Owners Report Increased Profits, Compensation, Expansion Plans

The Small Business Optimism Index increased in May to the second highest level in the NFIB survey’s 45-year history,” said the National Federation of Independent Businesses (NFIB) to the Daily Business News in a release. “The index rose to 107.8, a three-point gain, with small businesses reporting high numbers in several key areas including compensation, profits, and sales trends.”

Hundreds of manufactured housing firms are represented by the NFIB, as a source with the Washington, D.C. based organization told MHProNews in 2017.  All told, some 325,000 small businesses of all kinds are NFIB members.

Main Street optimism is on a stratospheric trajectory thanks to recent tax cuts and regulatory changes. For years, owners have continuously signaled that when taxes and regulations ease, earnings and employee compensation increase,” said NFIB President and CEO Juanita Duggan.

The NFIB is celebrating 75 years serving as “the voice of small business.”

Their May 2018 report hit several records:

  • Compensation increases hit a 45-year high at a record net 35 percent.
  • Positive earnings trends reached a survey high at a net three percent.
  • Positive sales trends are at the highest level since 1995.
  • Expansion plans are the most robust in survey history.

Small business owners are continuing an 18-month streak of unprecedented optimism which is leading to more hiring and raising wages,” said NFIB Chief Economist Bill Dunkelberg.

While they continue to face challenges in hiring qualified workers, they now have more resources to commit to attracting candidates.”

Access to credit continues as a non-issue with 37 percent of owners reporting all credit needs were satisfied and 43 percent saying they were not interested in a loan, down seven points from last month and the lowest reading since 2007,” said NFIB. “Only one percent reported that financing was their top business problem. Owners planning to build inventories rose three points to a net four percent, the nineteenth positive reading in the past 20 months.”

NFIB was an important part of the coalition that supported the Tax Cuts and Jobs Act. ## (News, analysis, and commentary.)

How “Location, Location, Location” in Housing Can Shift, and Manufactured Home Industry Impact

One of the challenges facing manufactured housing for years falls under the heading of “Location.”

 

In real estate, there is an axiom that the three most important things about a property are location, location, and location. Per the Real Deal,the “Yale Book of Quotations” found the phrase used in a real estate classified ad in the Chicago Tribune in 1926,” so that notion has been around for nearly a century.

The Balance states that, “In a nutshell, location, locationlocation means identical homes can increase or decrease in value due to location.”

All of that may be true, but during an affordable housing crisis, there are tensions created by the dynamics that surround location.

It may sound like a fine point, but location is a common influence on not just housing prices, but land prices.  Among the costs associated with all forms of home building, is the cost of the underlying real estate — the value of the raw or developed land.

Rural land tends to be less costly than urban or suburban land does.  But among the reasons that urban or suburban land is higher, is that there are more people – think more demand – in a metro than in rural areas, by definition.

While there are exceptions, “that metro land cost is higher” rule-of-thumb, along with other dynamics, such as

  • work,
  • schools,
  • shopping,
  • worship,
  • social opportunities,
  • and entertainment, to name a few –

coupled with the law of supply and demand, has for centuries meant that an identical residence in a metro area will tend to cost more than the same residence in a rural setting.

Commuting time has also influenced the “location, location, location” realty mantra for those who are housing hunting.

And that last point, about commuting time, is what is facing a disruptive development that could prove useful to the manufactured housing industry.

But before moving onto the commute issue, a few specific points about manufactured homes in urban and suburban areas.

Some examples will make serve to make the case.

  • Aging manufactured home communities with locations that make them appealing for redevelopment has caused thousands of communities to vanish, while only a few hundred new properties have been opened. The linked articles can be read later for additional facts, insight, and understanding.

  • Scattered lot placements of manufactured homes have suffered from zoning discrimination – NIMBYism – an issue that tends to push the locations of homes into more rural areas, in a largely urban and suburban society.

  • Affordable Housing is in heavy demand. But when the locations that a manufactured home can be placed would require a long commute, that commute time can lead many to pass on the otherwise lower cost manufactured home option.

How Emerging Tech is Poised to Change Some, or Perhaps Much of the Above

Billionaire Elon Musks’ first hyperloop is nearing completion in Los Angeles, as the Daily Business News recently reported.

Musk is known for the Tesla, SpaceX and his Boring Company, among other ventures.

In Chicago, Elon Musk’s Boring Company has been awarded a contract to build an underground system that will hit an estimated 150 MPH. Once completed, various sources say it will make the trip from downtown to Chicago O’Hare Airport in about 15 to 20 minutes, instead of some 45 minutes.

The Verge is reporting that the project could start in 3 to 4 months. It could be finished in under 2 years.  And for cash-craving governments, note this point.  That the estimated one billion dollar project will be done using only private capital.

Using these principles, picture other metro areas developing rapid-transit people-movers – be they hyperloop or some other underground system – could dramatically reduce commute times.  That in turn would open up more opportunities for lower cost construction, such as manufactured housing.

 

Other Areas of Industry Concern

This could be part of a revolutionary change for manufactured housing’s ability to attract and sell more prospective urban buyers in the near future.  But as is often the case in MHVille, there are still hurdles.

The industry faces a range of concerns, including, but not limited to:

  • Public perception;
  • Financing – such as a robust Duty to Serve (DTS), plus reforms to FHFA and other GNMA lending;
  • Arguably monopolistic practices – which concerned industry and other expert voices believe is and has been stunting the industry’s growth;
  • Failure to enforce the law, particularly the Manufactured Housing Improvement Act of 2000, and the aforementioned DTS and related.

Investors, consider what this could mean for those willing to think long-term, and act with vision, passion, and drive.  This could prove to be one of several possible magnets, attracting more to enter into the manufactured housing space. $1.2 Billion Settlement Proves FEDs Are Serious; Communities, Industry Head$ Up

For those who wonder if the Trump Administration is serious about enforcing laws, a $1.2 billion dollar settlement should put that question to rest.

 

U.S. Housing and Urban Development (HUD) Secretary Ben Carson…announced a historic agreement with the nation’s largest public housing authority to correct dangerous lead-based paint and other health and safety hazards,” HUD said in a release to the Daily Business News.  

HUD, the Justice Department, and the U.S. Environmental Protection Agency (EPA) reached a Consent Decree with New York City and the New York City Housing Authority (NYCHA) to resolve widespread issues of lead, mold, pest infestations and other inadequate housing conditions.  Read the Federal Complaint and the Consent Decree filed today in federal District Court for the Southern District of New York.”

Note that some of these listed items are similar to concerns raised by the Chattanooga Times Free Press with respect to allegations about Tom Lackey, still shown today as a SECO board member.

“More than 400,000 residents live in NYCHA properties, exceeding the number of residents living in the next ten largest public housing authorities combined.  In addition to the agreement announced today, New York State placed NYCHA under a state of emergency order in April and is committing up to $550 million to assist the public housing authority in resolving health and safety issues.

This historic agreement marks a new era for New York City’s public housing, one that puts families and their children first,” said HUD Secretary Carson.  “New York City and New York State are making an unprecedented commitment to put NYCHA on a new path.  The cooperation of Federal, State and city officials will vastly improve the living conditions for hundreds of thousands of New Yorkers who call NYCHA home.”

U.S. Attorney Geoffrey S. Berman stated: “NYCHA’s failure to provide decent, safe, and sanitary housing is simply unacceptable, and illegal. Children must be protected from toxic lead paint, apartments must be free of mold and pest infestations, and developments must provide adequate heat in winter and elevator service. NYCHA has put its residents at risk. Today’s unprecedented settlement will improve life for the 400,000 residents who call NYCHA home, while ensuring accountability, reform, and oversight at this troubled institution.”

HUD’s Principal Deputy Inspector General Helen M. Albert said: “We are proud of the integral work that the OIG staff performed which led to today’s settlement. This represents a consequential partnership with the U.S. Attorney and others to ensure that those who reside in NYCHA housing will do so in safe and sanitary conditions.”

EPA Administrator Scott Pruitt said: “Instead of protecting children from lead poisoning, NYCHA systematically violated EPA and HUD lead paint safety regulations and covered up its noncompliance. Today’s landmark settlement puts a stop to that. It is not only a great example of what EPA and HUD can achieve by working together, but it also sends a strong message to housing authorities, landlords, and renovators – violating the law and endangering public health will not be tolerated. This agreement will dramatically improve the living conditions of New York City’s most vulnerable residents.”

In addition to annual public housing capital funding from HUD, New York City will provide the following financial investment to support NYCHA under this agreement:

  • $1 billion in capital funding over the first four years of the agreement;
  • $200 million in capital funding each year after the initial four-year period;
  • Additional operating and capital funds through 2027; and
  • The City will continue its current practice of not seeking payments from NYCHA for ‘payments in lieu of taxes’ and police services.

Working with the court-appointed Monitor, NYCHA will also institute a number of institutional changes at the agency.  These changes include the creation of a new Compliance Department to ensure NYCHA meets all federal, state and local regulatory requirements and ensures the integrity of physical inspections.  NYCHA will also create a new Environmental Health and Safety Department to address lead-based paint hazards, mold, heating, pests, elevators, air quality and other physical conditions that affect residents’ health or safety. In addition, NYCHA will create a Quality Assurance Unit to verify the completion and quality of maintenance work.

The Consent Decree resolves the Federal government’s civil complaint against NYCHA.  As a result of the agreement, HUD will lift it’s ‘zero threshold’ for NYCHA and allow the agency to resume spending its existing public housing capital funding without seeking prior HUD approval.  This year alone, HUD is providing NYCHA nearly $1.5 billion to further assist the agency to meet its capital needs and to operate its programs.

We’ve been encouraging for some time the separation of the “chaff and wheat” approach.  No one is perfect. But at the same time, the industry ought to defend its image by enforcing a reasonable, fair-to-all code of conduct.

President Donald Trump and North Korean leader Kim Jong Un signed an agreement at the conclusion of Tuesday’s historic summit,” stated CNBC.

 

The summit in Singapore has been front-page news, as well as a cable and media headline globally.

Reuters says POTUS Trump told Kim they will have a “terrific relationship.”

Nice to meet you Mister President,” Kim said alongside Trump, with a backdrop of North Korean and U.S. flags, per Reuters.

The meeting was hailed by former NBA Star Dennis Rodman, which will be reviewed further below, along with part of the White House pressroom statement to MHProNews, plus potential manufactured housing industry market analysis, and impacts.

Joint Statement of President Donald J. Trump of the United States of America and Chairman Kim Jong Un of the Democratic People’s Republic of Korea at the Singapore Summit

President Donald J. Trump of the United States of America and Chairman Kim Jong Un of the State Affairs Commission of the Democratic People’s Republic of Korea (DPRK) held a first, historic summit in Singapore on June 12, 2018.

President Trump and Chairman Kim Jong Un conducted a comprehensive, in-depth, and sincere exchange of opinions on the issues related to the establishment of new U.S.-DPRK relations and the building of a lasting and robust peace regime on the Korean Peninsula. President Trump committed to provide security guarantees to the DPRK, and Chairman Kim Jong Un reaffirmed his firm and unwavering commitment to complete denuclearization of the Korean Peninsula.

Convinced that the establishment of new U.S.-DPRK relations will contribute to the peace and prosperity of the Korean Peninsula and of the world, and recognizing that mutual confidence building can promote the denuclearization of the Korean Peninsula, President Trump and Chairman Kim Jong Un state the following:

  1. The United States and the DPRK commit to establish new U.S.-DPRK relations in accordance with the desire of the peoples of the two countries for peace and prosperity.
  2. The United States and the DPRK will join their efforts to build a lasting and stable peace regime on the Korean Peninsula.
  3. Reaffirming the April 27, 2018 Panmunjom Declaration, the DPRK commits to work toward complete denuclearization of the Korean Peninsula.

Having acknowledged that the U.S.-DPRK summit — the first in history — was an epochal event of great significance in overcoming decades of tensions and hostilities between the two countries and for the opening up of a new future, President Trump and Chairman Kim Jong Un commit to implement the stipulations in this joint statement fully and expeditiously. The United States and the DPRK commit to hold follow-on negotiations, led by the U.S. Secretary of State, Mike Pompeo, and a relevant high-level DPRK official, at the earliest possible date, to implement the outcomes of the U.S.-DPRK summit.

Note that the document is not a treaty, which would require ratification by the U.S. Senate. Rather, it is a statement of mutual intentions.   There is much work still to be done, as the White House’s statement to MHProNews admits.

That said, the meetings went smoothly and swiftly, which reflects careful planning.

That’s a bold contrast to the claims of chaos that some in the media have mischaracterized these hopeful developments. Prayers from around the world were reported from a variety of leaders.

Rephrased, the event lays waste to the narrative of many of the ‘destroy Trump’ voices in the media.

The White House press room tells the Daily Business News on MHProNews that “Secretary of State Mike Pompeo [is] OptimisticDonald Trump-Kim Jong Un Summit Will Set [the]  Framework’ for Denuclearization.”

North Korea…has [previously] shown little appetite for surrendering nuclear weapons it considers vital to the survival of Kim’s dynastic rule. Sanctions on North Korea would remain in place until that happened, [Secretary of State Mike] Pompeo said on Monday. “If diplomacy does not move in the right direction … those measures will increase,” according to Reuters.

Secretary Pompeo added: “North Korea has previously confirmed to us its willingness to denuclearise and we are eager to see if those words prove sincere,” stated Reuters.

Fox stated that “In a dramatic interview with CNN’s Chris Cuomo that quickly became emotionally charged, Rodman, wearing a red “Make America Great Again” hat, blasted former President Barack Obama for not taking the North Korean leader seriously.”

 

Former NBA Star Rodman, Former POTUS Obama, Race and POTUS Trump

Five years ago, Dennis Rodman said that the North Korean leader Kim Jung Un told him “certain things” to relay to then President Obama concerning potential negotiations.  But the former president “didn’t even give me the time of day — he just brushed me off, but that didn’t deter me,” the former National Basketball Association (NBA) star player said, after admitting he was “naive” when he first visited the rogue state.

The emotionally charged Rodman recounted blowback and death threats here in the U.S. after he returned from that prior meeting with Kim.  Rodman has made several good will trips to North Korea, that in hindsight may have proven to be useful.

Rodman says he wants to help bring sports to the long-isolated North Korean state.

 

MH Markets Potential?

As Daily Business News evening market watch readers know, investors and markets crave stability and certainly.

A variety of geo-political, domestic economic, and politically oriented news items have periodically roiled the U.S. markets for months. That’s been true, even though the fundamentals of the markets have been strong, business confidence high, and consumer confidence are at record levels.

Manufactured Housing Institute Issues Alert – MHI Email Compromised

In a series of news tips form industry sources to the Daily Business News, a new staffer, David Townsend, MHI Vice President, Finance and Administration, is alerting members that MHI staffer Jenny Hodge’s email has been compromised.

 

The Arlington, VA based trade group are issuing a specific warning to the industry.  Do not open specific emails from Jenny Hodge, who is the vice president for the National Communities Council (NCC), and does research for MHI as well. Sources say the discussion of how best to address this email breach is an issue that was been brewing at MHI for about a day, before they sent the above alert.

Data and email breaches can happen to organizations of all sizes, including the federal government.

Americans deserve accountability from their government,” President Donald J. Trump said.

 

In a release to the Daily Business News, the White House press room has provided a partial list of some of what the Trump Administration sees as accomplishments on behalf of the Americans.

Through the first 500 days of the Trump Administration, the President has refocused the Federal bureaucracy to make sure that voters are truly in charge of Washington,” the release said.

Among their bullets:

President Trump has issued multiple Executive Orders that reform the Civil Service, including making union contracts open to public inspection, cutting down on taxpayer-funded union activities at Federal agencies, and easing the process to remove poor-performing workers.
The Administration is operating under a “One Federal Decision” memorandum of understanding for infrastructure, which puts the burden of coordinating complex permitting reviews on Federal officials, not applicants.
Despite obstruction from Congressional Democrats, the President has appointed a record number of Federal judges who are interpreting the law as it is written, promoting federalism, and standing for Constitutional liberties to combat government overreach.

Vice President Pence knows manufactured housing first hand, and HUD Secretary Ben Carson has praised manufactured homes as “amazing,” called the regulations frozen at HUD as “ridiculous,” telling MHProNews that he hears the industry, and wants to work with manufactured home industry companies of all sizes.

Fannie Mae produced a fine video, shown below.  But for all of the lip-service that they’ve been paying to manufactured homes, there’s no hint or mention of it in this video.  Why not?

To return to and surpass the manufactured home (MH) industry’s glory days, MH Pros must learn to look past polite words, posturing, or platitudes, to focus on realities.  For example, by every measure, the president is delivering. We’re proud to have editorially supported him during the primary and general election, and are focused on his results, not rhetoric.

Similarly, we must look at how Fannie Mae is touting on their home page their new Manufactured Home Advantage program. Much of what they say is terrific, and accurate, when it comes to the realities of modern manufactured homes.  But then they are arguably also subtly undermining manufactured housing, when they promote what amounts to the Manufactured Housing Institute’s (MHI) problematic “new class of homes.”

We asked officials at Fannie and MHI about this 2 days ago.  The reply?  Silence.

But others are speaking out.

An MHI member/producer emailed the Daily Business News blasted the GSEs for how they’re treating the vast majority of manufactured housing.  It might have been written by MHARR, but it was a MHI-only national association member.

MHARR on National Home Ownership Month

HUD Secretary Ben Carson pointed out during his tour last year that renting households average only $5000 net worth, while home owners net worth averages some $200,000. While MHARR’s advocacy is for common sense regulatory reform, the ultimate beneficiaries are citizens,” said their President and CEO, Mark Weiss in a message to MHProNews. “Thus, our motto, “Preserving the Dream of Home Ownership through Regulatory Reform.”

That said, educational and marketing efforts are the proper purview of the post-production sector of the industry,” Weiss stated.

The umbrella association that claims to promote the interests of the post-production sector were AWOL last year on National Home Ownership month. They were absent the year before as well, failing to promote the 40th anniversary of the first HUD Code manufactured homes,” the MHARR president said.

There is an urgent need to establish a reality-based post-production representation that isn’t dominated by a few major companies that would seemingly rather see the industry’s consolidation instead of protecting, educating, and promoting solutions that would benefit consumers, industry and save tax payers in the process,” said Weiss.

 

Weiss’ Thoughts, Juxtaposed to Lavin’s and Allen’s

Weiss, Allen, and Lavin have all recent called out the Manufactured Housing Institute for a variety of ways that they posturing helping all segments, but in fact work for the interests of what Lavin calls the big boys.”

Weiss, as well as others are calling for – and some are working towards – a new, post-production representation.

The independent producers of HUD Code manufactured homes already have able representation in MHARR, as the Washington Post, George Washington University, and the SBA have all helped make clear.

Pecking Order – Industry Facts

The new Skyline Champion combination represents about 17 percent of the factory built housing industry’s total shipments.

Cavco weighs in at about 13 percent, per their recent quarterly statement.  Cavco’s president, Joe Stegmayer, is a former Clayton division president.

Berkshire Hathaway owned Clayton Homes has about 50 percent of the industry’s total production, according to various industry sources, and the recent Warren Buffett, Berkshire Hathaway annual shareholder letter.

Manufactured Housing Association for Regulatory Reform (MHARR) Pressing Fannie Mae, Freddie Mac to Fully Engage on Duty To Serve (DTS)

The Manufactured Housing Association for Regulatory Reform (MHARR) in written comments filed on May 30, 2018, has called on the Federal Housing Finance Agency (FHFA) — the federal regulator of mortgage giants Fannie Mae and Freddie Mac — to significantly revise and amend the final rule that it issued on December 29, 2016 to implement the Duty to Serve Underserved Markets (DTS) mandate incorporated by Congress in the Housing and Economic Recovery Act of 2008 (HERA) and related FHFA “guidance” for evaluating the Government Sponsored Enterprises’ supposed DTS compliance plans that became effective on January 1, 2018,” the Washington, D.C. based trade group told the Daily Business News via a news release.

 

MHARR’s comments were submitted to FHFA pursuant to a “Notice of Regulatory Review” published in the Federal Register on April 5, 2018, seeking comments on FHFA regulations that “should be modified, streamlined, expanded, or repealed to make [FHFA’s] regulatory program more effective or less burdensome in achieving its objectives” in accordance with a 2012 Regulatory Review Plan developed under Executive Order 13579 (“Regulation and Independent Regulatory Agencies,” issued July 11, 2011),” with emphasis added, per the MHARR release.

Based on this request – and in order to bring both Fannie Mae and Freddie Mac into full compliance with DTS — MHARR’s comments call for substantial amendments to: (1) FHFA’s final DTS implementation rule; (2) FHFA’s DTS plan “Evaluation Guidance;” and (3) Fannie Mae and Freddie Mac’s DTS implementation plans themselves, given the patent failure and inability of these regulatory actions to effectively implement the DTS mandate in a market-significant and timely manner,” per MHARR.

In part, MHARR’s comments stress that a supposed “lack of information” regarding the performance of manufactured home chattel loans – which comprise upwards of 80% of the HUD Code market) – more than a decade after the enactment of DTS is both disingenuous and evidence of the type of continuing bias against manufactured housing and manufactured homebuyers at Fannie Mae and Freddie Mac that DTS was meant to remedy in the first place,” according to their statement.

There is no similar known effort being made by the Manufactured Housing Institute (MHI), which sources say has postured a push for DTS, but whose prior chairman, Tim Williams, has said in published comments was a “waste of time.”

MHARR has previously noted that every day that DTS isn’t fully implemented is a “gift” to the Berkshire Hathaway lenders.

Further,” said MHARR, “the comments note that the supposed chattel loan “pilot programs” included in the Enterprises’ DTS “implementation” plans, are little more than token efforts that would serve slightly more than 1% of the manufactured housing market with no assurance whatsoever of expanded secondary market or securitization support for manufactured housing chattel loans at any time in the foreseeable future. As such, the supposed DTS compliance plans – and the final DTS rule and Evaluation Guidance that they are based on – are wholly inadequate to “effectively” implement DTS and must be revised in accordance with FHFA’s 2012 Regulatory Review process.”

In Washington, D.C. MHARR President and CEO Mark Weiss said: “The continuing failure of FHFA, Fannie Mae and Freddie Mac – more than a decade after the enactment of DTS — to take concrete and market-significant steps to increase the availability of chattel loans for lower and moderate-income manufactured homebuyers is inexcusable and in defiance of the law and the will of Congress.

Weiss elaborated.

 Using the alleged lack of chattel loan “data” as a risible excuse, FHFA, Fannie Mae and Freddie Mac are standing in the way of greater competition in the manufactured housing finance market and lower,” he said, “more competitive interest rates for consumers that would allow many more Americans to purchase a truly affordable home of their own. Conversely, the failure to implement DTS as written and intended by Congress, will have the negative consequence of driving more consumers into the arms of the current industry-dominant lenders and their higher-cost loans. DTS is far too important to allow it to be emasculated by Fannie Mae and Freddie Mac and their enablers within and outside the industry.”

Attorney General Sues Manufactured Home, Modular Housing Company, and owner Stanley Hall

New York “Attorney General Barbara D. Underwood today announced an order directing Walker’s Manufactured Housing, Inc. (“Walker’s”) and its owner, Stanley Hall, to explain their failure to sit for testimony as required by the Attorney General’s subpoena,” said in a release to the Daily Business News.

Underwood is the acting AG in New York. She took over the role recently, after a scandal forced the resignation of her predecessor earlier this month. 4 different women alleged that prior AG Eric Schneiderman sexually assaulted and abused them, per the New York Times.

Following multiple consumer complaints, the Attorney General’s office opened an investigation into the company’s business practices and issued a subpoena for Stanley Hall to appear for questioning,” the state tells MHProNews.

Mr. Hall refused to answer questions, improperly asserting a blanket Fifth Amendment privilege, and terminated the hearing. The order issued by Supreme Court Judge James P. McClusky of Jefferson County compels Walker’s and Stanley Hall to explain why the Judge shouldn’t further order their compliance with the Attorney General’s investigation, per the NY AG’s office.

Multiple consumers in Jefferson County filed complaints with the Attorney General’s office regarding the advertising, sales, and installation practices of Walker’s Manufactured Housing, Inc.,” stated the attorney general’s office.

The Attorney General issued a subpoena to Stanley Hall to appear for questioning.  But Hall refused to answer any questions and terminated the hearing, per the AG’s release. The order announced gives Walker’s and Mr. Hall until late June to explain their failure to properly provide testimony to aid the Attorney General’s investigation.

Mr. Hall said he has never received any complaints of incomplete buildings, delays, not following design specifications or other similar accusations in 52 years of business. When asked why he asserted his Fifth Amendment rights during the conference, Mr. Hall said he was following his attorney’s advice,” per the Watertown Daily News.

There’s a lot of false information; a lot of false accusations” from the AG’s office, Mr. Hall told local media.
