Insightful Quotes for Manufactured Home Business, Investors, and Professionals

The quotes that follow from the first two nights of the 2020 Democratic primary are not to be construed as an endorsement of that candidate or their positions.  In some cases, the quotes are aimed to underscore claims backed by evidence.  The candidate may be right on the facts but may or may not be correct in their proposal to deal with those facts.

 

With that said, consider these pull quotes, taken from the full debate transcripts from NBC, linked here.

  • It has been far too long that the monopolies have been making the campaign contributions, have been funding the super PACs, have been out there making sure that their influence is heard and felt in every single decision that gets made in Washington.” Senator Elizabeth Warren (MA-D).

 

  • I know what it’s like to rent a home and to worry about whether you’re going to be able to pay the rent at the first of the month and to see a mom work very, very hard and know that moms across this country are getting paid less simply because they’re women.” Former HUD Secretary Julián Castro.

 

  • I mean, first of all, we’ve got to recognize that the China challenge really is a serious one. This is not something to dismiss or wave away. And if you look at what China is doing, they’re using technology for the perfection of dictatorship.” South Bend, Indiana Mayor Pete Buttigieg.

 

I think we have a serious problem in our country with corporate consolidation. And you see the evidence of that in how dignity is being stripped from labor, and we have people that work full-time jobs and still can’t make a living wage.

We see that because consumer prices are being raised by pharmaceutical companies that often have monopolistic holds on drugs. And you see that by just the fact that this is actually an economy that’s hurting small businesses and not allowing them to compete.

One of the most aggressive bills in the Senate to deal with corporate consolidation is mine about corporate consolidation in the ag sector. So I feel very strongly about the need to check the corporate consolidation and let the free market work.” Senator Cory Booker (NJ-D).

 

  • “…we have to restore the backbone of America, the poor and hardworking middle class people.” – Former Vice President Joe Biden.

 

So the way I understand this, it’s there is way too much consolidation now in giant industries in this country. That hurts workers. It hurts small businesses. It hurts independent farmers. It hurts our economy overall.

And it helps constrict real innovation and growth in this economy.

Now, look, we’ve had the laws out there for a long time to be able to fight back. What’s been missing is courage, courage in Washington to take on the giants. That’s part of the corruption in this system.” – Senator Elizabeth Warren (MA-D).

 

  • “…the 40 million of us who can’t start a family, can’t take a good idea and start a business and can’t buy our first home.” – Congressman Eric Swalwell (CA-D).

 

Socialism, in that sense, is not the solution. We have to look at what really will make a difference

I’m a small-business owner who brought that same scrappy spirit to big Colorado, one of the most progressive states in America.” – former Governor John Hickenlooper.

 

  • “…And at a time when we have three people in this country owning more wealth than the bottom half of America, while 500,000 people are sleeping out on the streets today, we think it is time for change, real change.” Senator Bernie Sanders (VT-I, causes with Democrats).

 

  • Right now, we have a system that favors those who can pay for access and outcomes. That’s how you explain an economy that is rigged to corporations and to the very wealthiest.” Former Texas Congressman Robert ‘Beto’ O’Rourke.

 

I think we have to do real things to help American workers and the American people. Right? This is the issue that all of us hear on the campaign trail…

Then we’ve got to fix our public education system. It’s not delivering the results our kids needs, nor is college and post high school career and technical training programs doing that. You know, I’m very different than everyone else here on the stage. Prior to being in Congress, I was an entrepreneur. I started two businesses. I created thousands of jobs. I spent my whole career helping small- to mid-sized businesses all over the country, 5,000 of them I supported. The Obama administration gave me an award for lending to disadvantaged communities.

I know how to create jobs…” – Former Maryland Congressman John Delaney.

 

  • I was 6 years old when a presidential candidate came to the California Democratic Convention and said it’s time to pass the torch to a new generation of Americans. That candidate was then-Senator Joe Biden. Joe Biden was right when he said it was time to pass the torch to a new generation of Americans 32 years ago. He is still right today.” – Congressman Eric Swalwell (CA-D).

 

There were other noteworthy quotes shared by many of the candidates, not just those noted above or that follow.  A weakness in the format was arguably that there was too few serious follow up questions. For example, in areas where the income inequality, the education process, housing policy, or gun laws have been in Democratic hands for decades, how do those candidates explain that they want to move the nation ahead with their plan, when prior efforts clearly failed?

Wittingly or not, NBC moderator Jose Diaz-Balart made that point with respect to New York City with this question: “Mayor De Blasio, good evening. You’re the mayor of the biggest city in the United States, but it’s also one of the cities in the country with the greatest gap between the wealthy and the poor. How would you address income inequality?”

In that sense of candidates with longer records and little to show for it are perhaps among the most vulnerable contenders.  An example of such is former Vice President Joe Biden. When any candidate says they can ‘fix’ the economy to be more fair to the worker, or fix the problem of big business consolidating smaller ones and their overbearing market and political power, how can they say that with a straight face?  Especially when they had years in office to do so, but failed to do it?  Or, how can a candidate rail against ‘Wall Street,’ or big businesses, when they have accepted years of campaign contributions from some of those same big corporate interests directly or through PACs?

 

  • Yes, they will pay more in taxes, but less in health care for what they get.” – Senator Bernie Sanders. What wasn’t nailed down in that bit of candor is the point made by Thomas Sowell.

Be it heath insurance, which is not the same as health care, or most any other instance one cares to mention, government routinely is less efficient than the private sector. The waiting time for treatments in Canada and England for certain procedures with their socialized medical care can be months to years.  That’s why the solution linked here, which costs less and is already proven to work, is but one example of free enterprise offering solutions that big government has failed to deliver.  Why have so many members of both major parties largely ignored that proven pathway?

Whatever the answer to that question, that being so, what must occur is fostering more competition, not less of it.  That’s why the issue of consolidation and monopolization should be important to every American.  It is an area that Democrats – at least in their talking points – have been engaged on more than the GOP, which some have taken notice and are mimicking. While some monopolistic minded businesses may give away something free or at lower cost to gain market share, in time, other options are eliminated. Once no other options exist, where will the competition be to keep prices in check?

That’s why some of those quotes from Democratic candidates cited above are important. As Senator Warren has put it, the laws needed to address these challenges are already on the books. They should be enforced.

What members of both major parties should do, with respect to manufactured housing, is hold hearings to explore how market dominance was or is being achieved, and through prompt public hearings put pressure on federal agencies to act sooner, than later.

 

The Manufactured Housing Connections, Opportunities and Obstacles

Manufactured home professionals should take heart that HUD Secretary Ben Carson has been pushing a narrative for some 2 years, and has recently connected it directly with manufactured housing.  Carson’s recent speech in New Orleans de facto addresses how manufactured homes could play an important role in addressing the issue of income inequality in a way that – at least so far – not one of the Democratic candidates have made a similar tie-in.

Dr. Carson’s evidence based notion is this. Home ownership is perhaps the most proven form of personal or household wealth creation. As Carson said in his speech linked here and above, the typical home owning family has a net worth of some $200,000 vs. the typical renter having a net worth of only some $5,000. Carson further pointed out that FHFA data reflects the point that manufactured homes can appreciate in value too. Rephrased, Carson confirmed prior data points made by researchers, for example, linked here.

The thumbnail analysis above should not be construed to mean that the GOP has every answer, nor that the Democrats do.  There are areas that each major party tends to have a superior or inferior track record.

What citizens must recognize is that identifying a problem is only the start. When someone says ‘free college tuition,’ the same principle that Senator Sanders said applies.  There is nothing free, someone always pays.  Sanders admitted that the middle class will have to pay more in taxes for so-called ‘free’ health care. The same principle applies to free education or any other government handout.

How many taxpayers will be willing to pay for free healthcare for hundreds of thousand to potentially millions of new illegal immigrants a year?  When the Trump Campaign starts hammering home those and other points, Democrats will have to pivot or look like they lack basic math skills. Yet on the second night of the primary debates in Miami, all 10 Democrats on stage raised their hand to say that their health care plan would cover all border crossers.

Do they realize that if that would be true, then what is to stop someone from coming to the U.S. by plane boat, or via the northern border?  Get to the U.S., and you’ll get free healthcare, and a raft of other promises of free stuff?

That’s a concern that a few Democrats have prudently raised. Time will tell if they pivot.  If they don’t, will promises of free stuff that can’t possibly be honored triumph over reality?  We’ll see.

The path to prosperity is arguably found in a combination of factors:

  • breaking up the power of huge conglomerates that drive down employment and keep wages lower in the process.
  • Illegal immigration creates a large pool of lower wage workers too, so controlling borders to prevent illegal entry and vetting who is allowed into enter the country is just common sense that most nations follow.
  • Creating a path to sustainable home ownership that is as simple as possible is prudent too.

These are issues that some Democrats have already proven their ability to engage in positively, as have some Republicans.

  • Facts vs. fantasy.
  • Truth over false promises.
  • Equality of opportunity and rights, not contrived or forced outcomes.
  • Economic basics being applied.

These are some of the things that more of America’s elected and appointed political leaders must learn to embrace.  The late Democratic leader, Daniel Patrick Moynihan, wisely said the following famous maxim.

NBC’s Savanah Guthrie asked Colorado’s former governor the following. “Governor Hickenlooper… You’ve warned that Democrats will lose in 2020 if they “embrace socialism,” as you put it.”

Hickenlooper replied, “Well, I think that the bottom line is, if we don’t clearly define that we are not socialists, the Republicans are going to come at us every way they can and call us socialists.”

Right or wrong, belief in socialism is rising, but is still not half of the population.  But when on scratches deeper, what has a broad coalition across the left-right spectrum is a belief that the system is rigged. Many who think they want socialism actually want justice. They want to level the playing field.

That’s where the fertile ground could be found for those willing to tackle in an honest and sensible fashion what has gone wrong for so many in America.  That includes why so many don’t get it that manufactured housing is a valid solution for the American Dream of home ownership, along with the how and why that understanding has been thwarted.

There is plenty of fertile ground for the GOP or Democrats to work in concert, or to campaign on a platform that will be more than empty promises.

It is real challenges and pragmatic solutions that we strive to monitor, fact-check, and report on here at MHProNews.

Warren Buffett’s Profitable Lessons for Manufactured Housing

“”We can afford to lose money – even a lot of money. But we can’t afford to lose reputation – even a shred of reputation,” wrote Warren Buffett to managers,” according to a post on the Wall Street Journal’s Facebook page.

 

Now contrast that with the investment-focused Motley Fool’s citation of the famous Buffett quote: “Rule No. 1: Never lose money. Rule No. 2: Don’t forget rule No. 1.

Do these two fabled Buffett quotes complement or contradict each other?

We deliberately avoid answering that today.

Ladies and gentlemen professionally involved in manufactured housing land – what we lovingly refer to here on MHProNews as MHVille – those Buffett quotes bear close scrutiny.

Beyond the words, so too does the actual behavior of Buffett and Berkshire Hathaway’s brands.

It is not that Mr. Buffett is necessarily wrong.  As one of the top four wealthiest people in the world, he’s proven his ability to attract investment capital and make money for the long term.

The question is, how has Buffett achieved that wealth in recent years? Say the last two decades?

No two people agree on everything. We need others in our lives as reality checks. If Marty Lavin never gave MHProNews any more on-the-record quotes than those already given, the ones we have from him are highly valuable to those wise enough to grasp and apply them routinely. It isn’t that Marty invented these sayings; he did not. But as a significantly successful person in manufactured home financing – with real manufactured home (MH) community and high-volume MH retail experience –  what he said is as useful – perhaps more so – as those Buffett quotes are.  Once more, with gusto…

  • Pay more attention to what people do than what they say.
  • Follow the money.

These Lavin tips have been used by detectives, serious reporters, and other researchers for decades.

What they point to, without saying it, is the value of authentic history.

Let’s pair that with what pro-manufactured housing investor Robert Robotti said about investing. “In order to outperform the market, you have to have a contrarian point of view,” Robotti said to the Motley Fool investment media.

In an organization, one needs a significant degree of compliance by team members. No factory could function successfully without team members doing their jobs well. No financing operation could profit, unless team members do their jobs well.  I know, because I’ve seen and experienced these things first hand.

But in order to achieve a breakthrough, one has to be able to step out of the box. If someone stays only inside the box, by definition, no progress is ever made.

We need to be able to celebrate the good that someone has done, while recognizing that they are bound to have flaws. Let’s give some examples, and then return to the profitable MH theme.

We like many of the quotes that the Reverend Martin Luther King, Jr. has given us to ponder. He was surprisingly successful, but that success was not overnight. It took time, persistence, a kind of urgent patience. King was wise, but he was reputedly also a womanizer. Can’t imagine that his wife liked that reputation, can you?

A couple in the White House today have a similar challenge. But unlike the defense that much of the mainstream media gave Bill Clinton while he was president, or the cover for womanizing given to John F. Kennedy while he was president, Donald J. Trump’s past womanizing is treated quite differently. Before he ran for  president, Mr. Trump was celebrated for the same thing he is now denigrated for doing. What’s up with that? That’s not to attack the other 2, nor to defend the 45th president on that score. It is only to reflect that a double standard exists.  It is also to reflect how helpful history is.  Now, let’s take that back to MHVille.

People have to be able to discern reality, to find what is true, and separate the ‘wheat from the chaff.’  There are things Mr. Buffett has said that are insightful, useful, and true.  That doesn’t mean I have to agree with Buffett’s reputed business practices. Wheat from chaff.  Discern what is useful, then act upon that, and your odds for success go up.

Before diving into our weekly headline review, and we have some doozies for you, let me make one more observation. There have been some famous – but later convicted – con men in our nation’s history. People who were so respected, until they were found out.  Once exposed, they where then reviled. Let’s mention only one to make the point.

Bernie Madoff is described like this by Wikipedia, “Description: Bernard Lawrence Madoff is an American former market maker, investment advisor, financier, fraudster, and convicted felon, who is currently serving a federal prison sentence for offenses related to a massive Ponzi scheme.”

Madoff was celebrated, until he was vilified.  By the way, not all cons are alike.

Now will the day may come that fans of Buffett — or an infinitely lesser light in MHVille, part-time magician George F. Allen — feel the same about them as they do now about Madoff?

Some sing the praises of the Manufactured Housing Institute (MHI). But look at the fact that every one of the corporate industry embarrassments in MHVille named by John Oliver’s “Mobile Homes” video was connected to a firm connected to MHI. Pray tell. What exactly are the leaders at MHI being celebrated for accomplishing?  Other than the increasing consolidation occurring in MHVille?

Cons are often celebrated, until they are finally understood, and then they are fully exposed. Some cons, like Madoff, go to prison.

To grasp those highly profitable lessons, one needs the perspective of history. That requires real history, not fake history. Discerning the truth requires real analysis, not fake analysis.

To be sustainably successful in MHVille, one needs to know when to duplicate – as in a training the line workers in a factory – and when to innovate. The later – innovation – means you have to be willing to be a contrarian at the proper times.

Before closing, let me tip the hat to Jim Ayotte for a statement he made that applies to everyone, not just top-tier association executives. “As an association executive, my job is to assess the situation and seek the best possible outcome based on the facts as I know them.”  Publishers, writers, sales professionals, business owners, line workers – everyone could apply this principle Ayotte made to themselves.

None of us don’t know what we don’t know.  That’s why we need others! But once we begin to suspect something different than what we thought we knew, it becomes parament to pivot to whatever that liberating – and often profitable – truth is.  Albert Einstein was right in saying you don’t keep repeating the same mistakes over and over if you plan to progress.

The reason that a con like Madoff’s or others arguably succeeds for as along as they do is because people are not willing to admit that they have been conned.  They are in denial. They may be embarrassed. Or they may have some other fear.

But the mature, secure adult admits an error.  If the error is that they were conned, one must make that admission, but then the solution is to move beyond the error.  That’s how profitable learning is done.  Objective history is a vital part of that process.

To my knowledge, there is no other manufactured home industry publisher that has the degree of historic and practical insights into manufactured housing reality than we do.  Not bragging, it is what it is.

If Warren Buffett believes in something, and it meets his inverting criteria, then one can be assured that Berkshire Hathaway has the financial capacity to make the acquisition or investment.  He’s said so himself.

When Berkshire Chairman Buffett says something, it may be literally or proverbially accurate, but rules have their exceptions.

Be it Buffett, or the President and CEO of Berkshire owned 21st Mortgage Corp, Tim Williams, they may not have thought that their words would later be scrutinized against their own stated standards. The reason? It is found in Buffett’s own quote about history, cited above.  They arguably may not expect the history of their words compared to their behavior to be matched up, years later.

It would be more accurate if Buffett said that in general, many don’t learn the lessons of history.  But nuance aside, one can now look back at the words of Buffett, 21st’s Tim Williams, or MHI and see how they measure up to what has transpired since that time.

Or to put it as the Hill’s Joe Concha did, are these words sincerely meant, or the words a costume?

On Jan 2, 2016, PBS News said about our manufactured home industry that “Typically older and poorer than traditional homeowners, manufactured homeowners often face serious, unique financial difficulties that make it a bad bargain for some low-income Americans.”

That narrative fits the talking points of MHAction, which has captured serious media attention. At the time that PBS News did the video posted below, Carla Burr was associated with NMHOA, but more recently, she has appeared on the MHAction website.  The PBS video doesn’t specifically mention Clayton Homes, 21st Mortgage, or Vanderbilt Mortgage and Finance (VMF). But much of what they describe are in fact pointed directly at those Knoxville, TX metro based brands owned by Omaha, NE based Berkshire Hathaway.

 

PBS Asked…

Among those interviewed for the video by PBS posted below was Julia Gordon, National Community Stabilization Trust, who told PBS’ Stephen Fee the following.

Often you have very few financing options. There are only a handful of lenders who work in this space, and because there’s a lot of vertical integration in the industry. Often when you purchase the home, the manufacturer of the home is going to refer you to a lender.”

As noted, that phrasing is a thinly veiled reference to Berkshire owned brands. One doesn’t know what was edited out for her or other’s commentary. But if Gordon been quoted in this video speaking directly about Clayton Homes, 21st or VMF, is there much doubt that Clayton or perhaps even MHI might have weighed in? After all, when Prosperity Now’s Doug Ryan refereed to the monopoly of the Berkshire brands in manufactured housing, MHI rapidly dispatched Lesli Gooch, EVP to respond in digital print.

So MHI and Clayton respond when they want to, but don’t at other times.

PBS & NPR Reporting on Manufactured Housing News, Pulling Back the Veil

 

To be clear, Stephen Fee’s PBS report on the misnamed “Bad Bargain” is a mixed bag of accurate and problematic information. It very much fits what Brad Lovin previously told MHProNews about mainstream media reports.

So, the question is why didn’t MHI affirm what was accurate, and correct what was not?

Why wasn’t

  • terminology
  • comparisons between apartments, land-lease communities, and conventional housing,
  • interest rates,
  • or a range of issues that could easily be debunked or corrected, not addressed publicly by MHI at all?

MHLivingNews and MHProNews put those concerns to then MHI Chairman Tim Williams. Here is every word that Williams said in his emailed response.

Many of our friends in the industry, including my friend Tony at MHLivingNews, have questioned why MHI hasnt made a strong rebuttal response to the PBS story.

There are good arguments that we should respond to every story, refute every statistic, and make our case to the public.  Certainly we can make the case that the PBS story was not fair and balanced reporting.  Just one example is the interview with Dick Ernst.  Dick spent several hours with PBS representing our industry as an official spokesman.  The reporter had about one hour of taped interview with Dick and used only 45 seconds of that interview.  

We can also make a case to counter the segment addressing manufactured home site rent increase.  No one from MHI was asked to comment on the segment and the allegation that consumers become trapped in their homes.  The reporter did not make any effort to understand the cost of operating a manufactured home community and why those costs must be passed on to the tenants, even though MHI provided ample evidence and information to assist the reporter in his research.  

The reporter did not attempt to compare site rent increases to apartment rent increases.  Just last week, the Wall Street Journal ran a Section C front page story about apartment rent increases.  The annual rate of rent increases has averaged 3.93% over the last 4 years.  This is a greater rate of increase than cited for lot rent in the PBS story where leader/actor Ms. Burr was complaining about her site rent increasing just over 3% per year.  

So why not respond with our good facts?

The PBS story ran on a date where everyone was busy with the holidays and very few people saw the story.  The last thing we want to do is bring more attention to a negative story about our industry.

The other problem with responding is the selective nature of what the press will print when you know they have an agenda.  If we submit the above paragraph where I acknowledge Ms. Burrs site rent increases on average more than 3% per year, what do you think PBS will print?  The risk is that they leave out the comparison to apartment rents that increase nearly 4% per year and print our acknowledgment that manufactured housing community site rents increase over 3% per year as they repeat their assertion that manufactured homes depreciate and residents become trapped in their homes.  

I understand the argument that we must work harder to tell our story and emphasize the advantages of manufactured homes.  We have a good product and a good story to tell.  We dont need to tell it to people with an agenda who will only tell half the story.  MHI has been focused on communicating positive messages about manufactured housings benefit. We are targeting media sources that will give us a fair hearing and policymakers in Washington.  This effort to drown out the negative media attention has been steadily increasing and weTimWilliamsPhoto21stMortgageCorpLogoPresidentCEOManufacturedHousingInstituteLogoMHProNews are pleased to have so many members willing to highlight the positive message of manufactured housing in this effort. We believe this is the right approach for the industry. Make no mistake, MHI issued a strong response to the PBS story by going straight to its producers.  This targeted approach has yielded the opportunity for MHI to receive fair airtime on that program at a future date, and we are currently exploring this opportunity.

Additionally, MHI President/CEO Dick Jennison is in the process of hiring a seasoned media relations professional.  This position was approved by the MHI Board for the position to begin in March 2016, but at the request of Dick Jennison, the MHI executive committee approved bring on this position as soon as the right person can be hired.  

It is the intent of MHI to broaden its public relations/communications focus to include positive consumer stories including testimonials on why people choose to live in and how they benefit from manufactured homes and living in our communities.” ##

 

So wrote Tim Williams, then chairman of the Manufactured Housing Institute (MHI), and still president and CEO of the Berkshire owned 21st Mortgage.  That was published on January 15, 2016 at this link here. It is one of several ‘on the record’ gifts from Williams to the industry at large via MHProNews.

Gift? How so?

Because using Buffett’s principle of the rear view mirror bringing clarity, it helps bring matters into clearer focus for thousands of manufactured home industry professionals and investors.  It will also raise vexing and timely legal, ethical and other questions, as you will soon see.

Now, since that statement by Williams was made and first published on the Industry Voices blog of MHProNews, MHI did indeed hire a public relations professional. Patti Boerger came on board at MHI, worked for a time, and has since gone. MHI has since William’s letter-to-the-editor revamped their website.

PBS’ purported hit-piece is still easily found online.  MHProNews and MHLivingNews responses to it are still visible online.  But where is a response to be found online by MHI to a report that millions were exposed to by PBS and their many affiliates?

Williams was factually accurate about much that he said in his guest column. But here are some of the things that weren’t said in response to the PBS News video was this.

 

  • The Preserving Access to Manufactured Housing Act that was part of the background debate at the time for the PBS report was arguably primarily for the benefit of Berkshire Hathaway lenders.
  • The MLO rule compromise was already on the table, per sources at MHI to MHProNews, and confirmed by then NMHOA attorney and executive director, Isbhel Dickens. That part needed no legislation, the Consumer Financial Protection Bureau (CFPB) – per sources ‘on both sides’ of the issue would have allowed that change by negotiated agreement between consumer groups and MHI.  It was MHI that said no, because they didn’t get the points and fees changes that 21st and VMF wanted.
  • There was in hindsight a clearly evidenced conflict of interest in the MHI Chairman promotion of a bill by MHI that benefited mainly his company.
  • MHI’s predecessor to Lesli Gooch, Ph.D., in the government relations role – Jason Boehlert, said that Preserving Access wasn’t going to pass years before, yet MHI kept spending the money at the direction of Knoxville and the political capital up on Capitol Hill.
  • In a real sense, whether the bill passed or not, Knoxville brands owned by Omaha based Berkshire benefited. How so? Because artificial headwinds are better withstood by large companies than smaller ones.  During the time that Preserving Access was working its way to a dead end in Washington, D.C. the Berkshire brands in manufactured housing were growing in market share, while the number of independents in the industry’s retail side continued to shrink.
  • The impact was not only on street retailers, but also on independent communities too. People moving into a manufactured home community – a.k.a. the typically misnamed ‘mobile home park’ – did so because they knew it was a good option for manufactured home placement. The PBS video placed that matter in doubt for those who viewed and/or read their report.
  • There was no discernable MHI or Knoxville retort on line, save the letter spurred by MHProNews’ question to Williams, which sparked the letter posted above.

It is difficult for most people to imagine a world where a company can benefit, even if they seemingly don’t get what they want.  But if a system is rigged enough, then that may be possible.  How?  First, ponder once more the Warren Buffett quoted cited here in the report linked below from 3.10.2019.

Then keep in mind that this is the same Buffett that said, per the investor site, the Motley Fool: “One of the most widely quoted pearls of wisdom of legendary investor Warren Buffett is: “Rule No. 1: Never lose money. Rule No. 2: Don’t forget rule No. 1”. … So, when Buffett talks of never losing money, he’s not referring to temporary “paper” declines in stock values. He must be referring to crystallised cash losses.”

That’s a keen insight that manufactured housing investors, professionals, advocates, and public officials must grasp.  Buffett’s Berkshire can lose “…even a lot of money…” on paper. But if their strategic and economic Moat is growing, have they lost anything at all? Haven’t the Berkshire brands in Knoxville rather gained while they might appear to be losing?

Omaha will defend its own reputation, and there are examples of Knoxville and Arlington defending the Berkshire brands too.  But defending the reputation of the manufactured home industry may not be a short or even a medium term priority.  Any headwinds is just one more shark in the water of Buffett’s moat.

Sometimes the truth is hiding in plain sight. Follow the facts, evidence, and the money.

 

But what PBS entirely failed to address in their misnamed ‘bad bargain’ report is

  • the role of the Government Sponsored Enterprises (GSEs) in the lending issue.
  • They also failed to get it right on appreciation or depreciation about manufactured housing.  Once more, it was primarily MHProNews and MHLivingNews that took up those mantles in the HUD Code manufactured home industry’s trade media. On the association side, it was primarily the Manufactured Housing Association for Regulatory Reform (MHARR) that has pushed the GSEs to do chattel lending on all manufactured homes, not just on the Clayton pushed scheme – per non-MHARR, MHI member sources to MHProNews – for a new class of homes that makes no logical sense on the surface.
  • Why create, says non-MHARR MHI member producers, a new class of homes to get GSE lending, when HUD Code producers already made modular homes?

Or as one outraged MHI member producer put it – in standing up for ‘standard’ HUD Code manufactured housing production, “What are we, chopped liver?”

By the sub-heading of ‘stage managed,’ that is not to imply that Tim Williams, MHI or anyone working for Berkshire knew what was going to be produced by PBS.  They likely did not know before others did.

But what was discernable – based upon PBS’ track record – is how the report might be framed.  And even ignoring that lesson of history, Knoxville and Arlington could easily have mounted a defense via others in media.

Because what Williams also didn’t mention is that Berkshire Hathaway owned dozens of newspapers at that time, and now too.

 

Due Credit, Warren Buffett, Media, and Manufactured Housing’s Historic Achievement

 

Never give up the con,” was not first said by Dinesh D’Souza, nor was it applied by him to the Omaha-Knoxville-Arlington axis.  But it was applied by D’Souza, who said: “Make the pitchIf caught, always deny, never give up the con.”

 

Here are the facts that have not yet been denied by MHI’s attorneys, others working for that Arlington, VA based trade group, or those working for Berkshire brands based in metro Knoxville, TN.

 

  • The Duty to Serve (DTS) lending mandated by the Housing and Economic Recovery Act (HERA) 2008 to support manufactured housing has never been robustly implemented for chattel or other lending for manufactured homes.
  • Industry professionals, including consultants, working for the GSEs have essentially slowed their acceptance of manufactured housing for lending on the industry’s most affordable homes.
  • The interest rates that PBS’ report railed against would arguably be lower in manufactured housing, if the GSEs, FHA, VA, and USDA lending were all being more robustly used in the industry.
  • The GSEs are co-sponsoring MHI events, a clear conflict of interest with their DTS manufactured housing.
  • While MHI claims to be working for more lending by the GSEs, the evidence proves the opposite is true. Who does that lack of GSE support financially benefit?  Aren’t Berkshire owned lenders with higher rate loans at or near the top of that list?
  • The recent letter that MHI signed onto was actually contrary to the claims they are making to their own members. See the recent report, linked here and below.

 

MHProNews publicly invited MHI, voices in Knoxville representing the Berkshire owned brands, the GSEs, or their attorney(s) to respond to this vexing claims and concerns.  Their response? Silence.  That’s their 5th amendment right.  But if they had a good explanation, wouldn’t they give it?

MHProNews looks at the facts, considers the sources, and follows the evidence. MHI earlier last year, and for years before, MHI routinely replied promptly to all inquiries. But since we’ve spotlighted the problems and concerns, they’ve gone silent. Why? If the facts are on their side, why not make offer a cogent explanation?

 

Tim Williams, Dick Jennison, and Friendship

Tim Williams referred in his letter to Tony Kovach as a “friend.” Richard ‘Dick’ Jennison said on stage and on camera, ‘my good, dear friend, L.A. ‘Tony’ Kovach with MHProNews.comgreat publication.” Here are some of the phrases used by the Urban Dictionary to define the term “friend.”

A friend is honest and makes you want to be honest, too…A friend is someone who tells you if you’re being stupid,  but who doesn’t make you feel stupid…A friend is someone for whom you’re willing to change your opinions…A friend is a partner, not a leader or a follower.”

Using Urban Dictionary that definition, MHProNews is the friend of those who want to see the manufactured home industry honorably achieve its great potential. There rest are the details and commentary needed to tell the industry where its greatest threats come from, based on the facts, evidence, and the logic of the money trail.

Who benefits from the status quo and the trends of recent years? If one looks at their growing market share, a few larger firms that are often aligned with MHI or a Berkshire brand.  But who is harmed? Arguably, the bulk of the rest of the industry.

MHI and the Clayton affiliated firms have in deed made efforts for years that ostensibly aimed at growth. They have the advertorials and videos to prove it.

But what have your so-called industry friends in the Omaha-Knoxville-Arlington axis and their allies have yet to do is routinely and robustly correct ever fact error that arises.

  • What is that MHI PR person supposed to be doing?
  • Where is MHI or Knoxville brands routine and robust defense of the industry? Or even on MHI’s own website?
  • Instead, even on Clayton’s own website, manufactured homes are in places called ‘mobile homes.’

Every news story, good, bad, or meh is a potential opportunity for the savvy manufactured housing professional. MHI praised Tony Kovach in writing for says my so, but did not do so themselves.

MHI can’t claim to be ignorant about the need to respond. Tim Williams understood it, and MHI’s education director praised Tony Kovach for teaching it too. So why doesn’t MHI practice what they know could help the industry grow again?

 

Is posturing MHI’s or Clayton costume? Is it their “Illusion of Motion?”

A traditional job of journalists is to hold the powerful to account for their behavior.  Too few in MHVille are doing so, but MHProNews – by doing fact checks and analysis like this – is providing the foundation for the recovery of the industry. It is the act of true friendship.

Wishful Thinking vs Facts, Evidence, Reason, and Manufactured Housing

Two nights ago, Special Counsel Robert Mueller’s Office took the unusual step of publishing a denial of a mainstream media report by BuzzFeed News that had the talking heads on TV, radio, and in print astir for 24 hours.

 

Harvard law professor emeritus, Alan Dershowitz – a Democrat and civil libertarian – once more explained Friday night on Sean Hannity’s show why these fake news accounts are grounded in nothing of substance.  It goes back to the need for discernment.  That’s a point which independent, award-winning journalist Sharyl Attkisson has preached and is reported on at the link here.

That Fox video embed code with Democratic-supporter Dershowitz is not yet available.  But another one from attorney Mark Levin – who was anti-Trump for quite some time – also discusses the same issues, references Dershowitz’s comments, and is posted below. This latest episode started by BuzzFeed raise issues that have and will continue to impact the manufactured home industry, all other professions, and society at large.

 

As important as that is, it is not the focus of this commentary that tees up our Sunday Morning weekly headline news report recaps.  Manufactured housing specific reporting is our emphasis again today.

As If…Wishful Thinking and Fake News vs,

Fact, Evidence, and Reason

 

As If?

As if George F. (F?) Allen would be the best tool in the Manufactured Housing Institute (MHI) shed to defend the Arlington, VA based trade group – as well as some of their largest members – was laughable.  But give “F” Allen credit.  At least he tried, and did so publicly.  As weak as “F” Allen’s effort may be, it is provided in full among the reports linked below, so you can decide for yourself how effective it is at defending Clayton, Cavco, MHI, et al from the mounting evidence of scandals.

Both Allen and the BuzzFeed stoked dramas have a few thinks in common. An arguable lack of objectivity, standards, or even common sense. Both rely upon an audience that may wish or hope that what the source says is true. Both cases involve the vast difference between evidence and reason, and everything else a matter of wishful thinking or a denial of reality.

Neither Kevin Clayton, nor Tim Williams, or Warren Buffett have disputed their own words or documents that have recently been reported at this link here. No conspiracy theories, evidence, documents, and direct quotes taken in context.  The sources have been given repeated opportunities to debunk or explain away the evidence.  Silence. That’s their 5th Amendment right.

So, having “F” Allen, MHI, or certain state association surrogates attempt any red herrings or head-fakes just reveals that they have no valid explanation, which implies that the linked evidence above is compelling.

Evidence, concerns, and allegations of market manipulation aren’t just in the past. They are in the here and now, and more are planned and underway for the days ahead. MHI – and some state associations – are part of that purported collusion. They are doing so despite MHI’s own published antitrust guidelines, linked here.

It’s been about a year since Richard ‘Dick’ Jennison, MHI President and CEO, cancelled at the Louisville Show “at the last minute” his presentation on the Trojan Horse of the so-called “new class of homes” and related. Jennison apparently didn’t want to be publicly questioned by MHProNews, or by anyone else in the audience that read MHProNews, and were provided a list of questions to ask during the Q&A.

They can hide, but only for so long. Because the trend lines, truth, and evidence keep drip, drip, dripping out.

You can trust George F. (F?) Allen, or not, when he says there are no conspiracies to find. But who beside aptly named “F” Allen spoke about conspiracy? We re-published evidence from the sources in question. Let people like Allen – who continues to ducks from his own controversial practices that created negative news in the mainstream media for the industry, see the linked report on the Masthead below – use head fakes. If Allen, MHI or their surrogates had a real, logical argument, why don’t they make it? Why don’t they do so in public, at Louisville?

What are they afraid of? What are they hiding from?  Do they fear the reaction of the crowd, if they realize that they’ve been duped by people they count on to represent their interests?

 

The Evolution of these Issues

In fairness to the current power structure behind MHI, this is not a new phenomenon.  Rather, sources suggest it has arguably taken on new twists and turns.

Danny Ghorbani, a structural and civil engineer, is a former Manufactured Housing Institute (MHI) Vice President and the Founding President and CEO of the Manufactured Housing Association for Regulatory Reform (MHARR).  He is a 51-year veteran of the manufactured housing industry, who has represented all aspects of the industry in Washington, D.C., including, but not limited to, manufacturers, suppliers, retailers, communities and developers, and has managed two national manufactured housing industry trade shows.  He is currently the Senior Advisor to MHARR.

Reached by MHProNews, Mr. Ghorbani stated on the record that:

From my personal experience, at any given time, the largest manufacturers tend to dominate that Association — i.e., the Manufactured Housing Institute. The same principal may well apply at the state association level.”

There are words, and then there are deeds.

 

There’s smoke and mirrors, or the clarity born of facts, evidence, and sound reason.

It’s about time to turn the page. 2018 is about to come to a close. It will be several weeks before the industry at large knows the final tallies for HUD Code manufactured housing shipments for the year. But rest assured, about a dozen (+/-) MHPros already know pretty close to what the final count for 2018 will be.

You’ll get an idea too from one of the articles in a headline linked below.

Why did the Manufactured Housing Institute (MHI) invest a purported 5 figures in a video to promote how great they are? Is it because annual dues/membership renewal time was coming up? Did the Arlington, VA based MHI want to get into the pockets of independents in manufactured housing once again? Did MHI leaders want to collect more money from independents before the disappointing totals for 2018 would be revealed?

There are many ways to point to the tragic truth that:

  • thousands of manufactured housing (MH) independents,
  • numbers of investors, and
  • millions of consumers have debatably been conned, manipulated, and cheated out of greater wealth.

We never say things like that lightly. Keep in mind, we have done our share of ‘cheer leading’ on MHProNews and on MHLivingNews for the industry too. Cheer leading is easy.  Cheer leading, when it is honest, is fun.  Telling several thousand industry pros that they’ve been ripped off?  Not nearly as much fun.  Don’t blame the messenger for the #Nettlesome message, we’re just following the evidence, tips from sources, track record, and common sense.

There came a point in time when questions, evidence, and logic opened-our-eyes as to the obvious reasons why the industry has failed to progress. Why did RVs roar past MH?  Why is mainstream housing so high, when the value of manufactured and modular homes should mean that our MH industry should be performing at much higher levels too?

When affordable housing is in crisis, and MHVille will finish about 100,000 (+/-) shipments, how is it possible that voices from Arlington keep belting out that same old tired song?

There comes a point in time when the accumulation of voices that kept telling MHProNews, ‘something is wrong here’ begs for attention. We’re returning the favor that those voices gave to us.

There comes a time to turn the page.

But a way simple way to prove the truth about MHI is to invite the leadership of the Omaha-Knoxville-Arlington axis to do the right thing.  No excuses.  Just do one thing right, one time, on one specific issue.

The Disney “Trailer” Controversy & MHI ‘Leadership’

Bragging is easy for some. But it’s performance that counts.

When MHI’s former chairman Tim Williams, who is also the president of Berkshire Hathaway owned 21st Mortgage Corp, says there’s a good case to be made that every problematic report, misuse of terminology, etc. should be challenged, it was a revealing statement.

We believe that Tim Williams was right on that point.

Why did Clayton, Warren Buffett or Berkshire Vice-Chair Charlie Munger respond to attacks on Clayton, 21st, or Vanderbilt Mortgage and Finance (VMF)? It can be oversimplified and summed up n two words.

Reputation Defense.

If Reputation Defense is good enough for Clayton, 21st, and VMF – then why isn’t a fact-based reputation defense of the entire MH industry every bit as important to MHI, or the Berkshire brands that dominate MHVille? Why has MHI already weighed in with Disney, to defend the industry’s reputation?

MHI and their masters will either weigh in on the Disney controversy – see the articles linked below – or not. It’s really that simple.

Our publisher, L. A. ‘Tony’ Kovach, has reached out to numbers of those MHI leaders on Friday. He did so bcc’ing numbers of MHI and non-MHI members. He also sent a message to an attorney who claims to represent MHI.

No excuses.  The truth will come out, period.

Either MHI and their Omaha-Knoxville and allied masters will act to defend the reputation of manufactured housing – as has:

–   Mark Weiss, JD, President of the Manufactured Housing Association for Regulatory Reform (MHARR)

–   Al Kemp, Executive Director of the Manufactured Home Park Owners (BC, Canada), and

   Paul Bradley, President of ROC USA already have.

Or MHI won’t. Simple. Clear.  No excuses.

MHI-Inspired “Boycott”?

It spoke volumes that MHI purportedly had their part-time surrogate, George Allen, call for a “boycott” of MHProNews within hours of our article and most recent headline news update being published and emailed.

Antitrust Girard Gibbs law firm says this, “A group boycott occurs when two or more competitors in a relevant market refuse to conduct business with a specific individual or company. Individual companies may always unilaterally decide to stop doing business with another company, but agreements between competitors may violate antitrust laws.”

So, there is a legal expert’s view that an organized boycott can be an antitrust violation. That means that those who were behind the called for boycott, have placed themselves in the legal cross hairs.

Those who participate, ditto.

The hypocritical irony of the call for a boycott is that GF Allen has – when he was on the outs with MHI – called MHI and their masters, Oligarchs. Allen has said in his own words that the industry was being monopolized. But sadly, the retired Marine Allen has a purported reputation for saying and doing what he thinks will give him more money, leverage, and/or attention. Rest assured, if a group of independents offered Allen a pile of cash, based on his history, he’d arguably turn on MHI again in a New York minute. His own reputation after the SECO-connected legal fiasco speaks sufficiently of his credibility. Keep in mind that just because SECO isn’t in the headlines, that doesn’t mean that the investigation and case prep aren’t ongoing.

George can say whatever stuff he wishes to say or write – within the norms of the law, ethics, etc. – but facts still matter. If Allen had proven a single claims, that might have been interesting. But instead, bomb throwing without a shred of evidence, and a call for a “boycott.”  That’s called a red herring. It’s also arguably opened Allen – and those with him – up for legal investigation, and potential action.

It would also be the reasons why industry pros should say, ‘what are the folks in Arlington and Knoxville trying to keep us from reading?’

Short of successful criminal and civil actions against the Omaha-Knoxville-Arlington axis, the next greatest thing they fear is arguably exposure.  Once the mask is completely off, then their MHI connected ‘alleged’ con game is over.

As with any con, the faces smile while pockets are being picked. Is your firm one of those pockets being picked?

After all, if those in MHVille who see MHI in a protection racket/con game fashion are correct, then the little guys are paying to have the big guys destroy the little guys own interests.

Or as Marty Lavin, an MHI award winner put it in his words, MHI only works for the little guys when that happens to match the interests of the big guys.

Within an hour of being asked, Al Kemp – who was on vacation in Hawaii when his office had contacted him – within an hour, Al had written Disney a fine message.  It was a good compliment to those from Mark Weiss and Paul Bradley. Al thought it that important.

If Al Kemp, Mark Weiss and Paul Bradley did, how about MHI?

What excuse will MHI give? Does it matter? Or if they now act only because they were pushed into it, what glory is there in that?

Do you see why our publisher has at times used satire? Don’t the tragic jokes practically write themselves?

And if MHI or the Berkshire brands do – out of shame or embarrassment – finally weigh in with Disney on their terminology issue – and they should! – then here’s the next question.  Why haven’t they done a real reputation defense of the entire MH Industry for the last few years on all similar issues?

It’s debatably time to turn the page on the failed systems and problematic leaders of recent years.

In the articles and reports that follow, several themes will come to light.

1)    There are huge opportunities in factory-built housing.

2)    Manufactured homes are underperforming.  That’s opportunity in disguise, for those who know what to do.

3)    That logically means that MHI, their allies and surrogates, have ignored reputation defense.  Doesn’t that disproportionately hurt the little guys more than the big ones?

Our sources in Washington and other cities were investigations of the Omaha-Knoxville-Arlington axis are underway tell us that these things take time. You and thousands will need to be patient, just as we are.

But there will likely come a day when you’ll wake up to a headline that’s not found first on MHProNews, but rather will be in national media. Those imagined headlines could read like this:

  • Antitrust charges filed against major firms, and trade group, details at 10.”
  • “RICO-related arrests occurred at national trade association headquarters, details at 10.”

The mantra of a con artist is ‘never, ever give up the con.’ They – whomever are in that loop – won’t likely confess, unless it is part of a plea deal with federal/state investigators. They arguably won’t admit they’re deceiving the MH industry they claim to be protecting.

The powers that be certainly won’t want to face millions of manufactured home owners – who because DTS isn’t being properly implemented by MHI, Fannie and Freddie – are arguably be cheated of lower payments, and higher resale values.

Turn the page.

2018 is almost done. 2019 is almost upon us.

Thousands of more pros are logging on daily than at this time a year ago.  Why?  Because at a minimum, they – like you – are learning to be more skeptical of the ludicrous claims made by MHI and their puppet masters.

Anyone who can produce graphics like the above, and can still smile, ask for their year-end bonuses, and do so while they tell you that 100,000 (+/-) new HUD Code manufactured homes are sold in 2018 are selling and/or smoking something.

Buying or smoking what they offer is arguably bad for your health.

Liars can lie with a straight face. Con artists can’t give up the con, because if they do, what’s left for them? Either MHI knows what they say they are doing – in which case shipments should be rising significantly, right? Or MHI and their Knoxville-Omaha masters don’t know what to do, in which case their failure to move the needle makes sense, but in that case, they shouldn’t claim to be leaders, right? Or, MHI knows what to do, and do what doesn’t work, which benefits a few that want to consolidate the industry into their hands at a discount – are there other logical alternatives? If so, please, explain it in writing, because MHI can’t or won’t.

Before we get into the purported Clayton/21st/MHI “kill shots” in our headline and feature image, a few words – a preface – are in order.

 

Preface:

We consider ourselves to be among those independent industry professionals who are positive-goals and solution-oriented people by nature.

Those who know us know us well believe we are social, gregarious, forthright, and hard working. That doesn’t mean we are perfect, but when we have a glitch, we strive to make it right, period.

We smile and laugh at comments like the one below. It is from non-MHARR source(s).  In these 2 quotes below, the “You” below should be understood in both instances as a reference to our online trade publications.

You are prolific and you keep the headlines sexy,” and “You seem to have a conceptual IQ that is more important than spelling ability.”

We’re human, we make mistakes, but once discovered or pointed out, we strive to accurately correct them.  Tim Williams at 21st/and then MHI Chairman has said as much.

 

There Was No Way to Know…

When we launched MHProNews over 9 years ago, we did not imagine nor seek the role of being the ‘communiqué cop’ to spotlight – and thus help stop – what Berkshire Hathaway has arguably been doing for years to our once far-greater industry.

Over 4 years into our project, an MHI staff leader – no doubt with their power brokers okay – had arguably set a trap. Initially, we candidly stepped into it, because we naively did not understand what in hindsight is now more clear. Once we began to discover what was going on, a non-disclosure agreement that they – MHI’s president and general counsel – insisted upon kept our mouths unfairly sealed.

But we stuck by that unjust aspect of their NDA agreement.  We did our home work.  We kept learning more and more about what we hadn’t clearly seen or understood prior to those incidents.

Meanwhile, the powers-that-be kept executing their apparent plan to conquer manufactured housing, in part by using MHI as a tool.

  • So, MHI asked to purchase our LLC’s MHProNews – their idea – they had us sign an NDA.  They then purportedly proceed to use over time what they learned about us during their ‘due diligence’ – against us, only they did so largely behind-the-scenes, per numerous sources.
  • Keep in mind that our publisher was at that time they pulled this apparent ploy an MHI board member.  L. A. ‘Tony’ Kovach was elected by his peers. Recall too that MHI elected and staff leadership had praised Tony and our team’s work for years, in front of several audiences, and often in writing.

Part of their plan was debatably to silence our independent news voice, which they apparently attempted to do by killing off our LLC’s MHProNews business.  We can look another time at parallel efforts they arguably used against MHARR or others.

So, we were absolutely not alone. As another non-MHARR source said last week, ‘some of us wake up and think about how to sell another home. Meanwhile, others wake up and think about how to put someone else out of business.’ That’s from a voice with years of Clayton Homes ties.

In that purported effort to kill our MHProNews business off, MHI and the ‘powers that be’ behind them have clearly failed.

But had they succeeded, in that fashion, we could have been no different than the thousands of locations that have been put out of business by their apparent scheme’s efforts to consolidate manufactured housing into ever fewer – and carefully selected – hands.

So not unlike:

  • closed or acquired-at-a-discount MH retailers,
  • MH Communities that were sold for too little money,
  • MH Producers that were closed or acquired for too little money,
  • And on down the list of businesses and organizations – that during an ever growing affordable housing crisis – witnessed for several years the constant and otherwise inexplicable contraction of manufactured housing.

Rephrased, we could easily have become a victim of their consolidation efforts. In our case, they wanted to shutter an independent voice that they had long praised.

Please keep all of those details in mind, because as the bullets suggest – that applies to hundreds if not thousands of other business professionals in our industry.

We are not idiots, but we were taken in by smiles, kind words, and sometimes big promises too. Aren’t those the historic pattern of every con? “You can fool all the people some of the time and some of the people all the time, but you cannot fool all the people all the time.” – Abraham Lincoln.

 

We’ve documented previously – using their own words, which they have never tried to publicly refute – how the “Moat” by Berkshire Hathaway owned brands operated in manufactured housing. One of the more recent reports is found linked just below.  Bear in mind we’ve repeatedly offered them the opportunity – they being the Berkshire brands in MHVille, plus MHI – the opportunity to refute or clarify any of their own words and actions.  To date, nada.  The offer to Clayton, 21st, MHI, Warren Buffett, et al do so in person, via video, or in writing stands.

The Feds and Others Are On Their ‘Case…’

You don’t have to take our word for it, because prior mainstream reports – some of which are found from the report link above – have documented and stated that Berkshire Hathaway brands in manufactured housing – Clayton, Vanderbilt, 21st – are among those being investigated in MHVille by the Feds or others. Or you can just “Google it.” Or see the screen capture from today, below, for some examples.

Federal investigators have been on this matter for some time. Clayton, et al, denies it all.

The Feds have candidly said these issues won’t be fixed overnight, because it is big. They told us what these dark forces are doing in our industry is not unlike what is happening in other industries. That pattern doesn’t make the Berkshire brands or those like them in other industries correct. It just sets the stage for our – and now your – fuller understanding of what’s happened that has kept manufactured housing at historically low levels for over a decade.

The report linked further below on monopolies from the New York Times will be useful to you and others in what we lovingly call MHVille.

There are professionals who are or have been in MHI, in Clayton or 21st, etc. that understand quite well what’s really been going on, while MHI and Clayton posture something different. There are those who have had long ties with the Clayton organization that know those smiling faces, but who tell us they too have suffered “the double cross.”

That’s about all we will say for now, but we have the evidence to demonstrate the above, some of which is linked from reports on this page, or cross liked from those reports.  Of course, at some point in time, such claims and concerns against Clayton, 21st, and MHI will likely have to be adjudicated. Until then, they are deemed innocent in the eyes of the law until proven guilty, or until they enter into a plea or other agreement.

That’s said to express this notion. We have been, and continue to be, pro-industry professionals. But we have come to realize the full depth of what some voices have said for years.  Some of those voices have at least for now, have gone silent or are more muted. Why they are silent, you’d have to ask them.

As noted, we remain goal and solution oriented. For our industry to grow to its potential, there are challenges from within that must be addressed.

 

From now until at least the Louisville Show, we will be making certain preparations. Hopefully before the time the Tunica Show comes around, we will unveil a plan that we will begin to outline tomorrow, which for now we will dub “Victory 2020.”

With that backdrop, we will once more note that someone or group with apparent ties to MHI has apparently been involved with having an investigator hired. The target? Our publisher. They have purportedly tried to dig up any ‘dirt’ – private, personal matters from over 20 years ago – that they think they could find and use to embarrass him, or silence him. We have been told from solid sources that a similar tactic has been tried with others in our industry.

Federal officials have been notified. They were provided with a string of ‘anonymous letters’ that were sent to our home have since we published the email shown above that was sent to:

  • Kevin Clayton,
  • Clayton attorney and MHI Executive Committee Member, Tom Hodges,
  • Tim Williams,
  • the Dick Jennison,
  • Lesli Gooch,
  • and others as shown.

It should be noted that not long after the message shown above was first published, the anonymous letters to Tony have since stopped. A coincidence?

Our preface is nearly done, and we will pivot in a moment to the headlines from the week that was. We’ve said the above to underscore how important to you some of what follows below can be. We’ll also note again what that message to Clayton et al said, if something happens to us, federal authorities who were already investigating Berkshire Hathaway brands in manufactured housing, MHI, and certain federal officials will know where to look.

There are still Patriots in America who believe in equal justice under the law. But that justice can take time.

What has happened to others or to us could happen to you or someone you care about. Our publisher has nothing to hide from, which is why the intimidation tactics sent by “whomever” didn’t work.

Tony likes to quote at times the maxim, that “You don’t catch flak unless you are over the target.”  MHProNews perhaps can be understood as being over the target then in our reports, fact checks, and analysis.

But merely exposing what has happened to our industry isn’t enough. There has to be a counterweight to MHI. Let’s be clear. There is nothing, NOTHING that they claim that they do ‘for the industry’ that can’t be done better by others.

MHProNews looks at the facts, considers the sources, and follows the evidence. MHI earlier last year, and for years before, MHI, Clayton and 21st routinely replied promptly to all inquiries. But since we’ve spotlighted the problems and concerns, they’ve gone silent. Why? If the facts are on their side, why not make offer a cogent explanation?

 

Some other options that are alternatives to MHI are already developing, as we have reported, and of course MHARR has existed for years for independent producers.

Financing, Warren Buffett has said, is where most of the money is being made by their firm in Manufactured Housing.  In fact, Clayton Homes is shown in their annual report listed under a financing category.

So it only makes sense from his point of view that Buffett – the-Moat-Builder – will have his MH lieutenants make sure that the GSEs don’t do anything useful for the majority of manufactured home communities and independents.

Next, a competitor of #4 Legacy Housing called and said that one of that firm’s smart moves is that they have created their own retail and wholesale lending.

Lending or financing is necessary for most any big-ticket business. Sam Zell famously observed that failing in creating a lending base has hurt the industry.

The Manufactured Housing Institute (MHI) brags about their big three members. When they created their videos, it was their big three members that were featured. If you are an independent, does the charts above and below inspire your confidence in their objectively supporting you?  Or does it make you see that the Big Three have taken over the lion share of the industry?

Third-party tracking data reflects that professionals among the manufactured housing industry’s giants are as dedicated to reading us as are smaller- to mid-sized firms.

Working for a giant? There are many reasons for managers or those who aspire for more read us and become sources of news and tips. If they want more, history reveals that there is only so much you can make by working for the monopolistic “company store.”

Monopolies and their cousin – oligopolies – purportedly harm every segment of society. Common sense says as much.

Warren Buffett, say critics, is buldling a new type of “company town.” Like the proverbial slow boiling of the frog in a pot of water, the placid pace nevertheless has an impact over time. Clayton has gone from an large also ran in 2002, prior to Buffett’s takeover in 2003, to some 50 percent of the industry by 2018. Monopoly? Is this a demonstration of Buffett’s “The Moat” principle at work?

  • Fewer competitors, means there are fewer opportunities.
  • Fewer opportunities means lower pay.
  • Giants are more likely to automate, which makes a worker’s or manager’s position vulnerable.

The above are akin to the thoughts from experts in other fields that study monopolies and oligopolies.

During the last three presidential administrations, the foundations were established or fostered policies and practices that led our once thriving manufactured home industry to the relative low point that it exists today. Just think, if we get past the 100,000 shipment mark in 2018, that would still be about 73 percent lower than manufactured housing was 20 years ago.

There is an affordable housing crisis.  As MHProNews and MHLivingNews have documented, third-party housing experts that studied our industry believed in the late 1990s, and early 2000s that manufactured housing would thrive. But that didn’t happen.

  • The more you think and look at the evidence,
  • the deeper you examine the facts and trends,
  • the more people of common sense see that “the system” has been rigged, as supporters of Bernie Sanders and POTUS Donald J. Trump broadly agree.

A rigged system hurts almost everyone, save the few that benefit from the system being rigged.

Monopolies of information and capital lead to monopolies of power.

The Manufactured Housing Institute has purportedly worked in concert with the majors in our industry to lead the many into habits and patterns of behavior that’s cost thousands their businesses in the last decade alone.

We follow the facts, the evidence, and the money.  Who else in MHVille trade publishing does that?  Why do the others in MH publishing gladly take the money of the majors?  How has it influenced their content?  These are apt questions that Danny Glover’s observation compels thinking people to ponder.

The following are facts.  Professionals like:

  • the Claytons’,
  • Nathan Smith, and
  • numerous allies of Warren Buffett and Berkshire Hathaway are backing Democratic candidates to oppose Donald Trump’s candidates in the GOP.
  • 7 of the top 10 billionaires back Democrats. How could so many people not see that the Democrats are the party of the rich that have corrupted our system?  That’s not to say that every GOP leader was pure. We strive to use a principle of separating the wheat from the chaff, with every source. But as independents, if you compare the two parties, looking at the facts, it becomes obvious that the mainstream media and money are largely with Democrats.
  • In MHVille, if you look beyond MHProNews, at the bloggers and publishers, most of them are bought and paid for by the big money people behind MHI, right?
  • Democrats are trying to buy elections. Billionaires and others are pouring money into Democratic campaigns.
  • That said, even push-polls are starting to reveal the shifting-tide away from candidates like Beto O’Rourke toward conservatives like Ted Cruz who are backing the pro-growth, pro-jobs, pro-independent businesses Trump Agenda.

Forbes estimates that the president’s net worth has dropped about one billion dollars since his election. President Trump has said on the campaign trail, it’s worth the loss of billions if he can help rally the nation so that we the people can together retake our country.
