, So Time to Replace the Law

For those who believe the law was helpful, there is time to change it. For those professionals and others who opposed the law on legal, practical, or for other reasons, there is cause to celebrate while preparing for replacement options that could cost taxpayers less, while delivering better coverage.
