A True Story.

An independent contractor was working for a multi-state company (MSC).  The Contractor did good work, the MSC’s president, key staff, plus rank and file praised him publicly and privately.  A payment (bonus) – part of a written agreement – was coming due to the Contractor, a 5 figure one, which would be the first of many.  The principle/CEO of the MSC decided not to pay, and threatened Consequences for the Consultant if he tried to collect.  

As the MSC had attorneys and deep pockets, what was the Contractor to do?  All direct appeals to the MSC were met with deaf ears.

In sharing this story and what follows, I’m not taking sides.  Nor is this story necessarily praising or condemning either party, both of whom I know personally.   

With the odds stacked against the respected Contractor, he creatively decided to turn his disadvantages to his benefit.  He interviewed some law firms, and because the Contractor had good records and could prove performance and good reviews from the MSC, he found an attorney willing to take his case on contingency.  

First a demand letter, then the suit.  After the normal pre-trial activities, once the MSC realized they’d lose, they settled.  The MSC paid more in attorneys fees, lost time and the settlement than the amount they tried to withhold from the Contractor.  Plus, they obviously now felt they could  no longer could turn to the Contractor for future, useful services.

The Contractor used jujitsu, turning the ‘stronger’ and ‘larger’ MSC’s “advantages” into disadvantages. 

The lesson? 

When you face a problem, step back.  Think things through.  Often you can turn the force of a challenge – or even an unjust attack – into an advantage. ##

Taking Chance revisited for the 4th of July, 2014

taking-chance-kevin-bacon-Image-credit-HBO-FilmsTaking Chance won Kevin Bacon a Golden Globe, the film garnered 10 Emmy nominations and was featured at Sundance in 2009. In my recent experience watching "Taking Chance," at first, I wasn't sure…

…but it didn't take long before I was hooked. If you've not seen it, please do or watch it again, especially as we come up on the Fourth of July.

Wikipedia said;

"One review from The Baltimore Sun, said that it "… is one of the most eloquent and socially conscious films the premium cable channel has ever presented," and USA Today, said "A small, almost perfectly realized gem of a movie, Taking Chance is also precisely the kind of movie that TV should be making.""

"Taking Chance is a 2009 historical drama film based upon the experiences of Marine Lt. Colonel Michael Strobl (Kevin Bacon), who escorted the body of a fallen Marine, PFC Chance Phelps (posthumously promoted to LCpl), back to his hometown from the Iraq War."

Praised in part for not taking a political "side" in the Iraq conflict, this fine film tells us why we should be proud of our Marines and the military in general.

Here in the U.S., we are so fortunate that the founding fathers had the courage to lay their lives, fortunes and sacred honor on the table to give us a chance to live in freedom. May we respect all that have held to, fought for and defended those priceless rights. ##
