City Denies Request to Site Manufactured Homes

mhc__triangle_mobile_home_park___battle_creek_michAldermen in Pierce City, Missouri have denied Ken Madison’s attempts to replace manufactured homes (MH) on his property because the sites have been vacant over 60 days, and he intends to sue for $25,000 loss of income. Madison originally purchased the manufactured home community and has used it as such since the acquisition, according to what monett-times tells MHProNews..

The city contends that the manufactured home community (MHC) is a ‘non-conforming’ use, and because the sites have been absent of MH for over 60 days, the non-conforming use is discontinued and Madison is prohibited from replacing the homes with additional MH.

The petition, which is to be filed May 1, 2015, reads, [Madison] has never discontinued use of the property as a mobile home park and should, under both Missouri laws and under [Pierce City’s] Municipal Code, be allowed to continue use of the property as a mobile home park, including the placement of mobile homes on empty mobile home spaces or pads.

City Clerk Julie Johnson, noting P & Z can restrict the year and types of manufactured homes that can be sited in the city, and said the commission will consider the matter at its May meeting and have an answer in June. ##
